Eviction from universities` hostels caused by quarantine regime 

Yesterday appeared the materials about the needless to move out of the universities hostels in cause of quarantine from Kyiv and Odesa. The Association considers that such measures aren`t possible.  

UAS`s student rights protection department prepared a legal justification according to the precedents with living in dormitory which were caused by quarantine regime.

The most important points:

 • The administration is not entitled to evict or not to provide temporary services unless otherwise provided for in the residence agreement. Check the contract and internal documents of the educational institution;

• The Chamber of Commerce and Industry did not recognize the quarantine as force majeure, as irresistible force for universities. The Cabinet of Ministers and the Ministry of Education and Science did not impose direct orders on eviction, lack of service, in case of quarantine, recognized groundless.

 • It isn`t an eviction if you are temporarily leaving the university hostel (place of residence). Eviction is a termination of contract;

 • All actions of educational institutions should be agreed with students` self-governments.

Now it is not clear how students will go to ordinary cities. Because as was marked in previous post of Association: from March 18 all interregional and intercities transporting will be cancelled. Therefore, UAS calls on the administrations of universities and colleges to stop sharing on illegal requirements.

The Ministry of Education and Science provided an explaining letter today about eviction requirements. If eviction attempts continue, the Ministry recommends to contact with directorate of higher education and education of adults.
