YOUNGSTOWN, Ohio (WKBN) — A Mahoning County grand jury Thursday indicted a Cameron Avenue man for the rape of a 12-year-old girl found in his attic.
Devin Davis, 33, was indicted on a first degree felony charge of rape as well as a charge of child endangering. He has been in the Mahoning County jail since his arrest in June.
Davis was interviewed by police and told them he thought the girl was 21 and she told him she was 21.
The affidavit in the case police used for the search warrant said Davis is accused of raping the girl from April 1 to June 8.
Davis has been on parole for a 2000 conviction on a charge of gross sexual imposition.

In a shocking sequence of events, a 13-year-old Dalit girl was allegedly kept at a police station for a whole night and beaten up when she wanted to lodge a rape complaint in Madhya Pradesh's Chhatarpur city.
Three police officers were suspended on Wednesday in connection with the incident which allegedly took place on August 30, a senior official said.
Babu Khan, who is accused of raping the girl, was arrested on September 3 under the relevant sections of the Indian Penal Code, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and Protection of Children from Sexual Offences (POSCO) Act, police said.
City Kotwali police station house officer (SHO) Anoop Yadav, Sub Inspector Mohini Sharma and Assistant Sub Inspector Gurudutt Shesha were suspended for keeping the rape victim in the police station, Chhatarpur district superintendent of police Sachin Sharma told reporters on Thursday.
Joint district Collector Pratap Singh Chauhan said a complaint of rape was received from the district child welfare committee (CWC) following which the case was registered.
As per the teen's mother, the girl went out of the house to play on August 27 but did not return, so her father lodged a missing person complaint at the Kotwali police station next day.
On August 30, the girl returned and told her parents that Babu Khan had forcibly taken her to his house, confined her there, and raped her for three days.
"We went to the police station to get a complaint registered. Two policewomen put pressure on my daughter to change her statement. They beat up my daughter. Another police officer took me outside. Inside, my daughter was kicked and beaten with belts," she alleged.
The girl was allegedly kept at the station the whole night while her parents waited outside.
Even on August 31 when they went back to the police station and asked inspector Yadav to register a case, they were driven out, the girl's mother alleged.
Finally, on the evening of September 1 police registered a case of rape against the accused but did not include the charge of kidnapping, she said.
In the First Information Report, the girl's age has been shown as 17 years and it does not mention the charge of kidnapping.
CWC member Afsar Jahan said the police seemed to be trying to save the culprit and to get the victim change her story.
Saurabh Bhatnagar, another CWC member, said the Child Welfare Committee asked police for documents about her age after learning that her age was shown as 17 years instead of 13.
When a CWC team visited the girl's house, inspector Yadav was there with the accused who was in handcuffs, Bhatnagar said, adding that as per law, a rape accused cannot be brought in the victim's presence.
Besides, law also forbids male police officers from recording the statement of a woman rape victim, he pointed out.

The second of two suspects wanted in the kidnapping and rape of a 14-year-old girl in Bell Gardens last week has been arrested.
Robert Nunez, a transient, has been taken into custody, Bell Gardens police reported Monday.
Last Thursday evening, police said, Nunez lured the victim into a residential garage.
When she got inside the garage, Nunez and a second suspect, identified as 40-year-old Jaomir Perez, tied her up, police said. Nunez then purportedly raped her at knifepoint.
Perez was apprehended the day of the attack. It's unclear exactly when and how authorities located Nunez.

The police in India arrested a teen girl who made four men rape her 13-year-old younger sister and helped the suspects to strangle the victim to death after the horrific act, reports said.
The incident was reported from Lakhimpur Kheri, a city in the northern Indian state of Uttar Pradesh on Tuesday. The unidentified teenager, who was reportedly in a relationship with the men, committed the crime after the victim opposed it, Hindustan Times reported .
The police arrested seven suspects Wednesday including the victim's elder sister, the four men who sexually assaulted the victim, identified as Ranjit Chauhan, Amar Singh, Ankit, and Sandip Chauhan, and two of their aides, Deepu Chauhan and Arjun, who stood guard during the assault.
"The two sisters had frequent quarrels (with the victim) after the younger one recently came to know about the elder one's illicit relations with the four men and objected to it," SP Sanjeev Suman, an investigating officer said explaining the motive behind the gruesome murder.
The teen suspect reportedly took the younger sister to a sugarcane field near her home Tuesday where the victim was attacked by the four men. When the girl tried to resist the assault, the elder sister forcibly held the victim's hand and made the suspects rape the girl. After the assault, the teen girl also helped the men to strangulate her younger sibling, police said.
The investigation began after the victim's body was spotted later that day. During interrogation, the sister confessed her involvement in the crime and narrated the incident to the police, Times Now reported .
Earlier this week, a Texas woman was wanted for allegedly murdering her sister and forcing her 13-year-old son to help dispose of the victim's body. The suspect, identified as Carmen White, allegedly shot the victim, Cynthia Cervantes, multiple times in the back of the neck and dumped her body before setting it on fire. The victim's family believes that White, who had an altercation with Cervantes, took revenge on her after she called the cops on her in February.
