A 17-year-old Georgia boy has been charged with a felony for allegedly secretly recording a video of two other teen students in the middle of sex in a school bathroom last week, PEOPLE confirms.


Kyle Steven Bahner faces a count of eavesdropping-surveillance for allegedly filming a male and female student — 16 and 15, respectively — while the latter two were engaged in a consensual sex act in a closed boy's bathroom stall at their Atlanta-area high school on May 2, according to an arrest warrant obtained by PEOPLE.


Bahner allegedly reached over the bathroom stall and began to record the pair from above, the warrant states. He then shared the video with his friends and soon it spread throughout the school via social media and platforms, authorities claim.


Police say the video was recorded without the pair's knowledge and was reported the following day by an assistant principal at Harrison High in Kennesaw. All three teens are students there.

"I took a video of a guy and a girl in a stall because I don't see how they should let that happen and I was showing it to my friends," Bahner allegedly told school administrators during their investigation, the warrant states.


He was arrested on Thursday after the school's assistant principal reported the video to school district police. He was bailed out about an hour after his arrest, records show.


Under state law, Bahner is considered an adult for the purposes of criminal prosecution because he is at least 17 years old.


"This incident has been thoroughly investigated by school administrators and school district police. In addition to the criminal charge, appropriate action has been taken in accordance with the Student Code of Conduct," the school district said in a statement to PEOPLE.


A district spokesman said he was unable to answer further questions.


It is unclear whether Bahner has an attorney who could comment on his behalf or if he has pleaded to his charge. He could not be reached directly on Wednesday.

A social media video clip reportedly showing two students having sex in a Maryland high school classroom is under investigation by school officials and legal authorities.
The incident occurred in a classroom within Woodlawn High School, a school in the Baltimore County town of Gwynn Oak. Upon learning of the video, Principal Jamel Jernigan alerted parents in an October 8 letter. The letter has only recently been reported by local media.
"I was recently made aware of a social media post of a video involving Woodlawn High School students engaged in highly inappropriate behavior while in class," the letter said, according to WJZ-TV.
"An investigation is underway with school administration, our [Baltimore County Public Schools] safety manager and the Baltimore County Police Department," the letter continued.
Jernigan's letter didn't specify how many students were involved, their ages or the date of the incident. A student is believed to have recorded the incident, the aforementioned news outlet noted. It's also unclear if the alleged sex act or the reposting of the video constituted crimes.
The principal's letter did state, however, that students could be subject to possible disciplinary action if their behavior was found to be "inappropriate for the school environment."
The school has reportedly declined to comment on the case beyond acknowledging the existence of the principal's letter.
Newsweek contacted the Baltimore County Police Department for comment.
The recording and transfer of sexual content between teens have become more common as more teens own smartphones, the journal Pediatrics reported in May 2019.
At least 1 in 4 teens has received sexually explicit texts or emails, according to an April 2018 study published in the journal JAMA Pediatrics . Approximately 1 in 12 teens has forwarded sexual content to others without the consent of the sexual partners involved, the study added.
Sometimes sexual content is sent out to others as a form of cyberbullying known as "revenge porn." Revenge porn, which can originate from a former sexual partner or someone else who recorded other people's sex acts without their knowledge, is often meant to shame sexual partners.
U.S. state laws on teen sexting vary widely from state to state. The laws and their application depend on several factors. Those factors include the age of the people involved, the explicitly graphic nature of the content itself and how widely the content is shared.
Some states have decriminalized the production and sharing of teenage sexual content between teens, as long as the creation and sharing are consensual. Other states punish teen sexting as a misdemeanor charge or with felony child pornography charges.
Maryland has laws forbidding revenge porn, according to Cyberbulling.org. Maryland teens who engage in sexting can receive up to 20 years in prison and a lifetime sexual offender status for producing or possessing teen sexual content, the Pediatrics article noted.
"Interestingly, in these states, a teen sexter can be charged as both an offender and a victim," the article said.

FORT MYERS, Fla. – Students and parents are in shock after a group of teenagers had sex in a high school bathroom in Fort Myers, Florida, and then posted a video of the act on social media.
A teenage girl had sex with as many as two dozen boys after school Tuesday afternoon at South Fort Myers High School, according to a Lee County Sheriff's Office incident report.
Deputies said 25 males were spotted via a hallway camera entering the restroom while the female was inside, the News-Press reported .
"A bunch of football players went into a room with a girl and had sex with her, and a bunch of the football players were suspended," student Alex Bailey told WBBH . "So we might not have a football team this year."
"The fact that that could've happened is just crazy in my mind," another student said.
Parent Megan Roldan said the incident proves some parents need to be more aware of what their children are getting up to when school ends.
"And apparently, obviously the parents need to be talking to their kids more,” Roldan told WINK . “And being aware of what their children are doing after school."
Even though the incident happened after hours, some students are wondering where the administration was when all of this was going on.
"I just don't see how that could've happened because there is so much security in there,” student Erin Bollinger said. “Like the teachers are really on top of all of that."
Students said the entire thing was filmed and then posted on social media.
"There's girls that saw the video once and it hurt, it is just so disturbing to them," student Casey Winn said.
Some parents question how this could have happened at the school.
"Well, they should be walking around the halls and things like that and know where the kids are,” Roldan said.
But others said they trust the school district to handle the situation
"I trust them to take care of it,” one woman said. “I really do think that that is their job and they will take care of it."
The sheriff's office said the girl's mother is not planning to press charges.
A school district official said the students involved have been disciplined.

