A Shirley man is facing indictment after Massachusetts State Police said the online sales site eBay notified them that he had purchased a sex doll shaped and sized like a child.
The dolls are not illegal, and the man, 48-year-old Sean McClure , a level three registered sex offender who spent a decade in prison for multiple counts of rape of a child, was not charged with having it.
Rather, the doll led police to his stash of child pornography. McClure is facing indictment for possession of sexually explicit images of children.
But McClure's arrest raises the larger questions of whether these dolls should be illegal.
Federal lawmakers are following in the footsteps of Great Britain and Australia, which have banned the importation and distribution of child sex dolls.
"There’s only one reason to possess one of these dolls," said Congressman Dan Donovan, a Republican from Staten Island. "It’s to fulfill some perverted fantasy that someone has about having sex with a child or a baby."
Donovan is pushing a bill that follows in the footsteps of the United Kingdom and Australia, banning the importation and distribution of child sex dolls. But his proposal does not prohibit owning a doll.

"Right now, child sex dolls proliferate mainly through international manufacturers," Donovan said. "My bill will stop these dolls from reaching pedophiles, which is the goal. It's clearly within Congress' jurisdiction to regulate interstate commerce, so that's the avenue I chose to take."
Child sex dolls are made overseas and imported into the United States. McClure is believed to be the first local case where a doll was involved in an arrest and prosecution.
The dolls do not fall under child pornography laws.
"The definition is right there. It’s not a child," said Carlos Cuevas, an associate professor of criminology at Northeastern University.
Cuevas evaluates sex offenders and works with victims. He wants the dolls banned altogether, and said Donovan’s proposal doesn't go far enough.
"There’s a lot of ways you can get someone a doll and not get caught," he said. "Once it’s in their hands, that’s where the problem is."
Donovan’s office said they did not push to make possession of the dolls illegal because of First Amendment concerns.
"We ban lots of things that are potential harm not actual harm," Cuevas said. "Drunk driving laws. Drunk driving is illegal because it can potentially hurt or kill somebody."
There is no shortage of what are often called "love dolls" for sale. They are posed on slides with toys or treats, some with measurements matching children as young as five years old.
In recent months, the NBC10 Boston Investigators have found them promoted on YouTube, eBay, Amazon — even Pinterest.
With recent public pressure, the shopping sites have gotten more aggressive in removing listings. But there are simple work-arounds.
We asked an eBay seller if a doll they were advertising with adult specifications if could be customized into a child version. They told us that it could be "tailored to one’s preferences."
eBay said in a statement that it could not comment on the specifics of McClure’s case.
"However, no company, including eBay, should tolerate its platform being used for nefarious reasons," the company said in its statement. "We regularly work with law enforcement to support them with criminal investigations. We will continue to work tirelessly to ensure that eBay is a safe and secure platform for all of our customers.
"eBay has blocks and filters in place to keep prohibited items, including child-sized sex dolls, off of our site," the company continued. "From time to time, sellers circumvent these filters, so we also undertake regular, manual sweeps to identify and remove these prohibited items. We take our policies very seriously and sellers who violate them, including evading our filters, will be restricted or suspended."
Cuevas said now is the time to put legal safeguards in place. Sex doll technology has already gone to the next level with adult sex bots, and he warns that child versions could soon be making their way into the U.S., fueling dark desires.
“Most of these people have already viewed child pornography, already potentially have hands-on offending,” he said.
State police started investigating McClure after eBay notified their Cybercrime Unit that he had paid an overseas seller $700 for, specifically, a doll with the height and weight of an average 8-year-old girl. Suspicious of a sex offender convicted of child rape owning a child-sized sex doll, investigators confronted McClure.
Soon after, they got a search warrant for his home, where state police, Shirley police, and special agents from the U.S. Department of Homeland Security discovered a cache of child pornography, according to state police.
McClure is being held on $20,000 cash bail.
Middlesex County Assistant District Attorney Rachel Perlman told Judge Margaret Guzman that the district attorney’s office is pushing for McClure to be indicted on Superior Court charges.
The U.S. House recently unanimously passed Congressman Donovan’s bill. It has not been heard in the U.S. Senate yet.

