TON_LovebotUSER AGREEMENT
1. INTRODUCTION
1.1. This User Agreement (“Agreement”) provides for the use of the Telegram bot @TON_Lovebot (“Service”, “Bot”, “We”) by the user (“User”, “Client”, "You”).
1.2. Before using the Service, you agree that you have read and accepted all of the terms and conditions contained in this Agreement and in our Privacy Policy available on @TON_Lovebot.
1.3. By starting to use the Service or its individual functions, the User is deemed to have accepted the terms of the Agreement in full, without any reservations and exceptions.
1.4. The terms of this Agreement are applied to all users and other persons who access or use the Service. If you do not agree to accept and comply with any of the terms of this Agreement, or if the Agreement contradicts the laws of your country or the laws of your location, you shall agree not to use @TON_Lovebot. If you fail to do so, you shall be liable for all losses and damages caused to the bot or third parties as a result of your refusal.
1.5. The Service may from time to time, at its discretion, make changes and improvements to this Agreement.
1.6. By continuing to use the Service after these changes have been made, you are deemed to have signified and agreed to the changes.
1.7. The service is based on the algorithms of the Telegram application, so please also refer to the Telegram Terms of Use and Privacy Policy.
2. SERVICES PROVIDED
2.1. The Bot provides dating services: the Bot provides the opportunity to create profiles that can be seen by the other users and liked or disliked by them. The mutual liking the profiles of each other leads to the exchanging of the contacts on Telegram for the further communication (hereinafter: “Services").
3. TERMS OF USE
3.1. To be eligible to use the Service, you represent and warrant that:
3.1.1. You are an individual of full legal capacity and physical ability, and have sufficient authority to agree to this document.
3.1.2. You do not provide us with misleading, false or fraudulent information.
3.1.3. You have not previously been banned or restricted from using our Service.
3.1.4. You do not violate any of the provisions of this Agreement or applicable laws and regulations.
3.1.5. You are responsible for compliance with the relevant laws in the territory of your residence (registration) from which you are accessing @TON_Lovebot.
3.2. The Service recommends using the Bot to persons over the age of 18. The responsibility for the actions of minors, including the purchase of services by them, lies with the legal representatives of minors. All visitors under the age of 18 are required to obtain the permission of their legal representatives before using the service.
3.3. The Service reserves the right to restrict or prohibit the use of the Bot in certain jurisdictions, if required by applicable law.
3.4. You also warrant that you do not misuse the Service or attempt to disrupt or otherwise interfere with it, for example, do not use the Bot for fraudulent or misleading actions, introducing malware, hacking, spreading spam or circumventing our systems or security measures.
3.5. You can also notify @TON_Lovebot if you wish to stop accessing the Bot at any time by sending a support request.
4. REGISTRATION PROCEDURE AND USE OF THE BOT
4.1. Registration procedure.
4.1.1. Sending a request.
To start using @TON_Lovebot, you must activate the bot and provide @TON_Lovebot with the data required to create the profile of the Bot's user. The data includes: nickname, gender, age, voice message, Instagram, height, the city where you plan to get acquainted, the video provided by the user.
The user can also add a description of their interests, hobbies, and other information in the profile.
4.1.2. User verification and monitoring.
We reserve the right to restrict or block your access to @TON_Lovebot and to postpone the registration if we detect a risk of fraud or any other illegal activity.
We may also require you to provide additional information or wait some time after you have completed providing the data before allowing you to use the services. For more information, see section 6 - “Suspension, Termination the access to the Bot" of this Agreement.
By accessing the services provided by @TON_Lovebot partners through the Bot, you give your consent to the transfer of your data to the Bot's partners and understand that @TON_Lovebot has the right to restrict your access to the Service and additional services based on information received from its partners.
4.2. Using the chatbot.
4.2.1. After completing the profile creation process, you have the opportunity to view the profiles of other users. In order to get acquainted with the profiles of other users, you need to select "Лента".
4.2.2. Choose an item in the form of a "heart" if you want to get to know the user. In case of unwillingness to further acquaintance, choose an item in the form of an "upside-down finger", then the following profile will be displayed to you.
4.2.3. If you have selected an item in the form of a "heart", then the person in respect of whom you have selected this item will receive a notification of your choice. If this person also chooses this item, then you will receive a link to his Telegram profile, where you can start communicating through the Telegram messenger.
4.2.4. In the process of viewing the profiles, advertisements placed in accordance with the provisions of the legislation may be displayed.
5. PROHIBITED USE OF THE BOT
5.1. We grant you a non-exclusive, non-transferable license to use @TON_Lovebot in accordance with the terms and conditions of this Agreement.
5.2. You have the right to access and use the Service and related materials and information (collectively referred to as the "Content") exclusively in accordance with the terms of this Agreement.
5.3. Any other use of the Service or Content is strictly prohibited, and all other rights, titles to the Service or Content belong exclusively to the owner of the @TON_Lovebot, its licensors.
5.4. The use of the Service for the purpose of advertising related to illegal services, fraudulent schemes, pyramids, darknet, extortion, money laundering, terrorist financing, subjects of sanctions regimes and other categories of unacceptable risk for @TON_Lovebot is prohibited.
5.5. Impersonating another person when registering and using @TON_Lovebot is prohibited.
5.6. Expressions of a sexual nature or hints of sexual acts against persons under the age of 18 do not comply with our terms of service and are illegal in many countries. If you are detected in such actions, your account will be deleted and information about it will be transferred to the local police.
