A Chambersburg man was arrested Wednesday after investigators said they found more than 1,000 images of child pornography on his devices, some of which police believe he produced himself.
Jason Ronald Nalewak, 49, was put in Franklin County Jail on $175,000 bail, according to court records.
Authorities began investigating in January after a certain IP address was seen requesting "blocks" of child pornography files in September and December of last year, according to the charging document filed at the office of Magisterial District Judge Kelly Rock.
"While it is not an absolute certainty the user was the original requestor, with respect to each file, considering the number of requested blocks, the total number of blocks required to assemble the file, and the number of peers the user had, the number of requests for blocks of the file is significantly more than one would expect to see if the user of (the) IP address … were merely routing the request for another user," police wrote in the affidavit of probable cause.
Through a subpoena issued to Comcast, police learned the IP address was assigned to Jason Nalewak and that it served an address in the 6000 block of Olde Pine Drive, Guilford Township, according to the affidavit.
State police executed a search warrant at Nalewak's home on Sept. 1 and seized a Samsung Galaxy phone, a hard drive and a laptop.
An examination of the devices turned up 1,085 photos depicting "apparent child pornography that included individuals under the age of 18 involved in various stages of undress as well as sexual acts," according to the affidavit.
The laptop contained 771 images, while the hard drive had 189 and the phone had 125 images.
The images found on the cellphone "display characteristics that are consistent with produced child pornography," the affidavit states. Several photos showed a girl that appeared to be between the ages of 9 and 13 lying on a bed sheet that was white with multi-colored vertical lines. It appeared identical to one police photographed while executing the search warrant at Nalewak's home, according to charging documents.
Police executed another search warrant at Nalewak's home on Oct. 10. From a bedroom that appeared similar to the one seen in the photos on Nalewak's phone, police seized two white sheets with multi-colored stripes. They also took two pairs of underwear and two pairs of shorts that look like ones depicted in photos seen on the phone.
A blanket featuring a character from the movie "Frozen" was also taken from the home, police said.
Nalewak was already facing charges related to sexual abuse of a child before he was arrested in the most current case, according to court records.
Nalewak was charged Aug. 22 with two counts of corruption of minors and one count of indecent assault of a person under age 13, according to court records. He was released on $25,000 unsecured bail.
Amid the child pornography investigation, in July state police at the Chambersburg barracks received a report from Franklin County Children and Youth Services that a 10-year-old girl had accused Nalewak of having inappropriate sexual contact with her at his home.
During an interview at the Over the Rainbow Child Advocacy Center in Chambersburg, the girl said Nalewak got in bed with her and touched his genitals, according to the charging document in that case. She described hearing a "slimy noise," the document states.
She said he put his hand in her underwear "again and again and again," according to the document. She described moving around to let him know she was awake and to try to get him to stop, but he did not stop.
The girl said after he was done, Nalewak told her to not tell anyone because "it was a secret between us," according to the document.
The girl also reported seeing Nalewak "playing with himself" on other occasions, according to the charging document.
A preliminary hearing in the most recent case is scheduled for 1:30 p.m. Oct. 25 before Judge Rock in Franklin County Central Court.
In his previous case, the preliminary hearing was continued from Sept. 27 to Nov. 8. That one is scheduled for 9:30 a.m. in central court.

More than 200 Australians have collectively paid more than $1.3 million to watch live streamed child sexual abuse filmed in the Philippines.

