HOUSTON, Texas (KTRK) -- A mother fears her 14-year-old son may have to register as a sex offender for having sex with his 12-year-old girlfriend.
The mother, who spoke to Eyewitness News under the condition of anonymity, said her son was detained and charged with aggravated sexual assault of a child a few months ago. The two went to the same middle school and were a grade apart, she said. He was charged because she was 12 and he was a few months older than 14.
If found criminally responsible, there could be a long-term consequence.
"Since he's 14, he's facing the possibility of being put on the sex registry. The sex registry is for people who are absolute criminals, pedophiles, child molesters, dangerous people. The worst of the worst," she said.
There is an exemption for some teens. The so-called Romeo and Juliet law protects those who have consensual sex with someone within three years of their age. So, in Texas a 17-year-old can legally have sex with a 14-year-old , but if either party is under 14, like the girl in this case, the law does not apply.
"Every parent needs to know if you have a son or daughter who's sexually active," she warned. "It terrifies us. It terrifies him. He won't have a future. He won't be able to go to school. He won't be able to get a job. He won't be able to get a job digging ditches because he won't be able to pass a background check."
That's why she and her attorney are speaking up.
"Where's the common sense? It's incomprehensible we're doing this to children in our society and something needs to change," said Joe Gutheinz, the boy's attorney.
The Harris County District Attorney's Office filed the case. A spokesman declined to comment due to juvenile privacy concerns.
Juvenile court judges decide whether delinquents are placed on the registry, which has happened, according to two attorneys who defend juveniles.
The boy's mother is asking for compassion.
"Everybody was young. Everybody has a past. Everybody has made mistakes," she added.

He claimed he wasn't aroused by the sick conversations with a 12-year-old however a judge told him "the evidence speaks for itself"
A pervert sent videos of himself performing a sex act to a 12-year-old girl via Snapchat.
Kenneth Cunliffe, 39, believed he was talking to a 15-year-old child, but she was actually three years younger.
Cunliffe, of Hawthorne Road, Bootle , bombarded his victim with indecent images and asked for naked pictures in return.
But he later tried to claim he wasn't "aroused" by the sick conversations - despite earlier confessing to police that he was.
Liverpool Crown Court heard Cunliffe starting talking to the girl in July 2018, having first spoken with one of her friends.
Fiona McNeill, prosecuting, said the victim asked Cunliffe why he was communicating with her friend and blocked him.
However, he contacted her again using another Snapchat account and their conversations resumed that September.
Ms McNeill said Cunliffe asked where she lived and sent a photo of a place near to her home, "which caused her some concern".
He then asked the girl how old she was, to which she said 15, and Cunliffe revealed he was 37 and told her where he lived.
Cunliffe sent her a photo of his genitalia and asked if she wanted to masturbate him, but she replied saying she was too young.

She estimated in total he sent between 10 to 15 pictures of his genitalia and around five videos of him performing a sex act on himself.
Cunliffe also asked if she wanted to meet up, but the girl declined and they last spoke to each other in November 2018.
Ms McNeill said she asked Cunliffe for a photo of his face, which he sent, and used an iPad to secretly take a picture of it.
The girl told her mum who posted the picture on Facebook and Cunliffe was arrested at his home on November 19 that year.
When cautioned, he replied: "I sent pictures of me aroused to young girls, I'm so sorry, I lied about my age, I never met any of them."
Police found pictures on his mobile phone as described by the victim, however, Cunliffe gave two "no comment" interviews.
The images actually sent on Snapchat weren't recovered, as messages on the app are automatically deleted after a short time.
Cunliffe admitted one count of engaging in sexual communication with a child and five counts of engaging in sexual activity in the presence of a child.
The girl's mum said her daughter now suffered with "really bad social anxiety" and feared going out and seeing anyone who looked like Cunliffe.
She said the child was left afraid, had struggled to concentrate on work, and she worried about her walking to and from school.
Charlotte Kenny, defending, said Cunliffe was a man of previous good character and urged Judge Gary Woodhall to spare him jail.
She said: "He made an immediate confession to what essentially he had been doing - sending pictures of himself to young girls."

The lawyer said Cunliffe hadn't tried to hide from his crimes, however, Judge Woodhall observed that he chose not to answer any questions in police interviews.
Ms Kenny said: "The references make it clear that he does have a couple of friendships, but is a man who has generally since the death of his parents led something of a solitary life."
She said a pre-sentence report found her client was "deeply ashamed" and "extremely remorseful", but needed work to challenge his problems.
Ms Kenny said Cunliffe had been "shocked to the core" by his behaviour and arrest, and was the sort of person - given his guilty pleas and confession - that the Probation Service could work with to ensure he didn't offend again.
Judge Woodhall said Cunliffe knew his victim was a child yet exposed her to sexual activity she should never have seen.
He said "thankfully" the girl refused to send him any pictures of herself.
The judge said: "There was virtually no response to what you did from her. Certainly she didn't do anything in any way to encourage your actions, quite the opposite, she told you she was too young to do the type of things you suggested. That didn't cause you to desist."
Judge Woodhall told Cunliffe: "You deny being aroused by these discussions. Frankly, that's a remarkable assertion to make."
He added: "The evidence speaks for itself."
The judge accepted there was "some prospect of rehabilitation", but said given the disparity in age, the "persistence" in Cunliffe's offending and the number of images sent including videos, the only appropriate punishment was a prison sentence.
Judge Woodhall jailed Cunliffe for 18 months and ordered him to sign on the Sex Offenders Register and to comply with a Sexual Harm Prevention O