On the May 3, 2016, their son Jalen — a then 16-year-old who has learning difficulties, and an IQ of less than 50 — was forced to perform oral sex on a classmate, who has Down syndrome.
The incident was all caught on camera “selfie-style”, while the pair travelled on a 20-seater supervised school bus to Victoria’s Monash Special Developmental School, which have since cancelled their contract with the bus service provider, Crown Coaches, following the incident.
“You kind of think the kids are safe on the bus,” Mr Aughterson told news.com.au.
“But the supervisor didn’t see a thing [as they were seated at the front of the bus].”
During the abuse, Jalen’s mobile phone — which was given to him by his parents to watch movies and listen to music during the morning and afternoon commute — was taken by the other student, who was the same age.
It was then used it to film the oral sex for approximately three minutes.
It is understood the student’s genitalia were exposed during the video.
“Out of luck, Leanne checked Jalen’s phone that night and saw 30 pictures of the boy who abused Jalen,” he said.
“Then she clicked on one of the three videos and saw the first 10 or 15 seconds and couldn’t watch anymore.
“I looked at the phone and was horrified. How this boy forced Jalen into it, I believe he knew what he was doing to Jalen.
“We found the footage at 10pm that night, and a whole range of things go through your head.
“My wife is pretty firey, and she wanted to kill everyone that night.
“He’s such a beautiful boy, it’s just shattering that something like this could happen on a supervised bus. I didn’t sleep well for a few weeks after seeing the video.”
But the upset soon turned to anger for Jalen’s parents, who live in Rowville, Victoria, after they questioned whether this was an isolated incident or not.
“What really worried us is that this was filmed, but how many other times might this have happened without the camera?” Mr Aughterson said.
Following the discovery, Mrs and Mrs Aughterson approached the school with the footage — where they were redirected to the bus company, Crown Coaches, who own the bus where the sexual assault occurred.
“When the bus came the next morning, I went out and told the driver that Jalen wouldn’t be on board that morning because he had been sexually assaulted,” Mr Aughterson said.
“The driver, who had been driving Jalen for five years, went white like he’d seen a ghost.
“After going to the school and showing them the footage on Jalen’s phone, I just broke down watching it again. Once one tear came out, they all came out.”
From there, the school contacted the police. Police advised that unless the Aughtersons were going to press charges against the boy who abused Jalen, there nothing they could do.
“We had to make a decision on what to do, and because we didn’t want to put Jalen in front of a court, and with the other boy being disabled as well, we didn’t press charges,” Mr Aughterson said.
Mr Aughterson is unsure if his son understands what happened on the bus, and if he has been impacted by the abuse.
“I don’t think he understands what happened,” Mr Aughterson said.
“When we ask him what happened, Jalen drops his head and doesn’t want to talk.
“But dropping his head and not wanting to talk is Jalen’s default mechanism, even when we ask about something good he will drop his head.
“But since the incident, Jalen won’t walk past the other kid’s house, who lives down the street from us. When I ask if he wants to go past the boy’s home, he asks to go another way.”
Speaking to the bus company, Crown Coaches told Mr and Mrs Aughterson the boy who abused their son had been taken off the bus and would not be on the same bus as Jalen in the future.
It is understood the supervisor on board the bus was reprimanded and put on a different bus run.
“A full review of the incident and how it happened was instigated,” a spokesman for Crown Coaches told news.com.au.
“Immediate measures were taken to ensure an incident of this nature was not repeated. The review outcomes involved a retraining of staff and a reallocation of responsibilities.
“The matter was referred to the police for investigation. We have had no further contact from the police on this matter.”
Just last month, the same bus company came under fire after a child with special needs was forgotten during the school drop-off and spent the day alone in a bus — which reached a temperature of above 30C.
The seven-year-old was aboard a Crown Coaches bus on his way to the Monash Special Developmental School in Wheelers Hill, in Melbourne’s southeast when he was left behind.
The young boy, who slept throughout the day, was found when the bus left the depot to pick up other schoolchildren in the afternoon.
“They keep saying all the right words — that they have learnt and that they have taken action against the individuals, but the sad thing is ... these things just seem to keep happening,” Mr Aughterson said.
“Other things have happened to Jalen on these buses. He came home six weeks ago with a black ear after one kid hit him.
“And then just before the sexual abuse in May, another kid grabbed Jalen’s phone and started screaming profanities into the camera.
“We couldn’t understand why someone didn’t intervene and grab the phone off him.”
Mr and Mrs Aughterson admitted the incident with their son made them feel as if they had “failed” Jalen.
“Our son been going to school with this kid for five years and been on multiple camps and school outings with him,” he said.
“But while the other kid has been moved into another class, you still worry. What happens when Jalen goes to the toilet? Who is there to protect him?
“Jalen is so vulnerable, if you used the right tone and speak to him in the right way, you could convince him to eat a dogsh*t sandwich.
“Never in 100 years did we consider this kind of abuse would happen to our son.”
Mr Aughterson said they had decided to seek legal advice with Shine Lawyers, and within an hour of telling the school they were going public with their story, the Education Department had cancelled Crown’s transport contract with the school.
“Looking after Jalen is challenging, you can never relax when he is around, but these teachers do it with 10 kids, so I praise them for that,” Mr Aughterson said.
“But when I looked into taking legal action, I organised to see the principal, and when I went in there were four people in the meeting room, and they all tried to chan
