Called Draft decision on establishing and improving the legal system and enforcement mechanisms for the Hong Kong Special Administrative Region (HKSAR) to safeguard national security, the law is introduced because of “the increasingly notable national security risks” in the city.

According to point 3, Hong Kong’s executive, legislative and judicial branches shall “prevent, stop and punish” any activities that threaten national sovereignty in accordance with established rules. It has not clearly indicated whether the rules refer to Basic Law Article 23.

“Hong Kong SAR shall establish a comprehensive agency and enforcement mechanism to safeguard national security,” the document reads in point 4. It adds that Chinese agencies responsible for national security will set up apparatus in the city in order to protect national security.

The law also empowers the city’s chief executive to promote national-security education, to prohibit any behaviour damaging national security and regularly submit a report regarding the subject matter to the central government (Point 5).

Last but not least, Beijing stresses in point 2 that it will deploy any necessary measures to prevent, prohibit and punish those foreign forces that use Hong Kong for secession, subversion, infiltration and destruction.
