Cinsel saldırı suçunda, organ veya cisim sokma eyleminin gerçekleşmemesi durumunda suçun nitelikli teşebbüs olarak değerlendirilmesi mümkündür. Mahkeme kararlarında, sanığın eyleminin nitelikli cinsel saldırıya teşebbüs olarak kabul edilmesi için gerekli hukuki ve fiili unsurların varlığı incelenir.
Eğer failin sokma fiilinde kullandığı organ veya sair cisim, cinsel motif taşımıyor ve mağdurun sokma fiiline maruz kalan organı da cinsel organ olarak kabul edilen anüs veya vajina değil ise bu suçun nitelikli cinsel saldırı olarak kabul edilmesi mümkün olmayacaktır.
