Some Victorian sex workers are being forced to work illegally or are using exemptions to COVID-19 restrictions to make ends meet during the state's fourth lockdown.
It is legal to be a licensed sex worker in Victoria. Despite that, many sex workers are not applying for government support payments or they are saying their grant applications have been rejected.
Melbourne-based sex worker Diana (not her real name) — who also does some work in regional Victoria — said some sex workers were using the intimate partner rule to see regular clients because they had no other choice.
"I was naughty and I had a few regulars that I would see [during lockdowns]. I also had sugar daddies who were paying my bills, so I was lucky," she said.
"There's definitely sex workers who continue working, despite the restrictions, because we have to — people have to eat, they have to pay their rent. I have to dig into my emergency funds."
Diana said she remembered chatting to other sex workers at the brothel where she worked, wondering what the pandemic would mean for their work.
"A couple of days before we went into the first lockdown, we were all sitting down in the brothel talking about what it would look like for us. [Asking] do we start wearing masks at bookings?" she said.
"When it comes to restrictions, we are put into a high-risk category, which is very fair, but — at the same time — why aren't we prioritised for the vaccine?"
Diana said many people were not aware sex work was legal in Victoria.
"[It is legal] but we are all fighting for full decriminalisation," she said.
Escorts working for themselves are required to register their personal details with the state government and are not allowed to have clients visit them.
Instead, they are only allowed to visit their clients, leading to safety concerns.
Victorian Reason Party leader Fiona Patten said sex workers had long been "at the forefront" of public health efforts, and designating one regular client as their intimate partner was "in the spirit" of the lockdown restrictions.
But the Upper House MP said Victorian sex workers had been hit by the lockdown just as other casual workers were.
"Whether they're sex workers or baristas … there's no support for them," Ms Patten said.
Last year, at the state government's request, Ms Patten conducted a review of the state's sex work laws and look at ways of decriminalising the industry.
She submitted her report in October and the government is still considering its response.
"This is not deregulating sex work, but this is about treating sex work as work," she said.
Ms Patten said the industry needed to be treated as other businesses were and suggested that any regulation could probably sit within the Occupational Health and Safety Act, the Public Health and Wellbeing Act, and the Planning and Environment Act."
She said the state's existing arrangements were out of date and that meant many sex workers operated in a grey area, where they did not comply with all requirements of them.
Gala Vanting from the Scarlet Alliance, the Australian sex workers' union, said many in the industry who had applied for financial support during the pandemic were unsuccessful.
"Applying for government support requires disclosing our work in a way that could incriminate us, which is a disincentive to apply," Ms Vanting said.
"That is why we are working for the full decriminalisation of sex work in Victoria and have been running a mutual aid fund to support Victorian sex workers during lockdowns."
Diana said the sex industry was not seen as real work and that she wanted to change perceptions around it catering to seedy men.
"Most of the people that book me are just lonely," she said.
"The mental health of men is falling onto socially disadvantaged women who do this job.
"It turns into us holding men in our arms when they cry, giving them therapy, teaching them how to set boundaries with people."
