The criminal justice system has a compelling interest in making sure all criminal defendants appear in court for their cases. In this report, however, we focus solely on the pretrial detention of persons accused of nonfelonies (primarily misdemeanors, but also including violations and infractions), because their incarceration is uniquely difficult to reconcile with the fundamental notions of fairness and equality that should be the cornerstones of criminal justice.
