As a leading global economy and an industrially developed country, Japan is attractive for the implementation of inventors’ ideas and may have significant prospects for the development and implementation of the V.O.D.A project, including the introduction into production and widespread use of hydropower installations. This country is focused on the development of industry and technology, promoting the introduction of innovative technical solutions into production and their use.
The application in the interests of the applicant D.V. Tiaglin for the protection of the invention “Energy Storage” was filed with the Japan Patent Office based on the international application No. PCT/RU2020/050186 and successfully passed all patent procedures предусмотренные Patent Act - the main regulatory act governing patenting of intellectual property in Japan.
The national phase of patenting the invention “Energy Storage” in Japan is carried out under the system of the Patent Cooperation Treaty of 1970 (Patent Cooperation Treaty (PCT)). In the international phase, the application for the invention “Energy Storage” PCT/RU2020/050186 was filed with the International Bureau of the World Intellectual Property Organization and published on March 4, 2021 on the PATENTSCOPE portal under number WO 2021/040569 - https://patentscope.wipo.int/search/en/detail.jsf?docId=WO2021040569
In the national phase of patenting the invention “Energy Storage”, the application was filed by a patent attorney and registered with the Japan Patent Office (JPO) on August 13, 2020 under No. JP 2022-513441. The Japan Patent Office (JPO) is a government agency responsible for the protection of industrial property rights, subordinate to the Ministry of Economy, Trade and Industry of Japan (website: https://www.jpo.go.jp).
Legally significant consequences for the inventor arise immediately after filing the application. Once the information about the submitted documents has been registered, their publication was carried out in the Bulletin of the Japan Patent Office. From that moment, the application is granted convention priority – similar inventions or other objects submitted later are subject to rejection.
After publication of the application and establishment of convention priority, a formal examination was carried out. Then a substantive examination took place.
Both examination procedures were completed with positive conclusions from the patent office experts, information about the new invention was entered into the relevant registers, and the applicant was notified in February 2024 of the decision to grant national protection for the invention “Energy Storage”.
After payment of the state fee, on April 4, 2024, the Japan Patent Office (JPO) issued a national protection document for the invention “Energy Storage” No. 7466630. Information about the patenting of the invention was published in the official Bulletin of the Japan Patent Office.
Upon receiving the patent document, the inventor acquires full protection of the technology in Japan. The invention will be protected for 20 years without the possibility of extension. The patent holder must also pay regular maintenance fees to keep the patent in force.
Recognition of the invention in Japan may contribute to the development of alternative energy sources and its widespread use in industry and infrastructure facilities, as well as the development and implementation of the hydropower installation itself in Japan.
