**RIGHTS AND USAGE**

Artwork Usage and Copyright

Unless otherwise agreed in writing, the purchase of an artwork grants the Client a limited, non-exclusive, non-transferable license to use the finished artwork for personal, non-commercial purposes only.

Permitted personal use includes, but is not limited to:

• posting the artwork on personal social media accounts;
• using the artwork as a profile picture or avatar;
• using the artwork as a personal wallpaper;
• displaying the artwork privately or on personal websites;
• other similar forms of personal, non-commercial use.

The purchase of an artwork does not transfer ownership of the copyright or intellectual property rights to the Client. All copyrights and other intellectual property rights in the artwork remain with the Artist unless a separate written agreement states otherwise.

Commercial Use

Any commercial use of the artwork requires prior written permission from the Artist and may be subject to an additional licensing fee.

Commercial use includes, but is not limited to:

• selling or reselling the artwork;
• using the artwork on merchandise or products intended for sale;
• using the artwork for advertising, marketing, branding, or promotional purposes;
• using the artwork to generate revenue or promote a commercial business, product, service, or project;
• incorporating the artwork into a commercially released game, book, publication, video, or other product;
• licensing, sublicensing, transferring, or otherwise granting third parties the right to use the artwork.

The scope, duration, territory, and cost of any commercial license will be discussed and agreed upon separately before such use begins.

ADOPTS

Upon purchase, full rights to the created character design are transferred to the Client. The Client may:

• Develop and modify the character freely, including making changes to the character’s appearance, design, colors, clothing, accessories, or other elements without requiring the Artist’s permission.
• Use the character in personal projects and on social media without additional permission or fees.
• Commission artwork of the character from other artists, as well as give the character a name, personality, backstory, and other personal characteristics.
• Transfer or resell the character. Resale is prohibited only if the character is being sold without any modifications or additions made by the Client. If the Client wishes to resell the character without making any changes to the original design, the resale price must not be lower than the original purchase price.
• Use the character design for commercial purposes, including commercial projects, products, merchandise, advertising, branding, and other forms of monetization.

Modifications and Derivative Works

The Client may not edit, alter, trace, redraw, recolor, crop, manipulate, or otherwise modify the finished artwork without the Artist’s prior written permission.

The Client may not commission another artist or third party to substantially modify, redraw, or recreate the artwork without prior permission from the Artist.

If the Client requires modifications to the artwork, they should contact the Artist directly. Depending on the nature and complexity of the requested changes, an additional fee may apply.

Artist Credit

When publicly posting or displaying the artwork, the Client is encouraged to credit the Artist whenever reasonably possible.

Credit may be omitted if necessary, as the Artist's signature is included in the artwork unless otherwise agreed upon.

Artist’s Portfolio and Promotional Rights

The Artist retains the right to display the finished artwork in their portfolio, on their website, and on their social media accounts for self-promotion and portfolio purposes, unless the Client and Artist have agreed otherwise in writing before the artwork is completed.

The Artist may also use the artwork as an example of their work when promoting their commissions or artistic services.

Unauthorized Use

Any use of the artwork that exceeds the rights granted under these terms without the Artist’s prior written permission may constitute unauthorized use.

If the Client wishes to use the artwork in a manner not covered by these terms, they must contact the Artist before such use and obtain written permission.

By purchasing an artwork, the Client acknowledges and agrees to these terms unless a separate written agreement has been made between the Client and the Artist.
