Starbucks Faces Lawsuit After Customer Suffers Severe Burns from Spilled Hot Tea

Seattle, WA — October 25, 2023 — Starbucks is facing a lawsuit after a customer alleged she suffered second-degree burns when a cup of hot tea spilled on her lap during a visit to one of the coffee chain’s locations in Seattle. The incident has sparked renewed scrutiny over the safety of serving excessively hot beverages.

According to the lawsuit, filed in King County Superior Court, 34-year-old Emily Carter ordered a hot Earl Grey tea at a downtown Starbucks on August 12, 2023. Carter claims the lid on her cup was not securely fastened, causing the scalding liquid to spill onto her lap when she attempted to remove it from the counter.

Carter’s attorney, Mark Reynolds, stated that his client suffered second-degree burns on her thighs and abdomen, requiring multiple medical treatments and leaving permanent scarring. 'Starbucks has a responsibility to ensure their products are served at a safe temperature and that their cups are properly sealed,' Reynolds said. 'This was a preventable incident that has caused my client significant physical and emotional trauma.'

The lawsuit alleges that Starbucks serves its hot tea at temperatures between 175°F and 185°F (79°C to 85°C), which Reynolds argues is unnecessarily hot and poses a serious burn risk. The complaint also accuses the company of negligence for failing to adequately warn customers about the potential dangers of handling their beverages.

This is not the first time Starbucks has faced legal action over hot beverage temperatures. In 2019, the company settled a similar lawsuit after a customer in Florida suffered burns from a spilled cup of coffee.

In a statement, Starbucks said, 'The safety of our customers is our top priority. We are deeply sorry for Ms. Carter’s experience and are currently investigating the matter. We take all concerns seriously and are committed to providing a safe environment for everyone who visits our stores.'

The lawsuit seeks unspecified damages for medical expenses, pain and suffering, and punitive damages. Legal experts suggest the case could reignite debates over industry standards for serving temperatures of hot beverages.

For now, Carter hopes her lawsuit will prompt Starbucks and other coffee chains to reevaluate their practices. 'I just want to make sure this doesn’t happen to anyone else,' she said. 'No one should have to go through this kind of pain over a cup of tea.'

The case is expected to go to trial in early 2024.
