1. Acceptance of Terms

Welcome to Fixnet ("we," "us," or "our"). By accessing the Fixnet Telegram Bot, downloading our Client Software ("Software" or "Application"), or using our digital credentials (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). All references to "you" and "your" in this Terms mean the person accepting this Terms as an individual or the legal entity for which the representative is acting.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE.

2. Description of Service

Fixnet provides a technological solution (Service) designed to stabilize internet connections, reduce packet loss, and optimize data routing, that establishes the secure connection. The Service operates by routing your encrypted traffic through optimized nodes.

To utilize the Service, the Company provides you with a unique string or configuration link, herein referred to as the "Access Key". This Access Key is generated and delivered to you exclusively through the Fixnet Telegram Bot following your registration or purchase of a subscription. The Access Key serves as the technical credential required to authenticate your session within the Software.

3. Account & Registration

Registration: Your account is created automatically via the Telegram Bot platform. You agree that the information automatically provided (e.g., Telegram User ID) is accurate and belongs to you.
Security: You are responsible for maintaining the security of your Telegram account and the devices where the Software is installed. You agree not to disclose your Access Key to any third party.
No Sharing: Your right to use the Service is personal. You may not share your account or Access Key with others unless expressly approved by Fixnet in writing. You acknowledge that you remain fully liable for all acts and omissions of any third party that you allow to access the Service using your Access Key.

4. Subscriptions, Payments, and Taxes

4.1. Pricing and Plans

All subscription fees, durations, and specific plan details are displayed dynamically within the Fixnet Telegram Bot interface. You agree that the pricing displayed in the Bot at the time of your purchase governs the transaction. We reserve the right to change prices for future subscriptions, which will be updated in the Bot.

4.2. Payment Terms & Auto-Renewal

Pre-payment: Services are provided on a pre-paid basis. You authorize us to collect the applicable fee for the selected subscription period.
Automatic Renewal: Certain subscription plans may be set to automatically renew at the end of the billing cycle. If a plan involves automatic renewal, this will be explicitly communicated to you within the Telegram Bot interface before purchase. By selecting such a plan, you authorize us to automatically charge the applicable fee using your saved payment method until you cancel the subscription via the Bot.

4.3. Refund Policy

Generally, payments are non-refundable due to the digital nature of the Access Keys. However, we provide Limited Refunds under certain technical conditions:

Eligibility: A refund may be granted solely if the Service remains technically unusable for you due to a fault on our side (e.g., prolonged server downtime or key generation failure) that cannot be resolved by our Support team.
Calculation: The refund amount is determined based on the duration of the Service unavailability (pro-rata basis).
Process: To request a refund, you must contact us via the contact details provided in these Terms. We reserve the right to deny a refund if the issue is caused by your local hardware, ISP restrictions, or failure to follow setup instructions.

4.4. Taxes and Fees

Unless otherwise expressly stated, our prices are exclusive of any taxes. You are solely responsible for calculating and paying any applicable taxes (including Value Added Tax (VAT), sales tax, use tax, or similar fees) required by the laws of your jurisdiction. Fixnet is not responsible for your tax liabilities.

5. Free Trial

The Company may, at its sole discretion, offer a free trial for a limited period ("Free Trial").

Availability & Terms: The specific details of the Free Trial (including availability, duration, and included features) are not guaranteed and will be presented to you within the Telegram Bot interface at the time of registration. If no Free Trial option is displayed, no such offer is currently available.
Limitation: If offered, the Free Trial is limited to one per User, Device, and IP Address.
Revocation: We reserve the right to determine your eligibility for a Free Trial and to withdraw or modify the Free Trial offer at any time without prior notice and with no liability, to the extent permitted by applicable law. We may immediately revoke access if we determine that you are abusing the Free Trial (e.g., by creating multiple accounts).
Expiration: At the end of the Free Trial period, your access to the Service will be automatically suspended unless you purchase a subscription.

