Marjorie Anderson, who met Schein as a fourth-grader, said they were like sisters. The pair lived near one another on the East Coast, traveled together and remained close after Schein's husband died. A Humboldt native, Schein worked for the Centers for Disease Control for most of her adult life, Anderson said, and had a passion for tackling the disease of tuberculosis. While living in New York City, she traveled to downtrodden neighborhoods in Harlem and the Bronx to administer TB tests to people who couldn't make it to a clinic. After transferring to Atlanta, she traveled to the Philippines and other impoverished countries to test children. By the end of her career, she was recognized by the CDC as the agency's foremost expert in mass skin-testing programs. Schein returned to Sioux Falls, Anderson said, because she felt it was a safe community with a lot to offer. Anderson soon followed her there. Schein never stopped working. She would take overnight shifts at Avera's Dougherty Hospice House so other nurses could spend time with their families, and she'd bring treats for people working New Year's Eve. She was good at it. When you're good at something, you want to keep doing it,' Anderson said. The day before Schein was killed, she called Anderson to ask her out to Bob's Carry-Out and Delivery for fried chicken. The pair talked for the first time about how thankful they were for their health and hopes for a long life. The next day, Anderson heard about the murder. She could scarcely believe the question when the detectives asked whether anyone would want to harm Schein. Schein's brother, Stan Fetters, testified that his sister was a giver and a role model for her nieces and nephews. She would plan and buy trips for them as graduation gifts, he said, because 'she loved adventure, and loved to take people along on her adventures. Reading from a letter composed by her other brothers and surviving family members, Fetters said ' Maybelle had an incredible talent to make everyone feel special and loved. Sister Leona Gauer, a nun who was a friend to Schein but also visits McVay weekly at the penitentiary, said her infectious joy would put her hospice patients at ease. Gauer also said, however, that Schein was a forgiving person and a member of the South Dakota Peace and Justice Coalition, a group that opposes the death penalty. Under the judge's orders, the victim's friends and family were not asked what the penalty for McVay ought to be. Witnesses testifying on McVay's behalf didn't touch on the topic, either. Kara Duncan, a paralegal who prepared a social history for McVay in , spoke instead of the inmate's rough upbringing and long struggles with mental illness and substance abuse. McVay's birth mother was a prostitute and heroin addict in Houston, Duncan said. McVay and his adoptive mother both said it was likely that he was exposed to the substance in utero. At 6 months old, McVay's adoptive mother said, he was thrown into a pool by his birth mother, who didn't want him any longer. His brothers pulled him out, and he was adopted into a home where, Duncan said, 'he always felt like he was somewhat of an outcast. The brothers in his new home fed him marijuana at age 10 and soon gave him methamphetamine, and McVay continued using drugs. McGowan questioned Duncan, however, on the veracity of the life story. Duncan said she'd confirmed McVay's social history through prison and mental health facility records but agreed that not everything matched up. One psychiatrist noted that McVay hadn't been physically abused as a child, for example. Ashley Miles, a deputy public defender who's worked with McVay since her time as an intern in , also testified on his behalf. McVay wrote a letter recommending Miles for a young lawyers award. Miles said McVay consistently has shown concern for his legal team and always expressed remorse for his crime. McVay had to be persuaded that his life was worth living after having killed Schein, Miles said. McGowan questioned Miles about the letter, suggesting that McVay was putting on kindness as a front to assist in his own defense. Miles told McGowan that she hadn't known about the letter and that McVay submitted it without her knowledge. The prosecution also called Associate Warden Troy Ponto to the stand Thursday to address the issue of McVay's future danger to staff at the penitentiary and other inmates. McVay lives in administrative segregation along with several other maximum-security inmates, Ponto said, but inmates who serve sentences of life without parole can earn freedom of movement throughout the facility through good behavior. Inmates on death row, however, are required by law to be housed separately in the secure segregation wing until their execution, Ponto said. Ponto pointed out that McVay threatened a correctional officer soon after his capture in Madison, Wis. I'm waiting for one of you to screw up. Then one of you will be gone,'' Ponto said, reading from a report written in July When defense lawyers questioned Ponto about McVay's potential danger, they asked whether he'd been written up again since the report, which came soon after his return to South Dakota from Wisconsin. Defense lawyers also called McVay's prison counselor, who said McVay's mental state had improved significantly during the past two years.
