Ohio Voters to Decide on Qualified Immunity Amendment in November

Columbus, OH – October 25, 2025 – Ohioans will soon have the chance to weigh in on a contentious legal issue as the 'Qualified Immunity Amendment' appears on the November ballot. If passed, the measure would make Ohio the first state to eliminate qualified immunity for police officers and other government officials, opening the door for more civil lawsuits against law enforcement for alleged misconduct.

What Is Qualified Immunity?

Qualified immunity is a legal doctrine that shields government officials, including police officers, from being personally sued unless they violate 'clearly established' constitutional rights. Critics argue it has allowed officers to avoid accountability in cases of excessive force or misconduct, while supporters say it protects law enforcement from frivolous lawsuits and financial ruin.

What the Amendment Would Do

The Ohio amendment, spearheaded by a coalition of civil rights groups, would:

Remove qualified immunity as a defense in state courts for police and public employees.

Allow individuals to sue officers directly for violations of their rights under the Ohio Constitution.

Maintain existing protections for officers who act in good faith and within the law.

Supporters, including the Ohio ACLU and Black Lives Matter activists, say the change is necessary to hold law enforcement accountable. 'For too long, qualified immunity has denied justice to victims of police brutality,' said activist Maria Johnson. 'This amendment ensures that when rights are violated, there’s a path to accountability.'

Opponents, including police unions and conservative groups, warn that eliminating qualified immunity could lead to an exodus of officers and make policing more difficult. 'This will discourage people from joining law enforcement and tie up officers in endless lawsuits,' said Ohio Fraternal Order of Police President Mark Daniels. 'It’s a dangerous overreach.'

National Implications

Ohio’s amendment is being closely watched nationwide. While Congress has debated ending qualified immunity at the federal level, no state has fully abolished it. If passed, Ohio could set a precedent for other states to follow.

Polls show a tight race, with voters sharply divided along partisan lines. The outcome could hinge on turnout in urban areas versus rural communities.

Election Day is November 4, 2025. Early voting begins next week.
