These Terms of Use ("Terms") govern your access to and use of the Search lost multitool mobile application ("the App," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Acceptance of Terms

By accessing or using Search lost multitool, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and the App. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use. This license does not grant you any ownership rights in the App or its content. All rights not expressly granted to you are reserved by us.

Description of Service

Search lost multitool provides tools to help you locate and interact with Bluetooth Low Energy (BLE) devices in your vicinity. The App allows you to scan for nearby BLE devices, view device information such as names, signal strength, and approximate distance, maintain a history of discovered devices, and save favorite devices for quick access. The App also includes a decibel (dB) meter feature that measures ambient sound levels using your device's microphone. The dB measurements are provided for informational purposes only and should not be relied upon for professional, medical, or safety-critical applications.

Subscriptions and Payments

Search lost multitool offers optional premium features available through paid subscriptions. Subscriptions are processed and managed through Apple App Store and Adapty. By purchasing a subscription, you agree to pay the applicable fees as presented to you at the time of purchase. Subscription fees are charged on a recurring basis (monthly, yearly, or as otherwise specified) and will automatically renew unless you cancel before the renewal date. You can manage or cancel your subscription at any time through your App Store account settings. Cancellations take effect at the end of the current billing period, and you will retain access to premium features until that time. We reserve the right to modify subscription pricing with reasonable notice. Price changes will not affect active subscriptions until renewal. Refunds are handled according to the refund policies of the Apple App Store. We do not directly process refunds.

User Responsibilities

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App in any way that violates any applicable local, state, national, or international law or regulation. You will not attempt to interfere with, compromise, or disrupt the App's functionality, security, or availability. You will not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App. You will not use the App to harass, abuse, or harm another person or to violate anyone's privacy or property rights. You will not use the App for any commercial purpose without our prior written consent.

Bluetooth and Microphone Access

The App requires access to your device's Bluetooth functionality to scan for BLE devices and access to your device's microphone to measure sound levels. You must grant these permissions for the App to function properly. You are responsible for ensuring that your use of these features complies with applicable laws and respects the privacy and rights of others. The App does not transmit audio recordings or personal data collected through these features to our servers or third parties.

Accuracy of Information

While we strive to provide accurate and reliable information, the App's measurements and data (including BLE device information, distance estimates, and dB levels) are provided for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any information provided by the App. You acknowledge that BLE signal strength and distance calculations are estimates and may be affected by environmental factors. Sound level measurements are approximate and should not be used for professional acoustic measurements, hearing protection decisions, or any safety-critical purposes.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Intellectual Property

All content, features, and functionality of the App, including but not limited to software, text, graphics, logos, icons, images, audio, and the design, selection, and arrangement thereof, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written permission.

Third-Party Services

The App may integrate or interact with third-party services, including Adapty for subscription management and app store platforms for payments. Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the actions, content, or policies of any third-party services. You acknowledge and agree that we are not liable for any damages or losses arising from your use of third-party services.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of these Terms and may notify you through the App or other means. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the App.

Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your license to use the App will immediately cease, and you must delete the App from your device. Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property provisions) will continue to apply after termination.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the applicable arbitration rules, or in the courts of competent jurisdiction if arbitration is not available or enforceable. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the extent necessary to make it valid and enforceable while preserving its intent.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.
