Tara Hudson ‘horrified’ by Ministry of Justice’s ‘transphobic’ response to her damages claim over 2015 spell in HMP Bristol
One of Britain’s most prominent transgender activists is embroiled in an extraordinary legal battle with the Ministry of Justice, in a landmark discrimination case.
Tara Hudson, a trans woman, was sent to a male prison in 2015, prompting a national outcry with more than 150,000 people signing a petition calling for her to be moved to a women’s jail. Hudson is suing the MoJ for damages, alleging that her status as a woman was ignored when she was imprisoned, that she suffered sexual assault during her incarceration and that she was placed in an atmosphere that was “intimidating, hostile, degrading, humiliating and offensive”.
Her lawyers are also seeking a declaration from the court that Hudson was discriminated against, potentially the first time the MoJ has been found guilty of mistreating a prisoner on the basis of gender reassignment. The case will be heard at the Mayor’s and City of London court in April, but Hudson’s lawyers have expressed outrage at the “transphobic and insulting” language used by the government in its response to the allegations.
In court papers seen by the Observer , the MoJ and government lawyers argue that they do not consider Hudson to be a woman despite the make-up artist reassigning her gender and living as a woman for her adult life. They state Hudson “is as a matter of biological fact a man” and add that the term “transwoman” has no legal significance. They say they have adopted female pronouns when referring to Hudson only “out of respect for her wishes”. In response, Hudson’s legal team accuse government lawyers of adopting “transphobic, unnecessarily abrasive, aggressive and insulting” language towards Hudson, who has breasts and has used hormones for years but does not have a gender recognition certificate.
Hudson spent six weeks in jail in 2015, after she admitted head-butting a barman. She spent seven days in HMP Bristol before being moved to a women’s facility, Eastwood Park, after a storm of national protest. Speaking from Belgium, where she lives with her boyfriend, Hudson said: “I was horrified when I read the defence from the MoJ. It states that I’m a male, which is a complete insult, humiliating and wrong because I’ve been living as a female all my adult life. I’m not a drag act. When I was put in jail I’d been the subject of transphobia and it feels like I’m the subject of transphobia again from the MoJ, which is horrible because it’s my government.”
Her lawyer, Jane Ryan of Bhatt Murphy, says the government is denying her gender identity and that its argument runs counter to the ministry’s published policies on trans prisoners and the 2016 women and equalities committee transgender inquiry , the first ever parliamentary report on such issues. Her case was also instrumental in prompting a national review to examine the treatment of trans prisoners. It concluded it may be appropriate for some trans prisoners to be placed in a prison of their acquired gender, even if they do not have a gender recognition certificate. “According to the review, the MoJ is committed to promoting transgender equality. Yet its decision to defend these proceedings, and the manner in which it is conducting its defence, directly undermines that commitment, compounding the discrimination suffered by my client,” said Ryan.
Last year Theresa May announced she would reform the gender recognition act, allowing people to self-identify and removing the need for medical diagnosis of gender dysphoria before someone can officially change gender.
Government lawyers insist that Hudson is legally a man and that placing her in a male prison did not signify “scant regard for her wellbeing”, deny breaching her human rights and state that all efforts were made to prevent her suffering any abuse or assault from other inmates. Hudson’s allegations include a description of her arrival at HMP Bristol in October 2015, where she says she was met “by a cacophony of noise and verbal abuse” with prisoners shouting: “What is it? Kill it.” During a body search, it is alleged that a male officer “gasped and mumbled ‘fucking hell’”. Hudson also alleges that an inmate groped her breasts and genitals, leaving her “threatened, distressed and humiliated”. Other claims involve Hudson being held in a segregation unit and not initially being offered a transfer to a woman’s prison, again contradicted by the government who claim “she preferred not to be transferred to a female prison”.
Hudson is calling for an apology. “They should accept they mistreated me and move forward rather than aggressively fight me. It’s shameful when really they should be trying to make sure a trans person is not mistreated.”

Curvy model Tara Lynn is proudly showing off her 'mombod' in a naked selfie while reflecting on the workouts she did to get strong and build muscle in the five weeks leading up to her Sports Illustrated Swimsuit debut.
The 37-year-old, who made history as the oldest rookie to ever pose for the iconic magazine, took to Instagram on Wednesday to share the unretouched throwback photo that she had snapped at 5 a.m. on the first day of her 2019 Sports Illustrated Swimsuit shoot, which took place on Kangaroo Island in South Australia last November.
'Friends this is my #unretouched* #mombod at 36 years and I’ve never felt as strong and gorgeous and proud of my journey and fitness and discipline as I did on this morning,' the mother of two captioned the image.
Strike a pose: Tara Lynn, 37, proudly shared a throwback naked selfie that she snapped on the first day of her 2019 Sports Illustrated Swimsuit shoot, which took place last November
Sultry spread: The mother of two made history when she became the oldest rookie model to pose for the iconic magazine
'Who needs bikinis or glam when you can take a stupid mirror selfie like this and know you’re the cleverest fn short chubby old mom model on the planet to look so damn good and even have flown four flights, four days early so you could hydrate, meditate and time-adjust? For the goddamned win.'