And the offenders often request how they want the child to be sexually abused as the crimes are happening, a new report says.
The shocking statistics were revealed on Wednesday in a report by the Australian Institute of Criminology , which says it has identified more than 2,700 financial transactions linked to 256 webcam child predators between 2006 and 2018.
The institute said it matched the transactions using AUSTRAC (Australian Transaction Reports and Analysis Centre) records that linked the accounts in Australia to people arrested for child sexual exploitation in the Philippines.
The live-streaming nature of the material was particularly sickening, the institute’s report noted, because of the real-time element.
“Offenders often request how they want the child to be sexually abused either before or during the live-streaming session,” the report said.
One Australian alone spent almost $300,000 on live streamed material, the report found.
An analysis of the 256 Australians identified paints a typical profile of someone in the 50s or 60s, most (55 per cent) with no previous criminal history.
The youngest live streaming purchaser was 27 years and the oldest was 82.
The report found perpetrators came from a wide range of backgrounds, with stated occupations including aged care worker, boilermaker, carpenter, chef, computer technician, driller, driver, gardener, lawn mower, rigger, road freight transporter, sales assistant and tradesperson.
“Others described their occupation as accountant, architect, clerk, general manager, quality technician and self-employed,” the report said.
“One described her occupation as housewife. “
The AUSTRAC transactions suggested many users over time escalated the frequency of access to the live-stream facilitators and increasingly spent larger amounts on each session.
The institute noted that while child sex crimes were rife in multiple countries, the Philippines has been identified by international law enforcement agencies, NGOs and academics as the global ‘hub’ for live streaming such material.
In November 2019, live streaming of child sex abuse came to national attention after AUSTRAC took legal action against Westpac Bank over 23 million alleged breaches of anti-money laundering and counter-terrorism laws.
Westpac was accused of failing to monitor $11 billion worth of suspicious transactions, including those to the Philippines suspected to be for child sexual exploitation.

WASHINGTON (CNN) -- The U.S. Supreme Court Tuesday struck down a 6-year-old law that prohibits the distribution and possession of virtual child pornography that appears to -- but does not -- depict real children.


The law had banned a range of techniques -- including computer-generated images and the use of youthful-looking adults -- which were designed to convey the impression of minors engaging in sexually explicit conduct.


The 6-3 ruling says the law violates the First Amendment guarantee of freedom of speech. The decision hands a major setback to the Justice Department and the majority of Congress in their legislative efforts to fight child pornography.


Writing for the majority, Justice Anthony Kennedy said key provisions of the Child Pornography Prevention Act of 1996 were "overbroad" and infringed on established protections of material with artistic value that does not violate community standards.


"Pictures of what appear to be a 17-year-old engaging in sexually explicit activity do not in every case contravene community standards," the court said.


"The (Act) also prohibits speech having serious redeeming value, proscribing the visual depiction of an idea -- that of teenagers engaging in sexual activity -- that is a fact of modern society and has been a theme in art and literature for centuries."


The opinion cited several artistically significant instances in which teenage sex was portrayed, including William Shakespeare's play "Romeo & Juliet," and the recent movies "Traffic" and "American Beauty."


Kennedy was joined by justices John Paul Stevens, David Souter, Ruth Bader Ginsburg and Stephen Breyer. Clarence Thomas wrote a separate opinion agreeing with their conclusion.


Justices Sandra Day O'Connor, in a dissent, disagreed with much of the majority opinion, and was joined by Chief Justice William Rehnquist and Antonin Scalia.


In a separate dissent Rehnquist, backed by Scalia, strongly disagreed with the majority, saying "the computer-generated images are virtually indistinguishable from real children."


The ruling came in a case named Ashcroft v. The Free Speech Coalition. U.S. Attorney General John Ashcroft and President George W. Bush's Justice Department inherited defense of the law from former Attorney General Janet Reno and the President Clinton Justice Department, which had defended the law in the lower courts.


The Free Speech Coalition is comprised primarily of a trade association of publishers of pornographic materials.


Ashcroft said he was disappointed by the court's decision.


"This morning the United States Supreme Court made our ability to prosecute those who produce and possess child pornography immeasurably more difficult," Ashcroft said.


Ashcroft said the Justice Department would use every resource to prosecute child pornography cases and said child pornographers "will find little refuge in today's decision."


He said he would work with Congress to pass new laws that would survive the court's scrutiny.


"I believe today's opinion and the Constitution leave open legislative avenues to protect our children from harm and we will seek to develop the means to do so with legislative endeavor," Ashcroft said.


Still to be decided by the Supreme Court this spring is another case involving a separate law, which specifically restricts the access of minors to sexually explicit material on the Internet.
