These Terms of Use (“Terms”) govern your access to and use of the Decibel Check mobile application (the “App”). Please read them carefully.


By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility


You may use the App only if:


  • You are at least the age of majority in your jurisdiction or have the consent of a parent or legal guardian; and
  • You have the legal capacity to enter into a binding contract; and
  • You comply with these Terms and all applicable laws and regulations.


If you are under the age of 18 (or the age of majority in your jurisdiction), you must have your parent or legal guardian’s permission to use the App.



2. License to Use the App


Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:


  • Download and install a copy of the App on a mobile device that you own or control; and
  • Use the App solely for your personal, non-commercial use.


You may not:


  • Copy, modify, or create derivative works based on the App;
  • Distribute, transfer, sublicense, lease, lend, or rent the App to any third party;
  • Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law;
  • Circumvent, remove, or interfere with any security or usage restrictions in the App.


All rights not expressly granted to you under these Terms are reserved by us and our licensors.



3. App Features – Sound / Decibel Measurement


The App is designed to measure and display approximate sound levels (decibels) using your device’s microphone.


You acknowledge and agree that:


  • The measurements provided by the App are for informational and indicative purposes only.
  • Results may not be accurate or suitable for professional or safety-critical use.
  • The App is not a certified measuring instrument and should not be used where precise, legally required, or professional-grade measurements are needed (e.g., regulatory compliance or industrial safety).


You are solely responsible for how you use any information obtained through the App.



4. Subscriptions, Purchases, and Billing


Certain features of the App may be available only through a paid subscription or in-app purchase (“Subscription”).



4.1 Purchases via Apple App Store


  • Subscriptions and in-app purchases are processed by Apple Inc. via the Apple App Store, not by us directly.
  • By making a purchase, you also agree to be bound by Apple’s terms and conditions and payment policies.


We do not have access to your full payment details. We may receive limited information from Apple (such as transaction ID and subscription status) so that we can provide the purchased content or features.



4.2 Subscription Period and Renewal


  • Subscriptions are typically offered on a weekly, monthly, yearly, or other period basis, as displayed in the App or on the App Store.
  • At the end of each subscription period, your Subscription may automatically renew for the same period and price (or as otherwise indicated), unless you cancel it at least 24 hours before the end of the current period.


When a user requests a refund for an in-app purchase, we may provide Apple with information about the consumption of the purchased content. This data may include details such as the time since installation, total app usage duration, an anonymous account identifier, whether the in-app purchase was entirely used, whether it included a trial period, the total expenditure, and the refunded amount.


4.3 Managing and Cancelling Subscriptions


  • You can manage or cancel your Subscription at any time by using your Apple ID account settings on your device.
  • Deleting the App does not cancel your Subscription. To avoid renewal, you must cancel your Subscription in your Apple account settings.



4.4 Free Trials

We may offer free trials for certain Subscriptions:


  • If you sign up for a free trial, you can use the premium features for the period of the trial, subject to these Terms.
  • At the end of the free trial, your Subscription may automatically convert to a paid Subscription and your Apple account will be charged, unless you cancel before the trial ends.



4.5 Prices and Changes


  • Subscription prices and available plans are shown in the App Store and may vary by region and currency.
  • We may change Subscription terms, including price, from time to time as permitted by Apple’s policies.
  • If a price change applies to your existing Subscription, we or Apple will notify you in advance, and you will have the opportunity to cancel before the change takes effect.



4.6 Refunds


  • All billing and refund processes are handled by Apple according to their policies.
  • As a general rule, we do not provide direct refunds. Any refund requests should be directed to Apple.



5. User Conduct


You agree not to:


  • Use the App in any way that violates applicable laws or regulations;
  • Use the App in hazardous situations where accurate, certified sound measurement is required;
  • Use the App to harass, stalk, defame, or otherwise harm others;
  • Interfere with or disrupt the App’s operation, servers, or networks;
  • Attempt to gain unauthorized access to the App or related systems;
  • Introduce viruses, malware, or other harmful code into the App or its ecosystem.


We may terminate or suspend your access to the App if we reasonably believe you have violated these Terms.



6. Intellectual Property


The App and all related content (including software, design, text, graphics, logos, and trademarks) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.


You do not acquire any ownership rights in the App or our content by using the App. Any use of our trademarks, logos, or brand elements requires our prior written consent.




The App may include links to third-party websites, content, or services that are not owned or controlled by us.


We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your use of such services is at your own risk and subject to the terms and policies of those third parties.



8. Disclaimers


The App is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind.


To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:


  • Warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • Warranties that the App will be uninterrupted, error-free, secure, or free of harmful components;
  • Warranties regarding the accuracy, reliability, or completeness of any information or measurements provided by the App.


Any use of the App and reliance on its outputs (including sound level readings) is at your sole risk.


Some jurisdictions do not allow the exclusion of certain warranties, so the above exclusions may not apply to you in full.



9. Limitation of Liability


To the maximum extent permitted by law:


  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the App;
  • Any inaccuracies in sound or decibel measurements;
  • Any unauthorized access to or use of our services;
  • Any other matters relating to the App.
  • Our total aggregate liability for any claim arising out of or relating to these Terms or the App shall not exceed, in the aggregate, the amount you have actually paid for use of the App during the twelve (12) months immediately preceding the event giving rise to the claim, or the minimum amount required by law if greater.


Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of these limitations may not apply to you.



10. Indemnification


You agree, to the extent permitted by law, to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way related to:


  • Your use of the App;
  • Your violation of these Terms; or
  • Your violation of any rights of another person or entity.



11. Termination


We may suspend or terminate your access to the App, in whole or in part, at any time and for any reason, including if we reasonably believe that you have violated these Terms or applicable law.


Upon termination:


  • Your right to use the App will immediately cease;
  • Provisions of these Terms which by their nature should survive (such as ownership, warranty disclaimers, limitation of liability, and dispute resolution) shall continue to apply.


You may terminate these Terms at any time by uninstalling the App and ceasing its use. Note that uninstalling the App does not cancel your Subscription; you must manage cancellations through your Apple ID settings.



12. Changes to the App and Terms


We may modify or discontinue the App (or any part of it) at any time, with or without notice, and without liability to you.


We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by updating the “Last updated” date at the top of these Terms or providing in-app notice).


By continuing to use the App after changes to these Terms, you agree to be bound by the updated Terms.



13. Governing Law and Dispute Resolution


The laws of [insert country/region – e.g., “Sweden” or “your country of residence”] will govern these Terms and any disputes arising out of or in connection with them, without regard to its conflict of law principles.


Any disputes shall be subject to the exclusive jurisdiction of the courts located in [insert city/country], unless mandatory law gives you the right to bring claims in your local courts.


Consumers in the EU/EEA or UK may have additional mandatory rights under local consumer protection laws, which are not affected by these Terms.

15. No Waiver


Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

These Terms constitute the entire agreement between you and us regarding your use of the App and supersede all prior or contemporaneous understandings.