6. Software License & Usage Limits

6.1. Limited License & Device Limit

Subject to your compliance with these Terms, Fixnet grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Fixnet Client Software on supported operating systems solely for your internal personal use.

Device Limit:

Each single Subscription (associated with one Access Key) grants you the right to use the Service on a maximum of five (5) devices simultaneously.

Attempting to connect more than 5 devices at the same time using the same Access Key is a violation of these Terms and may result in:

Connection failures on additional devices.
Temporary suspension of the Access Key.
Termination of the account for abuse.

6.2. Restrictions (Reverse Engineering)

You agree NOT to, and you will not permit others to:

Decompile, reverse engineer, disassemble, or attempt to derive the source code, underlying algorithms, or protocols of the Software.
Modify, adapt, or create derivative works of the Software or Service.
Remove any proprietary notices, labels, or marks on the Software.
Use the Software to build a competitive product or service.

6.3. Traffic Restrictions & Fair Usage Policy

To ensure connection stability for all users, specific traffic types and excessive bandwidth consumption patterns are prohibited:

No Torrent/P2P: The Service must not be used for BitTorrent, Peer-to-Peer (P2P) file sharing, or similar unauthorized bulk distribution protocols. We reserve the right to technically block or throttle P2P traffic.
No Excessive Load (Fair Use): You agree not to use the Service in a manner that places a disproportionate or unreasonable burden on our infrastructure. This includes, but is not limited to:
Cryptocurrency mining operations routing traffic through our nodes;
Unattended automated bulk downloads/uploads;
Running servers or daemons requiring high-bandwidth upstream connectivity.
Ordinary Use Only: The Service is intended for standard, personal internet activity (browsing, streaming, gaming). Commercial-grade usage or utilizing the Service as a dedicated leased line is prohibited.

Violation of this policy may result in speed throttling or connection termination without refund.

6.4. Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Service ("Feedback"), you acknowledge that Fixnet owns all rights to such Feedback and may use it for any purpose (including commercialization) without any compensation or attribution to you.

7. Prohibited Uses (Acceptable Use Policy)

You agree not to use the Service or Software to:

a) Violate Laws: Breach any applicable local, state, national, or international law or regulation.

b) Malicious Activity: Engage in hacking, port scanning, spreading malware/viruses, or botnet activities.

c) Abuse: Conduct DDoS attacks, spamming (sending unsolicited bulk emails), or phishing.

d) Harmful Content: Distribute Child Sexual Abuse Material (CSAM), content that promotes terrorism, or hate speech.

e) Intellectual Property: Infringe upon the copyrights, trademarks, or proprietary rights of others (e.g., illegal downloading/torrenting).

Consequences: Violation of this section allows us to terminate your account immediately without refund and, if necessary, block your specific Device ID from accessing our servers.

8. Compliance with Local Laws

Fixnet is a generic connection tool. We do not encourage the violation of local regulations.

You are solely responsible for familiarizing yourself with and abiding by the laws of your specific jurisdiction regarding the use of connection software.

9. Disclaimer of Warranties

THE SERVICE AND SOFTWARE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE FULLEST EXTENT PERMITTED BY LAW, FIXNET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT:

THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
THE SOFTWARE WILL BE COMPATIBLE WITH YOUR SPECIFIC DEVICE, HARDWARE, OR OPERATING SYSTEM VERSION.
THE SERVICE WILL STABILIZE CONNECTION TO EVERY RESOURCE.
THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXNET AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

CAP ON LIABILITY: IN NO EVENT SHALL FIXNET'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO FIXNET IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

YOU AND FIXNET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fixnet, its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your access to or use of the Service or Software.
Your violation of these Terms or applicable law.
Your infringement of any third-party right, including without limitation any intellectual property right or privacy right.

12. Termination

We reserve the right to suspend your access or revoke your software license at our sole discretion without notice if we believe you have violated these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via the Telegram Bot or within the Software. Your continued use of the Service following the posting of explicit changes constitutes your acceptance of the new Terms.
