Lindsey Jarvis was jailed after she was caught by cops with the boy in her car in the early hours
A TEACHER who groomed an underage pupil for sex behind her husband’s back is making a bid for freedom.
Lindsey Jarvis, 29, was caged for 18 months for raping the 15-year-old in a series of clandestine trysts.
She was nailed after a cop caught her with the boy at 1.17 a.m. in her car in a park after he sneaked out of his home without permission to meet her.
Jarvis admitted having sex with the teen after grooming him by text and was jailed for 30 months at the end of last year.
But she is now suing law and prison bosses in Kentucky, insisting she should be granted parole.
She claims she was “made to understand” she would be quickly eligible for early release because she finished a sex offender treatment programme before she was sentenced in December, court documents say.
But the state’s Department of Corrections wants her lawsuit thrown out of court, reports the Lexington Herald-Leader.
As Jarvis completed most of the programme before she was a registered sex offender it should not count, the department argues.
It also says her 16-month programme was shorter than the two-year one required by state law.
A judge is due to hear the case brought by Jarvis against the Department and Attorney General on Wednesday.
After Jarvis was caught in her car with the student, investigations revealed the pair were texting each other after becoming pals.
She was arrested in Lexington after mobile phone evidence about a months-long “romantic relationship” was discovered.
Their romps took place in two different counties - Woodford and Fayette.
Her trial heard she would meet the boy in local parks and desperately tried to keep their relationship a secret.
Jarvis was jailed for a year at Fayette Circuit Court in December 2018 after pleading guilty to third-degree rape.
The sentence runs concurrently with an 18-month prison term handed out at Woodford Circuit Court 48 hours earlier after she admitted rape.
Jarvis, whose husband Andrew stood by her when she first appeared in court, drove the student to her home for sex three times, court documents reveal.
The youngster gave police details of the house, including the master bedroom, stairs and entrance.
They also hooked up at parks, taking precautions no one would see them, the documents said.
Jarvis, who married in December 2013, resigned in June 2016 as a social studies teacher at Woodford County Middle School, Versailles.
She moved to Fayette County as a teaching assistant at Veterans Park Elementary School, Lexington, before quitting after her arrest in June 2017.
The school the student went to was not revealed.

A FEMALE teacher has been charged with rape and sodomy after allegedly having sex with a 15-year-old boy.
Kendall Burk, 23, romped with the student multiple times over the summer break, police in Kentucky say.
The Grant County High School biology teacher was arrested on Wednesday after a student reported the sordid allegations to staff.
Under Kentucky law, "sodomy" is defined as "deviate sexual intercourse" - including oral sex.
Burk is accused of engaging in multiple sexual encounters with the student off-campus during the summer holidays, Local 12 reported.
The University of Kentucky graduate faces four counts of sodomy and four counts of rape.
Burk had only taught at the school for just over a year before her arrest this week.
Grant County Schools superintendent Matthew Morgan told parents that Burk had been "removed from duties" while on trial.
He said in a letter on Thursday: "While these events, of course, sadden us, our first priority – and that of the law enforcement with whom we work – is and must always be the protection and safety of our students."
Burk has been held in the county jail on a $50,000 bond ahead of a court appearance on Monday.
