Nikola Founder Trevor Milton Sentenced to 4 Years in Prison for Fraud

Phoenix, AZ — December 18, 2023

Trevor Milton, the embattled founder of electric truck startup Nikola Corporation, was sentenced to four years in federal prison today for defrauding investors with false claims about the company’s technology.

U.S. District Judge Edgardo Ramos handed down the sentence after Milton was convicted in October 2022 on three counts of criminal fraud, including securities and wire fraud. Prosecutors argued that Milton misled investors by exaggerating Nikola’s progress, including claims that the company had fully functional hydrogen-powered trucks when it did not.

'This was not a simple mistake or optimistic exaggeration—this was a deliberate scheme to deceive,' Judge Ramos said during the sentencing.

The case stemmed from a 2020 report by Hindenburg Research, which accused Nikola of being an 'intricate fraud.' The report revealed that a promotional video showing a Nikola truck 'driving' was actually footage of the vehicle rolling downhill with no propulsion.

Milton, who stepped down as Nikola’s executive chairman in September 2020, maintained his innocence throughout the trial. His defense argued that he was a visionary entrepreneur who believed in his company’s mission.

Nikola, once valued at over $30 billion—briefly surpassing Ford—has since seen its stock plummet. The company continues to operate but has faced production delays and financial struggles.

Milton was also ordered to pay a $1 million fine. His legal team has indicated plans to appeal the verdict.

This case marks one of the highest-profile convictions in the wave of scrutiny over SPAC-backed companies and their founders’ claims. Legal experts say it could set a precedent for accountability in the electric vehicle industry.
