CHICAGO (CBS) – Chicago Police have launched an internal investigation – admitting they dropped the ball in the case of a 10-year-old girl targeted in a string of sexual assaults .
Officers finally arrested one of the suspects late Friday, but CBS 2 Investigator Dave Savini revealed Monday night that they could have arrested him months ago.
Instead, they allowed a child predator to roam free. During that time, his victim – a little girl – was locked in a psychiatric hospital.
"I'm just as outraged and frustrated as anybody else," said Jennifer Coleman, the first assistant at Cook County State's Attorney's Office.
Five men are accused of assaulting the girl, but none of them was charged with felonies until the CBS 2 Investigators exposed the Chicago Police Department's repeated failures in the case.
During our interview with Coleman last Thursday, she said her office has been unable to charge these men with sexual assault because CPD never provided any evidence.
Police reports for these assaults show at least three rape kits were performed in these five cases. The State's Attorney's office had not received any of the kits when we sat down for the interview.
But the day after our conversation with Coleman, Chicago Police suddenly arrested Samuel Brown on felony charges for sexually assaulting the little girl.
The 37-year-old has been accused of meeting the girl on a dating app and sexually assaulting her in a Chicago-area garage last May.
After this May assault, administrators at the Department of Children and Family Services (DCFS), who had been monitoring the little girl since she was six, recommended she and her family receive intact family services. This means services like counseling and parental training should have been provided – but the department failed to provide her with the resources she urgently needed.
Even though DCFS had more than a dozen reports about the fifth grader being abused and neglected, it failed to implement intact services until October 2020 – five months later.
But that wasn't the only delay in this case.
After the 37-year-old assaulted the girl, she was given a rape kit – the results matched Brown's DNA.
In fact, it was an easy match. Brown's DNA was already in the system because he's a registered child sex offender. Back in 2003, he was charged with sexually assaulting a minor in Iowa.
Despite having key evidence against Brown, no arrests were made. Instead, CPD sat on the rape kit results, allowing him to remain free for four months.
"This is not acceptable," said Brenda Myers-Powell, a local advocate appointed to the United States Council on Human Trafficking. "This is a 10-year-old baby."
Powell wants the CPD to do the job they're paid to do. She said police's negligence in these cases sends the wrong message to predators.
"They've made it a joke," she said.
The CBS 2 Investigators first introduced you to the little girl last month – the fifth grader taken to the top floor of the Grand Motel at 10022 S. Halsted St. – room 324. In that case, a different man was involved – a 47-year-old assaulter from Chicago.
During the time of this assault – October 2020 – concerned motel workers contacted the police. But officers failed to arrest the man and take the girl to the hospital for a rape kit.
Coleman confirmed police never sought charges in this case and her office never received rape kit evidence.
And the CPD's failure to charge these five perpetrators does not end there.
The CBS 2 Investigators recently learned details about another one of these cases.
A 22-year-old man took the little girl from Chicago to a home in Gary, Ind., where he is accused of repeatedly sexually assaulting her.
The child had been gone for days when police finally got a tip and traced the suspect's cell phone number. He was eventually arrested – but only on misdemeanor charges.
And the misdemeanors? Harboring a runaway and contributing to the delinquency of a minor.
"Misdemeanor charges are for swiping a candy bar from the drug store," said Charles Golbert , who has been fighting on behalf of abused children for the Cook County Public Guardian's Office for 30 years.
Prosecutors say Chicago Police didn't consult them before deciding only to pursue misdemeanor charges against the man who took her to Gary.
"With misdemeanors, the police can do what we call direct filing – they just file that on their own," Coleman said.
To date, Chicago police have not presented Coleman's office with evidence to file felony charges against the 22-year-old.
"This is a crucial part of what we expect our CPD to do – to protect our children if nothing else," said Myers-Powell.
Our investigation prompted the CPD to launch an internal probe into the mishandling of this girl's cases. After we started asking questions, the CPD assigned a new detective to the case – a decision that led to Brown's arrest late Friday.
Chicago Police released the following statement Monday:
" The Chicago Police Department is deeply concerned with the unacceptable delays of this investigation and is conducting a complete audit of the lead detective's work, including an investigation into any violations of the Department's investigatory policies and procedures. Immediately upon learning of the concerns regarding this investigation, the case was reassigned to a new detective, and the offender was promptly arrested on Friday, March 12 and charged with predatory criminal sexual assault of a victim under 13 on Saturday, March 13. The additional cases remain under investigation, pending the return of forensic results from the Illinois State Police Forensics Lab.
"We must remain steadfast in ensuring that all victims, especially children that have been subjected to criminal sexual assault, receive the proper protections and services immediately following and throughout the criminal investigation. We are revisiting our policies and practices, in addition to meeting with advocates, to prevent any unnecessary investigative delays from happening again. We must do better. "
The day after our story aired, Mayor Lori Lightfoot's office issued the following statement:
As a woman, a mother and simply as a human being, I am outraged and horrified at how many ways this child has been failed for years by those around her. This is simply unacceptable and no child in Chicago or anywhere should endure what this child has. We must all learn from this moment to make sure we do all that we can to take care of her--and to make sure this never happens again to any child on our watch. 
