At the international phase, the PCT application for the invention “Energy Storage” (PCT/RU2020/050186), filed on August 13, 2020, was submitted to WIPO’s International Bureau and published on March 4, 2021 on Patentscope under No. WO 2021/040569. At the end of 2021, the national phase in New Zealand began by filing with the Intellectual Property Office of New Zealand (IPONZ) (official site: http://www.iponz.govt.nz). The “Energy Storage” application was filed by a patent attorney on behalf of the right holder, Denis Tiaglin, and registered under NZ application No. 784788.

Under New Zealand law, examination consists of a formal examination and a substantive examination. During the formal stage, the application is checked for compliance with formal requirements. Publication occurs in the official journal 18 months from the filing or priority date. To initiate substantive examination (which assesses patentability), the applicant must request it within 5 years from filing or within 2 months of an IPONZ notice—whichever is earlier. Substantive examination is conducted within 12 months after the request and payment of the examination fee.

If the decision is positive, registration follows, with publication in the official journal and grant of the patent. The grant fee must be paid and proof received by IPONZ within 3 months after the decision to grant.

At present, substantive examination of the “Energy Storage” application is underway, and the first positive examination report has been received from IPONZ: all claims have been found novel and inventive over the prior art. The report also lists formal objections that can be remedied by supplying additional documents to IPONZ within the next few months.

Completion of the substantive examination is forecast for the second half of 2024 with a positive decision and subsequent patent grant.
