Ireland: The two-year-old boy was born in 2012 after his 13-year-old mum became pregnant by her 15-year-old brother.

The teenage boy disputed he was the father, but DNA testing proved the baby was his son.

A High Court judge has now ruled that the agreement of the toddler's mother to a freeing order can be dispensed with because she is incapable of giving consent, the Irish Mirror reports.
Mr Justice O’Hara's verdict came in a case involving family circumstances described as “depressing” and “hugely unsatisfactory”.

Both the mother and her son were taken into care - in different settings - within months of the birth. With no suitable family arrangements available, the toddler has since been placed with another couple.
The Trust involved in the case sought a freeing order on the basis that it is in the boy’s bests interests to be adopted - a view the judge held to be clearly correct.

Although the child’s father took little part in the proceedings, Mr Justice O’Hara had to decide whether the mother’s agreement should be dispensed with because she is incapable of giving consent or whether she is unreasonably withholding consent.

Now aged 16, the court heard she has had an “exceptionally difficult life” with recurring social services involvement due to a variety of concerns about her, her siblings and her mother and step-father.
“None of this is her fault - she is a victim of the way in which she was raised,” the judge said. “It is hard to identify any positive life experience which she has enjoyed.”

An educational psychologist’s report on her mathematical ability found only 3% of pupils the same age would have scored the same or lower on a numerical operations test and just 16% on reasoning. She produced stronger results on reading and spelling abilities.

With staff at her children’s home categorising her as “a very vulnerable young girl”, the judge also detailed a consultant child and adolescent psychiatrist’s report which “sets out in grim detail how miserable her life has been”.

The expert stated: “She is not in a position to fully understand the possible consequences of the various decisions which have to be made for herself and for the boy.

“Her reluctance to fully engage in the assessment process is one manifestation of this but the history and her responses during interviews have also informed my opinion in this regard.”
Based on her reports Mr Justice O’Hara ruled that the mother is not competent to make a decision on whether the child should be adopted.

In a judgement made public last week he said: “She is undoubtedly capable of making some decisions as is shown by some elements of the psychological assessment but not a decision which is of a magnitude and which has the consequences of the present one.

“It appears to me that this finding on her competence undermines the proposition that she can be properly regarded as unreasonably withholding her agreement to adoption.”

The judge confirmed: “I am satisfied that the agreement of the mother to the making of an adoption order for the child should be dispensed with because she is incapable of giving her agreement.”

A mum has revealed her heartbreak after discovering that two of her children are in a relationship together.
The mother said she was shocked to learn her son and step-daughter - who’ve been living together as a family since they were toddlers - had formed a romantic bond.

Sharing on Reddit, she said she refuses to accept their relationship and says it makes her “sick and angry”.
“When my son Nathan was two, he met a friend in his daycare class, who we’ll call Abby,” she said.
“Her dad, Jack, was one of the only other single parents there, as his wife had left after Abby was born.
“Jack and I bonded over our children and ended up dating for a year and a half before getting married, and we had our daughter Eliza less than a year later.
“Jack and I always raised all three of our children the same, and though they knew that Nathan had a different dad and Abby had a different mum, we had never thought to question if they saw each other as siblings.”
The mum went on to say that her life was tipped upside down last week when Nathan and Abby admitted they’d been in a romantic relationship for the past few years.
“She said that it happened after they were both adults, that they had gone to relationship counselling when it first started and that they were seriously thinking about marriage,” she said.
“Nathan then told us that they had admitted to having feelings for each other as teenagers, but had never acted on it because they were afraid of ruining their friendship, hurting each other, and most of all what we would think.
“At this point, Jack looked at me, grabbed my hand and hugged our children.
“He told them that he was sorry for us keeping them apart and that he ‘could tell how happy they are together’.
Since Nathan and Abby confessed their love, the mum said she’s struggled to cope.
“I haven’t responded to any of their messages or calls, and pretended I wasn’t home when they tried to visit during the day,” she said.
“I’ve been fighting with Jack since this happened, even so far as telling him ... they would never have my blessing, and I would put them both in therapy for having incestuous desires.
“This really upset him, and the fighting got so bad that I had him sleep in the guest house.
“I’ve never gone this long without talking to my children. I’ve never fought my husband. He’s even threatened me with divorce.
“I have no idea how to navigate this, and every time I think about it their whole relationship just makes me sick and angry.”
Many Reddit users sympathised with the mum’s reaction.
“Nathan and Abby were raised as siblings since they were toddlers and share a sibling not much younger than them,” said one.
“This isn’t a case of you and Jack meeting when your children were all grown, or possibly a much younger sibling they didn’t see much or even living in different houses throughout their childhoods.
“They were raised as brother and sister, and while they don’t share blood, they do have a sister together.
“I think your reaction is completely normal and justified.”
Added another: “It doesn’t matter if they technically don’t share blood.
“They were raised together as siblings since they were three years old, which is about as far back as any of us can remember. This is messed up.”
But others believed there was nothing wrong with the siblings dating, given they’re not related by blood.
“They are adults and it sounds like they took the correct steps before starting a relationship,” said another.
“Perhaps, you should consider therapy to work through your issues with their relationship.
“After all, they aren’t biologically related so this isn’t incest.
“You can’t force them to feel like siblings just because they grew up together.”

A mother woke up in the night to find her 14-year-old son raping her, a court heard.
Initially she thought it was a dream, but after realising the "enormity of the situation" she began screaming.
Her teenage son, who is on medication for ADHD, had been having behavioural problems in recent weeks, Preston Crown Cour was told.
For some years he had been in the habit of climbing into bed with his mother, but the boy - from Blackpool and now aged 15 - denied a charge of rape.
The prosecution said the woman had been asleep before waking and realising the "enormity of the situation, that her son was in the process of having sex with her".
In her police interview - which was taped and played in court, the woman said she was "trembling from the inside" after the alleged attack.
The teenager, who cannot be identified, left the courtroom while the interview was played.
Judge Pamela Badley explained to the jury he did not want to be present during the interview and that she had given him permission to leave.
Speaking of what happened, the woman told police: "I just know when I opened my eyes he was there. I don't even know what I said. He scuttled out of the room and didn't say anything.
"I just sat there holding my covers, screaming and thinking 'what the hell's just gone on?'
"Does he know what he is doing? Is he aware? Now I am actually thinking what state is he in? Does he know what he has done?"
The mother told investigators that her son had had issues for a long time.
She described her last 18 months with him as being an "absolute nightmare".
