An Amanzimtoti man who is using a "Trojan horse" defence against allegations that he had more than 1 000 child pornography images on his computer, had anti-virus software and firewalls installed on his hard drive.
This was the evidence on Monday of Inspector Susanne Barnard, of the South African Police Service's Technical Support Unit, who testified at the trial of Mark Rawlinson.
Rawlinson has pleaded not guilty to 1 159 charges of possession of child pornography and one count of allowing children to view the pornography.
He claims that his computer was infested with viruses and that it was possible that a hacker had downloaded the images without his knowledge while he was on the Internet. This is done using a "Trojan horse" virus.
It is believed this is the first time such a defence has been raised in South Africa.
Because of the technical nature of the evidence, the presiding officer, Durban regional court Magistrate Trevor Levitt, is being assisted by a computer expert, Ian Melamud.
Rawlinson, 36, also has a computer expert in court, while the prosecutor, Val Lotan, will be relying on the evidence of Barnard and her boss, Senior Superintendent Beau Grobler, the commander of the Technical Support Unit.
On Monday Barnard said that after she had received the computer confiscated from Rawlinson, she had used forensic software to make a mirror image of the hard drive so that she had a "working copy" of it. She said in this way, nothing could be removed or tampered with.
On examining the copy, she had found images on the desktop, in the "my pictures" folder, in the "deleted files" folder and in the temporary Internet file.
More than 1 000 pictures were of children without clothes on and most had been downloaded from the Internet.
She said she had also discovered that a Norton Anti-Virus package had been installed on the computer in May 2005 which, she said, was activated every time the computer was switched on and warned the user if a site was infected.
"The computer also had a firewall to prevent people from hacking in," she said.
During cross-examination, defence attorney Sam Garbaran suggested that the computer had been tampered with, saying the hard drive and stiffy drive were now in a different order on the tower.
He said there were "screw marks" on the box just above the stiffy drive.
Barnard agreed that had the computer been "manipulated" before she had made the working copy, those manipulations would have been duplicated on to her copy.
She also conceded that she had not looked for viruses "because my instruction was to look only for child pornography".
Earlier in the trial, a 14-year-old neighbour of Rawlinson testified that while looking at family pictures on Rawlinson's computer, a pornographic image of a man and woman having sex had appeared on the screen.
She said she had been "disgusted and uncomfortable".
