(Voluntary Software Testing Agreement)

1. General Provisions

1.1. These Terms of Use (hereinafter – the “Terms”) govern participation in voluntary testing of the Hypov Hedge Fund AI Trading System (hereinafter – the “Software”).

1.2. The Software is provided strictly for testing purposes and operates in an experimental mode. It is not a licensed financial service, brokerage product, or investment offering.

1.3. By accessing or using the Software, the participant (hereinafter – the “Volunteer”) confirms that they have read, understood, and accepted these Terms.

2. Nature of Participation

2.1. The Volunteer participates solely on a voluntary and non-commercial basis.

2.2. The Software is installed and operated on the Volunteer’s own account and trading environment. The Volunteer bears full responsibility for granting and managing such access.

2.3. The use of the Software is considered beta testing and is intended exclusively for research, evaluation, and improvement of the product.

3. Compensation and Rights to Results

3.1. The Volunteer has the right to retain any financial results (profits or losses) generated during testing.

3.2. At their sole discretion, the Volunteer may voluntarily transfer part or all of the income obtained through the Software’s operation to the account of the project owner (hereinafter – the “Provider”). Such transfers are not mandatory and cannot be considered as service fees, payments, or investment contributions.

3.3. No fixed remuneration, guarantees, or obligations are provided by the Provider.

4. Taxes and Legal Obligations

4.1. The Volunteer is solely responsible for any and all tax obligations arising from the use of the Software and any income generated during testing.

4.2. The Provider does not act as a tax agent and does not provide financial, investment, or tax advice.

5. Risks and Liability

5.1. The Volunteer acknowledges and accepts that trading involves risks, including partial or complete financial loss.

5.2. The Volunteer assumes all risks associated with using the Software, including but not limited to:

technical errors or failures;
financial market volatility;
incorrect configuration or use;
security breaches resulting from third-party actions.
5.3. The Provider, the project founder, team members, partners, and any affiliated persons bear no responsibility for:
financial losses or missed profits,
malfunctions or interruptions in the Software’s operation,
any direct, indirect, incidental, or consequential damages.

6. Disclaimer

6.1. The Software is provided “as is”, without warranties of any kind, whether express or implied, including but not limited to warranties of performance, fitness for purpose, or error-free operation.

6.2. The Provider does not guarantee any specific financial results, accuracy of forecasts, or continuous availability of the Software.

6.3. Participation in testing is not an investment agreement, partnership, or fiduciary relationship.

7. Termination

7.1. The Provider reserves the right to modify, suspend, or terminate access to the Software at any time without prior notice.

7.2. The Volunteer may cease participation at any time by discontinuing use of the Software.

8. Governing Law

8.1. These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which the Provider operates, unless otherwise specified.

9. Final Provisions

9.1. By using the Software, the Volunteer confirms that they:

understand the experimental and non-commercial nature of participation,
voluntarily assume all related risks,
release the Provider and affiliates from any liability for results of use.

Neither the founder, nor the team, nor any affiliates provide investment services or accept responsibility for the final outcome.
