Terms of Service — Tihost



1. General Provisions

1.1. These Terms of Service ("Agreement") govern the relationship between the Tihost Service Administration ("Operator", "we") and any individual or legal entity ("User") using the virtual server (VPS/VDS) rental services.

1.2. Tihost provides virtual server rental services based on server infrastructure located in Germany and Finland.

1.3. By making a payment or commencing use of the service, the User confirms that they have read this Agreement in full and unconditionally accept its terms. If the User does not agree to the terms of this Agreement, they must refrain from using the service.

1.4. All interactions with Users are conducted via Telegram bots @tihost_bot and @tihost_support.


2. Service Provision

2.1. The Operator grants the User access to a virtual server (VPS/VDS) for the paid period.

2.2. Server deployment is carried out automatically within 2 minutes of payment confirmation.

2.3. The Operator does not guarantee 100% service availability but undertakes to compensate the User for downtime caused by the Operator's fault, in accordance with Section 5 of this Agreement.

2.4. Planned maintenance is announced in advance via @tihost_channel. Notification of emergency maintenance cannot be guaranteed due to its unforeseen nature.


3. Rights and Obligations

3.1. The Operator undertakes to:

  • ensure the operability of host machines and server infrastructure;
  • maintain network stability and connectivity;
  • ensure availability of the control panel;
  • respond promptly to User requests submitted to the support service.

3.2. The Operator is not liable for:

  • software installed by the User on the rented server;
  • the User's actions on the server and their consequences for third parties;
  • loss of User data not caused by the Operator's fault;
  • disruptions in third-party services on which the User depends.

3.3. The User undertakes to:

  • comply with the terms of this Agreement;
  • refrain from using the server for purposes specified in Section 4;
  • respond promptly to Operator notifications regarding violations;
  • independently perform backups of their own data.

4. Prohibited Use

4.1. The use of Tihost servers for the following purposes is strictly prohibited:

  • any activity that violates the legislation of the Russian Federation or the jurisdiction where the server infrastructure is located;
  • cryptocurrency mining in any form;
  • scanning or probing third-party networks and IP addresses;
  • organising, conducting, or participating in DDoS attacks;
  • sending spam or unauthorised mass messages;
  • hosting phishing pages or malicious software;
  • any other activity that causes harm to third parties, the Operator's infrastructure, or the Operator's reputation.

4.2. Upon receipt of justified abuse complaints regarding the User's activities, the User must remedy the violations within the timeframe specified in the Operator's notification.


5. Suspension and Termination

5.1. The Operator reserves the right to suspend services or block the User's server in the following cases:

  • the User violates the terms of this Agreement;
  • justified complaints are received from third parties or competent authorities regarding the User's activities;
  • the User ignores Operator notifications regarding identified violations;
  • the User's actions cause harm to the Operator's infrastructure, third parties, or Tihost's reputation.

5.2. In cases of serious or repeated violations, the Operator reserves the right to delete the server and all data on it without prior notice. No refund will be issued in such cases.

5.3. The Operator shall not be liable for any losses incurred by the User as a result of a lawful suspension or termination.


6. Financial Terms

6.1. All services are provided on a full prepayment basis. Service delivery commences upon receipt of payment in full.

6.2. Payment is accepted in cryptocurrency via supported payment services.

6.3. Refunds are available subject to the following conditions:

  • the server is non-functional due to the Operator's fault, or was not provisioned within the timeframe set out in clause 2.2 of this Agreement;
  • the User has submitted a refund request via @tihost_support within 48 hours of the grounds for the refund arising.

Refunds cover unused full rental days only. Refunds are issued to the payment details from which the original payment was made. Requests are reviewed and funds are returned within 72 hours of the support request being submitted.

6.4. Refunds are not issued in the following cases:

  • the User has violated the terms of this Agreement;
  • the reason for the request is dissatisfaction with the service in the absence of fault on the part of the Operator (change of mind, dislike of the plan, etc.);
  • the User's actions have caused direct or indirect losses to the Operator (IP blacklisting, provider-side blocks, penalties, or other costs) — costs incurred by the Operator will be deducted from the refund amount;
  • the User has initiated a chargeback without prior contact with the support service.

7. Limitation of Liability

7.1. The Operator's total liability to the User under any circumstances is limited to the amount paid by the User for the current billing period.

7.2. Under no circumstances shall the Operator be liable for lost profits, data loss, reputational damage, or any other indirect losses of the User.


8. Personal Data

8.1. The processing of Users' personal data is carried out in accordance with the Tihost Privacy Policy, which forms an integral part of this Agreement.

8.2. By accepting the terms of this Agreement, the User simultaneously consents to the processing of their personal data in accordance with the Privacy Policy.


9. Final Provisions

9.1. This Agreement enters into force upon its acceptance by the User and remains in effect until the User ceases to use the service.

9.2. The Operator reserves the right to amend this Agreement at any time without prior notice to Users. The current version is available at the permanent link in the Telegram channel @tihost_channel. Continued use of the service constitutes the User's acceptance of the current version of the Agreement.