This systemic failure is particularly disgraceful given the seemingly extensive contacts that the State's Department of Children and Family Services (DCFS), and other providers have had with this child and her family over the past 4 years. Of course, the detective involved in failing to act on a DNA hit, must be held accountable. Superintendent Brown has appropriately opened an investigation. CPD, at the prompting of the State's Attorney's Office, ultimately did act, arresting and charging an alleged offender. I have also directed the CPD to open a criminal investigation into all alleged offenders to make sure all adults responsible for any abuse or exploitation of this child are held accountable.  
I urge DCFS and the Public Guardian to take further action. DCFS must immediately prioritize a full investigation to determine if any other children that remain in the household are at risk. 
The Public Guardian's office needs to exercise its power to gain full and immediate access to this child to ensure that her rights are protected going forward. 
My office is working with CPD to review and revise policies involving the sexual abuse and human trafficking of minors. My team has developed the City's first strategy to create a coordinated response to human trafficking, which includes training all City employees about how to identify and respond to suspected human trafficking. This also includes working with CPD to reform policies around human trafficking and to ensure that any minor who is discovered engaging in commercial sex is treated as a victim--not a criminal--and is immediately connected with vital services. We are working with community organizations and survivors to revise training and policies used in connection with these crimes to improve officers' understanding of what commercial sex and human trafficking can look like, particularly for our youth. 
We must also stop the adultification of Black girls--who too often are blamed when they should be treated as victims--particularly in cases of sexual abuse. 
Our protective ecosystem for children in Chicago is clearly not strong enough. Improving it will take a comprehensive, community-driven approach to preventing violence and intervening appropriately when it does. To this end, I have also convened the City's first gender-based advisory council, which brings together frontline organizations, survivors and City departments to reform and guide public and private systems to better serve and protect survivors.

SINGAPORE: A 17-year-old boy who had sex with his younger sister after frequenting pornographic websites was on Wednesday (Aug 8) sentenced to 21 months' probation and 180 hours of community service.
The teenager - who cannot be named to protect the identity of the victim - sexually assaulted his sister in 2013, when she was 10. The boy was 12 years old at the time of the crime.
The court heard that the boy was exposed to pornography in 2013. Although he was initially disgusted by it, he soon became more interested and began surfing pornographic websites, court documents said. He eventually felt the urge to simulate what he saw on those websites.
In September 2013, the boy became aroused after watching a television show with a bedroom scene.
He summoned his sister, who was alone with him in the flat, and told her he wanted to "try something with her". 
He threatened to tell their parents about her mobile phone usage if she did not comply. He proceeded to penetrate her without a condom, stopping only when she complained of pain.
Their parents subsequently found out that the boy had touched his sister’s private parts on several occasions. They did not lodge a police report, but since 2014, both children had been seeing a counsellor from the Counselling and Care Centre. 
BOY MOVED TO STAY WITH GRANDPARENTS
Arrangements were also made for the boy to move to his grandparents’ home so as to keep him away from his sister. After six months of counselling, he was assessed to have reintegrated well and allowed to move back home.
However, in August 2016, the boy started watching pornography again "due to the stress he felt over his studies". He asked his sister, then 13, into his bedroom and molested her.
That same month, his mother told the counsellor that her son had continued to commit sexual offences against her daughter.
The matter was referred to the Child Protective Service of the Ministry of Social and Family Development, and a police report was made in April 2017.
The boy pleaded guilty in June to one charge of sexual penetration of a minor under 16 and one charge of outrage of modesty.
Six other charges of molesting and having sex with his sister were taken into consideration for sentencing.
PROSECUTOR ASKS JUDGE NOT TO ALLOW ACCUSED TO STAY IN HOME WITH YOUNG GIRLS
District Judge May Mesenas sentenced the teenager to 21 months' probation. He also has to perform 180 hours of community service and undergo counselling and psychological treatment.
Additionally, an Internet filter service must be installed on mobile communication devices used by the accused, so as to allow his parents to monitor his Internet usage.
Deputy Public Prosecutor Marshall Lim also asked the judge to include in the court order that the boy should not live in a household with any females under the age of 16.
"The offences he committed against his sister - she was a ready and available target," said Mr Lim. "We have to cut off the availability of any victims for him to prey on."
The judge agreed. She also ordered that any future contact between the teenager and his sister be supervised by an adult.
When asked if he had anything to say, the accused, who was unrepresented, said he was very regretful and asked for a second chance.
"Do you really understand and treasure this chance? Because you have committed a very serious offence against your only sister, your younger sister, and threatened her," said the judge. "I really hope that she can heal from this. The parents are in a most difficult situation."
Speaking to the boy's parents, the judge said that they would need to go for counselling as a family.
Turning to the boy, she said: "You have to respect women. And I think you have to respect your mother as well, (judging from) the way you speak to her."
For sexual penetration of a minor under 16, the teenager could have been jailed up to 20 years and fined or caned.
For molesting his sister, he could have been jailed for up to five years, fined, caned, or given any combination of these punishments.
