Welcome to SuperBoard! These Terms of Use ("Terms") govern your access to and use of the SuperBoard mobile application (the "App"). Please read these Terms carefully before using our App.

By downloading, installing, or using the SuperBoard App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

1. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the SuperBoard App for your personal, non-commercial purposes on any iOS device that you own or control, as permitted by the Apple App Store Terms of Service. All rights not expressly granted to you in these Terms are reserved by us.

2. App Features and On-Device Processing

SuperBoard provides features powered by artificial intelligence, including AI Voice, Fix Grammar, Continue Text, Paraphrase, Style, and Translate ("Features").

Our core principle is user privacy. As described in our Privacy Policy, the App is designed to perform all core data processing, including text and voice input analysis, directly on your device. We do not collect or store your typed text, voice data, or the content generated through the AI Features. Certain features, like "Translate," may rely on native iOS services, and their use is subject to the terms and policies of Apple Inc.

3. User Responsibilities and Conduct

You are solely responsible for the text, information, and content that you create, edit, or generate using SuperBoard ("User Content"). You agree not to use the App for any purpose that is illegal or prohibited by these Terms. You agree that you will not:

• Violate any applicable local, state, national, or international law.
• Generate any content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Generate content that is unlawful, defamatory, hateful, obscene, or discriminatory.
• Attempt to decompile, reverse engineer, disassemble, or otherwise derive the source code of the App or its underlying AI models.
• Use the App in any manner that could interfere with, disrupt, or negatively affect the App or its servers (even though we do not store your data, this applies to the App's integrity).

4. Intellectual Property

• Your Content: You retain all ownership rights to the User Content you create with SuperBoard. We claim no ownership over your content.
• Our Content: The SuperBoard App, including its name, logo, visual design, software, and underlying AI models, are the exclusive property of us and our licensors. These are protected by copyright, trademark, and other laws. You may not use our branding or intellectual property without our prior written consent.

5. Disclaimers and Limitation of Liability

The App and its AI Features are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied.

• No Guarantee of Accuracy: You acknowledge that output generated by artificial intelligence is not always accurate, complete, or free from errors. You are solely responsible for reviewing and verifying the accuracy and appropriateness of any content generated by SuperBoard before using or sharing it. We are not liable for any damages or losses arising from any inaccuracies, errors, or omissions in the AI-generated content.
• No Warranty: We disclaim all warranties, including, but not limited to, the warranty of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
• Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall we, our affiliates, agents, directors, or employees, be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the App.

6. Third-Party Services

The App may rely on or integrate with third-party services, such as Apple's native iOS functionalities. We are not responsible for and do not endorse any third-party services. Your use of such services is subject to their respective terms and conditions.

7. Termination

We may terminate or suspend your license to use the App at our sole discretion, without prior notice, for any reason, including a breach of these Terms. You may terminate these Terms at any time by uninstalling the App from your device.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after any such change constitutes your acceptance of the new Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
