Terms of Use

Welcome to Party Roast (the "Application"), a free iOS mobile application with optional in-app purchases, developed and provided by avfapps@gmail.com (the "Service Provider").

By downloading, accessing, or using the Application, you agree to comply with these Terms of Use (the "Terms"). If you do not agree with these Terms, please refrain from using the Application.

1. ACCEPTANCE OF TERMS

By using the Application, you acknowledge that you have read, understood, and accepted these Terms, along with any future modifications. The Service Provider reserves the right to update these Terms at any time. Continued use of the Application after changes are posted constitutes acceptance of the revised Terms.

2. DESCRIPTION OF SERVICE

Party Roast provides entertainment features, including AI-generated photo roasts, chat roasts, and roast battles. AI-generated content is provided for entertainment purposes only and should not be treated as factual, professional, medical, legal, or personal advice.

3. INTELLECTUAL PROPERTY RIGHTS

The Application, including its source code, design, logos, text, graphics, and other content (except user-provided content), is the exclusive property of the Service Provider and is protected by copyright, trademark, and other intellectual property laws.

You are not permitted to:

- Copy, modify, or create derivative versions of the Application

- Reverse-engineer, decompile, or attempt to extract the source code

- Use the Application for any unauthorized commercial purposes

- Remove or alter proprietary notices

Any violation may result in legal action.

4. USER CONTENT

You may provide photos, screenshots, names, and other content through the Application ("User Content"). You represent that you have the right to submit such content and that it does not violate any law or third-party rights.

You grant the Service Provider a limited license to process User Content solely to provide the requested features (including transmission to third-party AI services as described in the Privacy Policy).

You retain ownership of your User Content. The Service Provider does not claim ownership of photos or screenshots you upload.

5. AI FEATURES AND CONSENT

Certain features require sending photos or screenshots to third-party AI services (Google Firebase / Google Gemini). Before the first use, the Application requests your explicit in-app consent through the Enable AI Features screen.

If you do not enable AI Features, those features will not function. You may revoke consent at any time in Settings.

6. SERVICE MODIFICATIONS AND CHARGES

The Service Provider reserves the right to:

- Modify, suspend, or discontinue the Application or any feature at any time

- Introduce or change fees for certain features, including subscriptions, with notice where required by applicable law or platform rules

The Application may offer optional Party Roast Pro subscriptions through the Apple App Store. Pricing, billing, renewal, and cancellation are governed by Apple's terms and your Apple ID account settings.

7. USER RESPONSIBILITIES

You agree to:

- Use the Application only for lawful purposes and in accordance with these Terms

- Not use the Application to harass, abuse, defame, or harm others

- Not upload content that is illegal, offensive, or infringes third-party rights

- Maintain the security of your device

- Avoid jailbreaking or rooting your device, as it may compromise security and app functionality

- Be responsible for any data charges from your mobile provider when using the Application outside Wi-Fi

8. DATA PRIVACY AND THIRD-PARTY SERVICES

The Application collects and processes information as outlined in the Privacy Policy. By using the Application, you consent to such processing in compliance with applicable laws.

The Application relies on third-party services, each with its own terms and privacy policies, including:

- Firebase (Google)

- Google Gemini / Firebase AI Logic

- Apple App Store / StoreKit

The Service Provider is not responsible for the policies, availability, or actions of these third parties.

9. DISCLAIMERS

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The Service Provider does not guarantee uninterrupted, secure, or error-free operation. AI-generated outputs may be inaccurate, incomplete, or inappropriate. You use AI-generated content at your own discretion and risk.

10. LIMITATIONS OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APPLICATION.

The Service Provider is not responsible for:

- Device malfunctions (for example, battery drain or software issues)

- Damages resulting from misuse, unauthorized modifications, or reliance on AI-generated content

- Actions or failures of third-party services

- Any losses incurred due to reliance on the Application's functionality

Some jurisdictions do not allow certain limitations of liability; in such cases, liability is limited to the fullest extent permitted by law.

11. IN-APP PURCHASES

All purchases and subscriptions are processed by Apple. The Service Provider does not store your full payment card details. Refunds and billing disputes are handled according to Apple's policies.

12. UPDATES AND TERMINATION

The Service Provider may release updates to the Application. You agree to install updates when required for continued use or security.

The Service Provider may suspend or terminate your access to the Application at any time, with or without notice, if you violate these Terms or if the service is discontinued. Upon termination, you must cease use and may delete the Application.

13. CHANGES TO THESE TERMS

The Service Provider may update these Terms periodically. Updated Terms will be posted at the location where these Terms are made available. You are advised to review these Terms from time to time. Continued use constitutes acceptance.

14. GOVERNING LAW

These Terms are governed by applicable law, without regard to conflict-of-law principles, except where mandatory local consumer protection laws apply.