In the snapshot, Tara is completely nude and turned to the side while taking the bathroom mirror selfie. Her dark hair is loose around her shoulders, and she doesn't appear to have any makeup on.
Before posting the image, she drew an 'X' over her breast to cover her nipple, and at the end of her caption she explained that she is accepting Instagram's 'baby-feeder censorship.'
The mom has two sons: four-year-old Finley and two-year-old Rupert, who was born a little over a year before her shoot.
The stunning image was the last of three Instagram posts about how she physically and mentally prepared for her shoot with the magazine after being named a 2019 Sports Illustrated Swimsuit rookie model.
Working up a sweat: Tara's celebratory nude photo was the last of three Instagram posts about how she built as much muscle as she could in the five weeks leading up to her shoot
Goal: The curvy model worked with trainer Rock Tate, co-owner of Intrepid Gym-Montclair, as she worked to get strong and build muscle
Tara started documenting her experience back in June when she shared one of the images featured in her sultry magazine spread.
In the picture, she is lying on the beach, covered in sand, while modeling a tan thong bikini that highlights her curves.
'When I found out I was going to shoot @si_swimsuit and had five weeks to prepare, I decided I wanted to be in the best shape of my life,' she explained. 'Which for me means strong, visibly muscular, flexible, un-injurred.
'I’ve been very comfortable in a gym lifting weights alongside the big dudes for about fifteen years now, but I wanted the help of a professional to maximize my gym time and minimize my chances of injury - I have a history of getting excited and greedy and overdoing it,' she admitted.
'So I went to a trainer new to me, Rock Tate, co-owner of @intrepidmontclair and explained my goals. I wasn’t sure he’d ever trained a woman over 200 pounds whose goals were NOT weight loss, so I was emphatic with Rock about what I wanted: to build as much muscle as humanly possible in 5 weeks, without injury.'
Keeping it real: Tara admitted she wasn't sure if Rock had 'ever trained a woman over 200 pounds whose goals were NOT weight loss'
Five months after her first post, she shared a throwback video of herself working out with her trainer at Intrepid Gym-Montclair ahead of her Sports Illustrated Swimsuit shoot.
In the clip, she can be seen doing lunges, barbell squat presses, and a plank on a stability ball while working up a sweat.
'I work out, generally, to keep my mind focused and sort of release endorphins and keep myself happy — keep all of this nice and toned,' she says, admitting she has been pushing herself a bit more because of her upcoming shoot.
'So muscle gain was the goal, and that’s what I worked tirelessly at until shoot day,' she explained in her post. 'My trainer helped me firm up and ever so slightly bulk up. He pushed me hard, and most importantly helped me maneuver the threat of over doing it, adapting exercises to accommodate flare ups of previous injuries while continuing to work target zones.'
Tara admitted to feeling 'impatient' at the time because the process was 'going slower' than she had wanted.
Looking back: Tara posed for her spread on Kangaroo Island in South Australia last November
Postpartum: The shoot took place a little over a year after she welcomed her second son, Rupert, in 2017
'If I'm honest, I'll say I was frequently frustrated that I found myself in a situation where I felt rushed; if my personal ideal is to be strong and visibly muscular, why was the immense audience of @si_swimsuit a more powerful incentive than my own inner desire?' she wrote while looking back.
'I can’t say I feel proud of this aspect of my journey, and it feels important to say so. But I can say I’m still proud of the work itself. It was a month of discipline and incredible effort, and my conveniently selective memory tells me I loved every minute of it,' she added. 'And despite any inner frustration with my process, I loved myself immensely during this time too.'
Tara was discovered at an open call in her hometown of Seattle, Washington, and has been modeling for nearly 20 years. Her big break came after she appeared in V Magazine's 'Curves Ahead' editorial feature, and soon after, she landed a 22-page spread and the cover of Elle France.
Speaking to the New York Post in May, Tara said she was delighted when she found out she was going to be part of Sports Illustrated Swimsuit's 2019 issue.

Exciting time: The model said finding out she was going to be part of Sports Illustrated Swimsuit's 2019 issue was 'pure joy'
'That's a mind-blowing piece of news to get. I started laughing hysterically for a couple of minutes. It was pure joy,' she recalled, adding that she didn't mind being the magazine's oldest rookie.
'I'm the eldest, as I like to say. I think that sweetens the deal, and I think that is one of the most delicious parts to me.'
Tara explained that just because she is getting older, it doesn't mean her best career opportunities are behind her.
'So many of us have these grand goals when we are kids, and as time goes on, we seem to think our opportunities are narrowed down,' she said. 'We can get trapped in the idea that the older we get, the more opportunities are behind us.'
The model, who had only given birth a year before, said she wasn't worried about posing in a bikini for the shoot.
'I wasn't concerned about getting rid of the baby belly. I worked with a trainer to gain muscle. My focus was on fitness,' she said.
