A Manassas City, Virginia, teen accused of sexting a video of his penis to his girlfriend is now being threatened with a search warrant...that requires more pictures of his penis. You see, search warrants involving human anatomy can be tricky; you can't just burst into someone's house and seize the evidence. Manassas City police and Prince William County prosecutors are demanding that the 17-year-old boy re-create his erect penis to determine whether it matches the sext.

The boy's 15-year-old girlfriend allegedly sent photos of herself to him, and he responded with the video. The girl's mother filed a complaint, and the teenager has now been charged with possession of child pornography and manufacturing child pornography — both felonies. If found guilty, the boy could face jail time until he's 21 and be listed on his state's sex offender database for the rest of his life. Now, the teen's defense lawyer, Jessica Harbeson Foster, is trying to stop the search warrant from being granted."The prosecutor’s job is to seek justice," Foster told the Washington Post. "What is just about this? How does this advance the interest of the Commonwealth? This is a 17-year-old who goes to school every day, plays football, has never been in trouble with the law before. Now he’s saddled with two felonies and the implication that he’s a sexual predator. I don’t mind trying the case. My goal is to stop the search warrant."Just to remind you, the search warrant requires the boy to become erect — forcibly, if necessary — so that police can take pictures of it to compare to the sext video. And that's not even the most bizarre part of this case.

As part of the search warrant, Foster claims that the officers and prosecutors were planning to take the teen to the hospital for a shot that would make him erect. Then they would whip out their cameras and snap the pics that they need. This is real life.

Foster also told the Post that Detective David Abbott, who is the lead investigator on the case, had informed her that after getting the pics that they need, he and his team would "use special software to compare pictures of this penis to this penis. Who does this? It’s just crazy."

The teen was originally charged in January, and law enforcement tried to take the shots when he was in custody.
"He said they took him to a room and took pictures of his genitalia," Stacy Bigley, the boy's aunt, told NBC. "I asked if they’re allowed to do that, and [he] said, 'I tried to refuse,' which he did. They told him if he did not they would do it by force."Apparently, that incident didn't produce the quality of shots the police were looking for because a Prince William County judge allowed the search warrant for more photos.

The police are investigating a teenage boy for sending sexually explicit material of his penis by forcibly obtaining more sexually explicit material of the boy's penis? And they're trying to prove that the teen is the pervert?
"They’re using a statute that was designed to protect children from being exploited in a sexual manner," Carlos Flores Laboy, the boy's guardian ad litem, told the Post. "To take a picture of this young man in a sexually explicit manner. The irony is incredible."
According to Laboy, the police are creating child pornography in order to crack down on it.
