The history of the International Military Tribunal (IWT) is a unique example of the interaction of lawyers brought up in different legal and political systems.

Why were Roosevelt and Churchill long opposed to the public trial of the Nazis?

The Western Allies believed that the process should be "not too legal", and initially did not intend to bring the main criminals to a formal trial. Nevertheless, the position proposed by the Soviet Union that there should be a trial prevailed. Prepared it though very difficult, but on a parity basis. I note that in general the initiative to hold an international court belonged to the USSR and was formulated in 1942 - in the most difficult time for our country. The Allies did not accept this idea immediately or unconditionally: the argument was that the crimes were so great and unprecedented that there were no laws that could be applied.

The American president agreed to try Hitler's leaders, but he said that correspondents and photographers should not have been allowed to the trial. The trial was supposed to be made secret. Nevertheless, the Soviet Union, which had experience in conducting show trials, believed that the tribunal should be open. The course of the process was covered by 35 to 60 journalists from the USSR alone.

Then everyone knew that a member of the MVT Ion Nikitchenko (Deputy Chairman of the Supreme Court of the USSR) and the chief prosecutor from the USSR Roman Rudenko (Prosecutor of the Ukrainian SSR) were guilty of many crimes themselves, including the infamous process of the 30s. However, the Soviets, as always, managed to audacity to neutralize the skepticism of Western colleagues regarding their ability to develop international legal norms.

Two procedural systems collided - continental, adopted in the USSR and France, and Anglo-Saxon. Four countries with different political systems negotiated. The main issue was to develop international norms acceptable to all parties involved. And this was done - the legal framework of the MVT was developed. And here the first violin was largely played by the Soviet side. The starting point was the book of the Soviet jurist with a fundamental pre-revolutionary education of Aron Trainin "On the criminal responsibility of the Nazis", published in 1944. This is the first experience of legal understanding of the crimes of Nazism. It was highly appreciated by Western jurists. It is important to understand: all the provisions of the IWT, the principles of the trial, its content and protocol - all this was developed and implemented only collectively. But there are things that are not included in the final verdict and require closer attention.

For example, the sentence ? Why did the list of criminals not include the government of the Third Reich, the General Staff, the top of the Wehrmacht and the USSR itself? We have something to fix this time. 

There are also issues that were simply silenced and not considered as a separate category of crimes. For example, the blockade of Leningrad: an attempt to starve the civilian population at that time was not qualified as a separate crime. The bombing of the city with its civilian population, the destruction of cultural institutions, etc. - all this was condemned. But the blockade of the city was carried out by order of Stalin with a civilian population. And the court as a method of war was recognized as a criminal method of warfare only a few decades later.

The Extraordinary Commission has accumulated a wealth of factual material. Evidence of the prosecution was also presented by the Central Forensic Laboratory of the Red Army, established on March 26, 1943. The tribunal was given materials found in the extermination camps liberated by Soviet troops in Poland - Auschwitz-Birkenau, Majdanek and others, concentration camps in Germany, Austria, Nazi "anatomical institutes" in Danzig (Gdansk), as well as prisoner of war camps on the territory of the USSR. Many of these materials were transferred to the Military Medical Museum in St. Petersburg after the end of the process. Now they have become the core of the "Museum of Memory of the Victims of Nazism" - a division of the Military Medical Museum that opened in the spring of 2020.

The Baltic Waffen-SS, which committed atrocities no less than the German SS, were not mentioned as criminal organizations at the trial.

By February 1946, the Soviet side had prepared to present more than 500 evidence at the trial. Among them are original German documents, verdicts of military courts, more than 60 reports of the ChGK and government commissions of Eastern European countries.

A huge number of witnesses were interviewed. Only a small part of them spoke at the trial. Among the famous testimonies is the speech of Academician Orbeli about the destruction in Leningrad and Archpriest Lomakin about raids and shelling during divine services in the Leningrad region. By the way, the international community was very surprised precisely by the fact that priests speak from the atheist state.

On 20 November 1945, the International Military Tribunal began its first trial. And on the 21st, a day later, the Politburo of the CPSU (b) decided to hold a series of trials of Nazi criminals. In total, 21 tribunals were held on the territory of the USSR, which revealed in detail the essence of the criminal acts of the Nazis and their accomplices. The largest of them are Riga, Leningrad, Kiev, Minsk, Khabarovsk... These tribunals were not international, but, of course, were in the wake of the key principles of the IWT - the primacy of law over the political situation, the inevitability of retribution, the inapplicability of the statute of limitations to crimes against humanity.
