Filed by MG Premium, a subsidiary of porn giant MindGeek, the lawsuits reads, in part: “The YesPornPlease Web Site is a pirate website, displaying copyrighted adult entertainment content without authorization or license.” It’s a serious accusation. Considering the big empty hole where YesPornPlease used to house its collection of tight little holes, it sure looks like they’ve caved to the pressure of the MG Premium lawsuit. It’s aimed at the site and its host, VShare.io, suing for hundreds of millions of dollars as compensation for damages. YesPornPlease had always been a free site, so it seems unlikely they’d even have the resources to go up against the massive multinational smut empire. But did MindGeek really put them out of business?
The DMCA subpoena was filed back in September 2019, demanding all kinds of vital information about YesPornPlease and their host. Referring to conduct between both platforms as “egregious and willful,” they demanded the operator’s names, IP and physical addresses, phone numbers, posting history and presumably penis length. The subpoena didn’t yield much, except that the site was hosted by an unknown Russian company. Hell, I could have told you that much. At the time of this writing, both YesPornPlease and VShare had shuttered, displaying Cloudfare errors. Following the breadcrumbs, all anybody can really find are vague links to big domain registrars and other web companies. You know lawyers, though: they managed to pack all this non-info into a 233-page document. That book might make good spank material for the determined, though, as it catalogs 3,078 MG Premium-owned pornos allegedly stolen by YesPornPlease between July 2017 and 2020.
The MG lawsuit is most notable not for its attempt to take down a free tube, which is fairly common, but for their targeting of hosting site VShare. They allege that the site actively encouraged users to upload stolen porn to benefit from the affiliate program. Not only do they want both YesPornPlease and VShare shut down, removed from search engines and domain name registrars so nobody can see them, but also believe they’re entitled to statutory damages potentially running into the hundreds of millions of dollars.
Of course, there are two sides to every issue. Using my connections in the world on online porno, I reached out to the (former?) operators of YesPornPlease to see what they had to say.
First of all, Cloudfare (Cloudflare, Inc. is an American web-infrastructure) didn’t give us anything,” they said. “The idea that we were raking in millions is bullshit. We never earned anything. During the Republican National Convention last year, traffic to porn sites spiked dramatically in its host city, Cleveland, according to xHamster , a giant purveyor of adult content online.

That practice was all set to be banned by FCC regulations next year. Increasingly, though, the public gets it. “We always encourage our users to leave feedback via our feedback form,” Prince told the Observer in an email, via a spokesperson. “Users have submitted requests for full HTTPS encryption, especially over the course of the past several month as privacy concerns saw an uptick.”

Adult sites have been some of the last major sites online to encrypt connections with visitors. In part, they have been stymied by processing such massive pools of data and in part by relying on third-party ad networks. An encrypted site needs to encrypt absolutely everything that appears on it, Aas explained. It needs every external site it grabs assets from to participate in the encryption as well.
The Observer has been following the adult-only web’s transition closely. Thumbzilla and RedTube made the move previously, both of which are owned by Mind Geek, the same parent company that also owns Pornhub and YouPorn.
Among non-MindGeek companies, MakeLoveNotPorn made the shift in July of 2016, according to an email to the Observer from Cindy Gallop, its CEO. XVideos has an encrypted option, but it should encrypt by default.
In fairness to the GOP, it is worth noting that not all its House members voted against the FCC’s rules on Tuesday. For example, Republican Rep. Kevin Yoder of Kansas didn’t, releasing a statement following the Congressional Review Act resolution passage, saying, “In the 21st Century, Americans deeply value their privacy when it comes to digital content. We don’t want the government having access to our information without our consent, and the same goes for private business.”
This isn’t Yoder’s only recent pro-privacy move. He’s also pushed an update to laws on email privacy, as we reported. Honestly, it’s hard to understand why any principled conservative wouldn’t support consumers’ right to decide how much the wider world can know about how they use the web.
Especially if that principled conservative happens to be one that, y’know… likes the weird stuff.