6. SUSPENSION AND TERMINATION THE ACCESS TO THE BOT
6.1. @TON_Lovebot may restrict or terminate your access to the Service if required by a valid subpoena, court order or mandatory order of a government agency,
and/or we reasonably suspect the User of prohibited use of @TON_Lovebot;
and/or the use of your profile is the subject of any legal proceedings, investigations or government proceedings;
and/or we believe there is an increased risk of non-compliance with legal or regulatory requirements regarding your use of @TON_Lovebot;
and/or our service partners cannot support your use of the Service;
and/or you take actions that, in our sole discretion, circumvent the rules and controls we have established, including, but not limited to, opening multiple profiles or abusing promotions that @TON_Lovebot may offer from time to time;
or you are violating this Agreement and other @TON_Lovebot rules.
7. RESOLUTION OF COMPLAINTS
7.1. If you have any feedback, questions or complaints, please contact customer support (@TON_Lovehelp).
7.2. If you have a complaint, please state the reason for your complaint, how you would like us to resolve the complaint, and any other information that you consider appropriate. We will investigate your complaint based on the information you have provided and any information provided by @TON_Lovebot.
7.3. Your complaint will be considered within 14 (fourteen) calendar days from the date of receipt of the complaint by the support service.
7.4. The Agent from the @TON_Lovebot support team may make the following decisions based on your complaint:
7.4.1. Resolve your complaint in accordance with your request.
7.4.2. Make a decision to reject your complaint and indicate the reasons for the rejection.
7.4.3. Resolve your complaint in an alternative way.
7.5. You agree to use the complaint procedure described in this section before filing a claim with the court. The failure to comply with this provision may be used as evidence of your unwillingness to settle the issue out of court and/or the unacceptable nature of the complaint.
8. WARRANTIES AND RESPONSIBILITIES OF PARTIES
8.1. Data transmission to the Bot is encrypted using SSH, HTTPS and SSL/TLS. No method of transmission or electronic storage is 100% secure; therefore, the Service cannot guarantee its absolute security.
8.2. By using the Bot, you agree that the Service is not responsible for any consequences arising from the use of the information provided by the Bot.
8.3. The Service will not sell, buy, provide, exchange or otherwise disclose your data, transaction details or personal information about the User to anyone other than partners and third parties specified in the Privacy Policy.
8.4. The Service is not responsible for any content that users post, send or receive using the Service. You access the content uploaded or otherwise obtained through the Service at your own risk.
8.5. You are also personally responsible for updating your contact details in order to receive any notifications or warnings that the Service may send to you. The Service is not responsible for the fact that you do not comply with any notifications or warnings that the Service may send you.
8.6. We are not responsible for any damage or disruption caused by any computer viruses, spyware, repellent programs, Trojans, worms or other malicious software products that may affect your computer or other equipment, as well as any phishing, spoofing or other attacks. We recommend that you regularly use proven and easily accessible software for virus scanning and prevention.
8.7. Although the Service takes all necessary and reasonable measures to maintain the functionality of the service, users use it at their own risk.
8.8. The Services are provided without any representations or warranties of any kind, express or implied, as required by law with respect to the software or websites, including, but not limited to, warranties or conditions of quality, performance, non-infringement, merchantability and fitness for a particular purpose.
8.9. The Service does not represent or guarantee that it or any other software associated with it will always be available, will always work uninterrupted, timely, safe, accurate, complete, error-free and lossless.
8.10. In accordance with this section, the Service is not responsible for any loss or damage resulting from or in connection with the use of the Service, even if the Service has been notified and/or aware of the possibility of such loss or damage. In particular, the Service is not responsible for:
8.10.1. Loss of any actual or expected profit, income or any indirect, special, incidental or consequential losses and missed opportunities;
8.10.2. Any indirect, special, incidental or consequential damages.
8.11. We are not responsible for delays, failures or interruptions in service that are direct or indirect result of any cause or condition beyond our reasonable control, including, but not limited to, any delay or failure caused by any natural disaster, act of civil or military authority, act of terrorism, civil unrest, war, strike or other labor dispute, fire, interruption of
telecommunications or internet services or network provider services, hardware and/or software failure, other disaster or any other event, which is beyond our reasonable control and does not affect the validity and applicability of any of the other provisions.
9. THIRD PARTY CONTENT
9.1. If during the use of the Bot, the user profiles contain (or may contain) links to sites on the Internet (third-party sites) as well as articles, photographs, illustrations, graphic images, music, sounds, videos, information, applications, programs and other Content belonging to or originating from third parties (Third party Content) resulting from the intellectual activity and protected in accordance with the law, these third parties and their Content are not verified By the service for compliance with certain requirements (reliability, completeness, integrity, etc.).
The Service is not responsible for any information posted on third-party sites that the User accesses during the use of the Bot or through third-party Content, including, but not limited to, any opinions or statements expressed on third-party sites or in their Content.
10. FINAL PROVISIONS
10.1. The meanings of the terms, conditions and representations contained in this document will depend on the definitions and interpretations in English. Any translation provided may not accurately reflect the information contained in the original.
10.2. Meta, including Instagram and Facebook, are recognized as an extremist organization and prohibited in Russia.
