14-year-old boy faces charges for having sex with 12-year-old girl.
HOUSTON, Texas -- A mother fears her 14-year-old son may have to register as a sex offender for having sex with his 12-year-old girlfriend.
The mother, who spoke to Eyewitness News under the condition of anonymity, said her son was detained and charged with aggravated sexual assault of a child a few months ago. The two went to the same middle school and were a grade apart, she said. He was charged because she was 12 and he was a few months older than 14.
If found criminally responsible, there could be a long-term consequence.
"Since he's 14, he's facing the possibility of being put on the sex registry. The sex registry is for people who are absolute criminals, pedophiles, child molesters, dangerous people. The worst of the worst," she said.
There is an exemption for some teens. The so-called Romeo and Juliet law protects those who have consensual sex with someone within three years of their age. So, in Texas a 17-year-old can legally have sex with a 14-year-old , but if either party is under 14, like the girl in this case, the law does not apply.
"Every parent needs to know if you have a son or daughter who's sexually active," she warned. "It terrifies us. It terrifies him. He won't have a future. He won't be able to go to school. He won't be able to get a job. He won't be able to get a job digging ditches because he won't be able to pass a background check."
That's why she and her attorney are speaking up.
"Where's the common sense? It's incomprehensible we're doing this to children in our society and something needs to change," said Joe Gutheinz, the boy's attorney.
The Harris County District Attorney's Office filed the case. A spokesman declined to comment due to juvenile privacy concerns.
Juvenile court judges decide whether delinquents are placed on the registry, which has happened, according to two attorneys who defend juveniles.
The boy's mother is asking for compassion.
"Everybody was young. Everybody has a past. Everybody has made mistakes," she added.

A married Florida middle school teacher has pleaded guilty to having sex with a 14-year-old male student and sending nude photos to him, according to multiple reports.
Stephanie Peterson, 27, faces between five and 10 years in prison after pleading guilty to one count of lewd or lascivious battery sex act with a child, a second-degree felony. If the case had gone to trial, she could have faced up to 15 years in prison.
She also pleaded guilty to one count of transmission of harmful material to minors by electronic means, a third-degree felony.
Peterson was arrested after the teen revealed the relationship to his parents. Police said the sexual relationship began in November 2017. The boy, an eighth grader, had been her student the previous year, Sheriff Mike Chitwood told Click Orlando last February.
According to court documents obtained by PEOPLE, the student said Peterson would send him nude photos. On multiple occasions, Peterson picked the boy up from his home around 11 p.m. and brought him back a few hours later while her husband was at work. The sex occurred in her house, her car and in a barn behind the student’s house. The sexual contact occurred between Nov. 1, 2017 and Jan. 31, 2018, according to the court documents.
Peterson also bought the teen marijuana and bowls for smoking it, according to the documents, though she was not ultimately charged with the drugs.
The student said that his grades began to suffer after their relationship started. He also said Peterson told him they had to keep their relationship secret.

Authorities gathered evidence of Peterson’s Snapchat messages after she learned that the boy’s mother was going to the police, according to the documents.
“I hate you,” she wrote to the student, according to the court documents. “So much.”
Then she wrote, “Please tell her it was the worst decision of my life and I know it was and idk where my brain was but that I somehow fell in love with you briefly and idk why and I’ll never be the same person because of it.”
Then she pleaded with the boy: “Delete everything.”
A sentencing date has not yet been set. The judge ordered a pre-sentence investigation to help reach a decision.
Peterson’s attorney did not immediately return PEOPLE’s call for comment
The conservative channel's host might hear from the former president about this.

In a survey out today 6% of teenage girls admit to having sex before the age of 12.
Two-thirds of sexually active under 18-year-olds lost their virginity before the age of 16.
And 40% of the young respondents said they were less than 12 years old when they first kissed a boy.
Teen magazine Sugar surveyed 1,770 girls between the ages of 12 and 18 and found that 15% admitted to having sex.
Seven per cent admitted to having had sex with “10 or more” boys and 18% said they first had sex with a boy who was not a boyfriend.
Last week it was revealed that 13-year-old Alfie Patten had fathered a baby girl. He was just 12 when he and 15-year-old Chantelle Steadman conceived baby Maisie.
Despite the risks it seems some parents adopt a relaxed attitude to their daughters’ relationships.
The survey found that 11% of girls were allowed to have boys stay the night in their bedroom. Another 34% could take boys into the bedroom and close the door and 27% had boys to stay overnight in a separate room.
Only 16% are banned from having boys in their bedroom at all.
Parents might struggle to get to know their daughters’ boyfriends as 54% of teenage girls said they would never let them meet a boyfriend and 21% would not admit to having one.
Only 11% of parents insist on meeting the boys their children date.
One teenage respondent said: “Cause my parents are so horrifically embarrassing, I would never live it down, I mention a boy’s name and all I hear is ‘Lauren’s got a boyfriend’ it’s so stupid.”
Girls admitted to feeling under pressure to have sex and 47% said that the pressure comes from their peers.
Those who do have sex found that it did not make them happy. Twenty two per cent said they felt “ashamed”, 21% felt “used” and 26% admitted to feeling “worried”.
One respondent said: “I was pressured into it by other people at school, lots of people at my school have done it before, and it wasn’t a very good time. We have been on/off for a year and we weren’t together when we did it and I thought it would make him like me more and stop messing me around, but afterward he stopped talking to me and now we hardly talk anymore.
“I was also worried that my parents would find out, because I was stupid to do it so young and I know if they find out they will be really disappointed in me, and they would go mad. I wish I had waited.”
