Une mère aide son fils pathétique
Mohamadou Rabby Bah est âgé d’une soixantaine d’années. Il est domicilié au quartier Winindara, dans la commune de Ratoma. Il a porté plainte contre son fils, Elhadj Ibrahima Bah, pour des menaces et injures publiques. Et, le procès de ce jeune mécanicien s’est tenu hier, mercredi 03 Juillet 2019, au tribunal correctionnel de Dixinn (délocalisé à la mairie de Ratoma). Mais, la désinvolture du jeune homme qui qualifie son père de menteur et le récit pathétique du vieil homme qui dit être battu par son fils ont laissé stupéfait le tribunal, rapporte un journaliste de Guineematin.com qui a suivi ce procès.
Six mois après sa sortie de la maison centrale (où il a purgé 3 mois de prison pour avoir battu sa marâtre), Elhadj Ibrahima Bah s’est retrouvé de nouveau devant le tribunal correctionnel de Dixinn. Cette fois, il est poursuivi pour avoir menacé et insulté publiquement son père biologique. En clair, il est reproché à ce jeune mécanicien d’avoir battu et menacé de tuer son père, âgé de 60 ans.
A la barre, le prévenu a réfuté les faits articulés contre lui. Il a déclaré que son père veut simplement se débarrasser de lui. « Je n’ai rien fait à mon père. Il y a six mois, j’étais en détention à la maison centrale. On m’avait condamné à six mois de prison à cause d’une bagarre. Mais, c’est trois mois que j’ai fait là-bas. Et, depuis que je suis sorti de prison, tout le monde en famille a peur de moi. Ils me traitent tous de bandit. Mon père veut me chasser de la maison. Il m’a clairement dit de quitter sa concession… Je n’ai menacé personne, je n’ai insulté personne. Vous pouvez même demander aux gendarmes, j’étais dans les toilettes quand ils m’ont arrêté », a poliment expliqué Elhadj Ibrahima Bah.
Appelé à la barre, la partie civile a fait un récit qui a laissé stupéfait le tribunal et qui a figé l’auditoire. « Mon fils me bat tout le temps. Quand je fuis, il me poursuit comme son enfant. Et, quand il me rattrape, il me bat encore et encore », a entamé le vieil homme, la gorge nouée.
« Il a d’abord commencé par battre la coépouse de sa mère (sa marâtre). Et, c’est pour ça qu’il avait été condamné à six mois de prison… A sa sortie de prison, il me battait aussi. Il me menace chaque fois de mort… Suite au décès de sa mère, je suis allé au village, au Foutah, pour la présentation des condoléances. A mon retour, j’ai trouvé qu’il a chassé tous les occupants de ma concession où se trouvaient ma famille et des locataires. Il a dit qu’il va les tuer. Ces gens ont fui. Il menace souvent de me tuer. Et, il me bat chaque jour que Dieu fait. Il est plus fort que moi. Quand je fuis, il me poursuit et me bat encore. Je sollicite votre aide. Je ne peux plus rester avec lui dans ma concession. Sinon, il va me tuer un jour », a confié Mohamadou Rabby Bah, qui a aussitôt fondu en larme.
Le vieil homme sera inconsolable pendant quelques minutes. Ce qui conduira la juge, Aïssata Kalissa, à lui dire d’aller s’assoir. « Ne pleurez pas ! C’est bon, ne pleurez pas monsieur ! », dira de son côté le ministère public, visiblement très touché par les larmes du vieil homme.
Revenu très énervé à la barre, Elhadj Ibrahima Bah va traiter son père de menteur. « Ce n’est pas vrai ce qu’il vient dire. Mon père veut seulement me faire perdre l’argent que j’ai dépensé pour construire une chambre chez nous. C’est faux, tout ce qu’il a raconté ici… », a-t-il déclaré.
Surprise générale dans la salle d’audience. « Eh, eh, eh… », entendait-on de l’auditoire, surpris du ton condescendant et irrespectueux du jeune garçon qui parlait ainsi de son géniteur.
« Comment pouvez-vous traiter votre père de la sorte ? Vous pensez qu’on est chez vous à Wanindara ou que vous êtes au-dessus de la loi ? », s’est alors énervé le ministère public.
« Non ! Mais, il veut que je perde mon argent… », a répondu Elhadj Ibrahima Bah avec un ton de défiance.
« Est-ce que vous pouvez hériter votre père de son vivant ? La concession lui appartient. Donc, il peut vous mettre dehors et même vendre la concession, s’il le désire », articule de nouveau le ministère public.
« OK ! Il n’a qu’à le faire alors… », rétorque le prévenu qui prend soin de tourner la tête, de fixer le regard et d’indexer son père qui était assis juste derrière lui.
« Vous nous montrez déjà votre comportement à l’égard de votre père », dit ensuite le procureur, arborant un regard foudroyant.
Dans ses réquisitions, Boubacar 1 Bah, le procureur audiencier, a demandé au tribunal de retenir Elhadj Ibrahima Bah dans les liens de la prévention. Et, « pour la répression, vous le condamnerez à 2 ans de prison ferme. Ça lui servira de leçon », a-t-il requis.
Dans sa décision, le tribunal a suivi les réquisitions du ministère public. Il a déclaré Elhadj Ibrahima Bah coupable des faits de menaces et d’injures publiques.
« Le tribunal, statuant publiquement, contradictoirement, en matière correctionnel et en premier ressort (…) condamne Elhadj Ibrahima Bah à 2 ans de prison ferme », a annoncé la juge Aïssata Kalissa.
