TERMS OF USE AND CONDITIONS

1. ABOUT THE SERVICE

Nexa Companions is an entertainment service based on artificial intelligence. Interactions simulate conversations with fictional characters, not real people. Nothing provided by the service should be taken as medical, psychological, financial or legal advice.

2. MINIMUM AGE

The service is intended only for people who are 18 (eighteen) years old or older.

By using Nexa Companions you declare that:

- you are 18 or older; and

- you have legal capacity to use digital services.

Use by minors is prohibited. If we identify use by a minor, the account may be closed and access blocked.

3. ALLOWED AND PROHIBITED CONTENT

Nexa Companions may generate romantic or suggestive content for adult entertainment. It is strictly forbidden to request or publish:

- any content involving people under 18 (explicitly or implicitly);

- sexual violence, coercion, threats or non-consensual situations;

- hate speech, discrimination or encouragement of crimes;

- encouragement of self-harm, suicide or any physical harm.

You agree not to request this type of content and to stop using the service if you feel uncomfortable.

4. USER RESPONSIBILITY

You are solely responsible for:

- everything you send in conversations (texts, images, audio);

- how you use the content generated by the AI;

- ensuring that your use complies with the laws of your country.

You agree not to use the service for illegal purposes, harassment, disclosure of third-party data without consent or any use that violates third-party rights.

5. PLANS, CREDITS AND PAYMENTS

Nexa Companions may offer paid plans, credits and one-off purchases through third parties (for example, Stripe or Mercado Pago).

- Prices, limits and benefits of each plan are shown in the interface.

- Payments are processed by external providers; Companion does not store full card data.

- In case of payment failure, suspected fraud or violation of these Terms, access may be suspended or terminated.

6. PRIVACY AND DATA

To work, the service needs to store some information, such as:

- basic account data (Telegram ID, username, language, plan);

- small conversation history, generated photos and character preferences when needed to maintain the experience;

- usage records (technical logs) for security, abuse detection and service improvement.

We make reasonable efforts to protect your data but cannot guarantee absolute security. Never share confidential information (passwords, official documents or banking data) in conversations.

7. AVAILABILITY AND CHANGES

Nexa Companions is provided “as is”, with no guarantee of continuous availability.

We may change, suspend or terminate the service, specific features, plans or prices at any time, with or without prior notice, while honoring obligations already assumed with paying users.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

- we are not liable for indirect damages, loss of profit, data loss or any damage resulting from the use or inability to use the service;

- your use of Companion is at your own risk;

- AI-generated content may be inaccurate, inappropriate or offensive, and you agree to use common sense when interacting with the service.

9. ACCOUNT TERMINATION

We may terminate or suspend your account, in whole or in part, if:

- there is a violation of these Terms;

- there is suspicion of fraud, abuse, automated use or attempts to attack the service;

- use by a minor is identified.

You may stop using the service at any time. Refunds are not guaranteed, except when required by applicable law or a specific policy communicated through official channels.

10. GOVERNING LAW AND JURISDICTION

Unless otherwise stated, these Terms are governed by Brazilian law.

Any disputes will preferably be resolved amicably. If a dispute persists, the chosen forum, where permitted by law, is the courts of São Paulo/SP, Brazil.

11. CHANGES TO THE TERMS

We may update these Terms from time to time. The current version will always be available via the /terms command or official channels.

By continuing to use Nexa Companions after changes, you agree to the new version.