A Japanese company that produces lifelike and anatomically-correct sex dolls claims that they prevent pedophiles from offending.
Shin Takagi has been shipping the dolls to clients around the world for over a decade.
Takagi told the Atlantic that he is helping people express their desires legally. “We should accept that there is no way to change someone’s fetishes,” he said.
“I am helping people express their desires, legally and ethically. It’s not worth living if you have to live with repressed desire.”
While treatments for pedohilia exist, a study by the Mayo Clinic 61074-4/abstract|target="_blank") found that treatments do not change a pedophiles basic sexual orientation towards children.
Takagi says that the dolls he creates (sent mostly to "men living alone") save children from sexual abuse.
“I often receive letters from buyers. The letters say, ‘Thanks to your dolls, I can keep from committing a crime. I hear statements like that from doctors, prep school teachers—even celebrities," he said.
Psychologist and sexologist Michael Seto, told the Atlantic that there are two differnt types of pedophiles.
"For some paedophiles, access to artificial child pornography or to child sex dolls could be a safer outlet for their sexual urges, reducing the likelihood that they would seek out child pornography or sex with real children," he explains.
“For others, having these substitutes might only aggravate their sense of frustration.”

SICK child sex dolls modelled on a 14-year-old Instagram star are being sold on Etsy, say shocking reports.
Cops in Australia say they have seized more than 100 of the twisted mannequins over the past five months.
One seller - with the username Sexy Lady Fox - reportedly claimed some of those being sold online were based on an underage social media star.    
The sex dolls are advertised as being 156cm tall - the average height of a 13-year-old girl.
Fiends were even able to send in a photos of real children to have them customised to order, reports news.com.
“We can change the wig,” the seller said in reply when sent two computer generated images of young children.
“I think it is very similar to the images you send me.”
After Etsy was told what was happening by NCA Newswire it quickly deactivated the "shop" from the popular sales platform, say the reports.
The outrageous trade was revealed when sexual assault advocacy group - Collective Shout - posed as an interested buyer.
However, those selling the twisted items initially appeared to try and justify what they were doing.
“We are selling the most required real dolls on the market,” the seller said, who identified themselves simply as Federica.
When asked if it was the intention to make the dolls look underage, they replied: “To be honest, if I think that somebody (will) buy and use a real doll instead doing something wrong with a young girl, I’m grateful.”
However, this sick claim was branded “self-serving” by Collective Shout.
“Men who are found with child abuse dolls are also (often) found with other forms of child sex abuse material, including things like photos and videos of children and babies being raped and tortured,” said its campaign manager Caitlin Roper.
“There are reported scenarios from this year of men still incorporating living children into their child sex abuse doll use,” she added.
Ms Roper cited research from the Australian Institute of Criminology, which stated there was no evidence these kind of dolls prevent child sexual abuse.
“Instead, they present a risk of escalation and may actually increase the likelihood of child sexual abuse,” she said.
The providers of these vile sex dolls have shown they will go to sick lengths to supply customised material to pervets, Ms Roper told NCA NewsWire.
“Men could see a girl out in public, take a photo and say, ‘I want a doll modelled on her’,” she said.
“They could send in photos of children they know or have some kind of caretaking power over, so there’s lots of ways men can use this to victimise living children.
“It’s a new way they can be victimised and abused even without their knowledge and without their presence.”
Assistant Customs Minister Jason Wood said the Australian Border Force and law enforcement were working to stop the vile dolls entering the country.
“Increased intelligence work undertaken across the Home Affairs portfolio and the ABF’s commitment to detecting this abhorrent material has ensured these items are stopped at the border,” he said.
Legislation introduced in June allows for a mandatory minimum sentence of four years’ imprisonment in situations where it is the person’s “second-strike” child sexual abuse offence.
“These penalties reflect the serious role that these products can play in normalising and desensitising offenders to child sexual abuse,” added Mr Wood.
“The ABF is committed to working closely with our law enforcement partners, both here in Australia and overseas, to combat this issue, and we will continue to pursue and prosecute.”
Australia has seen a spike in childlike sex doll imports with the Australian Border Force seizing more than 100 dolls in less than five months to November 18.
At least 191 dolls have been found this calendar year, in comparison to 145 in the whole of 2019. The majoritywere discovered in packages from China, Hong Kong, Japan and Singapore. 
Etsy has reportedly been contacted for comment over the shocking revelations.
