A MAN who took off his condom during consensual sex with a prostitute has been jailed for 12 years for raping her.
Lee Hogben, 35, ignored his female victim's repeated objections and carried on having unprotected sex with her in a hotel room at the historic four-star Royal Bath Hotel in Bournemouth.
In doing so Hogben 'broke the agreed terms of consent' with the escort who then went to the police.
He was arrested on suspicion of rape the next day and forensic tests taken from the complainant matched Hogben's DNA to a probability of one in a billion.
Hogben denied the charge of rape but was found guilty following a trial.
After being sentenced Hogben threatened to shoot the sentencing judge in an angry outburst.
Appearing via video-link at Bournemouth Crown Court, Dorset, he told Judge Stephen Climie: "I'm coming for you. You'll get a shotgun in the face at night."
The court heard the victim, aged in her 20s, advertised her services on an adult work website.
She specifically indicated online that all her clients must use protection when with her.

Hogben made contact with her and the pair met at a hotel in his home town of Bournemouth on January 19 last year.
The pair agreed a price in advance for two hours of her services.
Jodie Mittell, prosecuting, said the escort claimed Hogben threatened her with violence when she resisted him during sex.
She said: "Hogben went beyond what was consented to by removing the protection, which the complainant will say was a condition of intercourse.
"She repeatedly protested, 'I don't do that - please, no'.
"She tried to wriggle away but he told her to stop.
"He told her he had beaten people up and robbed people."
Afterwards Hogben left without paying the woman despite spending two hours in her company.
Ms Mittell read aloud a victim impact statement from the victim. In it she said she has considered self-harm as a result of what had happened to her.
Hogden, who is a known offender with dozens of previous convictions for harassment and driving offences, was convicted of rape and two counts of assault in relation to the escort.
He also pleaded guilty to threatening to destroy property, disclosing private photographs, breaching a restraining order and making a malicious communication in relation to a second female victim.
Nick Robinson, mitigating, said the offences occurred when Hogben was in a 'heightened emotional state'.
The defendant suffered years of sexual abuse while in care.
He said: "His coping mechanism is driving, violence, abuse and talking to people the way he talks about himself and to himself."
Hogben was sentenced to 12 years in prison as well as an extended licence period of six years, making the total sentence 18 years.
He was also sentenced to indefinite restraining orders and a sexual harm prevention order.
Detective Inspector Kate Lill, of Dorset Police, said: "Lee Hogben is a dangerous offender who raped and sexually assaulted his frightened victim.
Sexual consent is an agreement to participate in sexual activity but this doesn’t give a person taking part to do whatever they like.
Boundaries can be established about what is, or isn’t permitted.
Without that consent sexual activity is considered to be either sexual assault or rape.
Under the law, anyone can change their mind about what they feel like doing at any time, so if a couple are having sex and the woman decides she wants to stop, if the man continues this could be considered to be rape.
If someone consents to only have sex if a condom is used, those are the agreed terms and should anyone break that agreement then there is no consent and it is considered to be rape.
"I want to praise her and all the witnesses in this case for their courage in coming forward and supporting the investigation.
"We will always take reports of sexual offences extremely seriously, regardless of someone's background or circumstances.
"We acknowledge that not everyone will want to report a matter directly to police. We have a sexual assault referral centre for Dorset and its expert staff are independent of the police."

A prostitute in fear of being sent to prison pulled her client’s condom off his penis and swallowed it whole to try and destroy the evidence.
The 48-year-old Vietnamese national named Dang was found guilty of perjury after misleading police following a crackdown on sex workers.
She was jailed for two months for lying to a local court in Western Taiwan after claiming that she did not have sex with her client, identified as Yao.
Identified only as Dang, she will not be punished for trying to destroy evidence because the condom was never found.
Police raided the ‘health spa’ at 9pm on March 14 and found her in a room on the first floor.
Dang and Yao were questioned separately on prostitution charges and Dang denied any illegal activity.
However, her client admitted they were ‘halfway through’ having sex when police smashed their way in through the front door and said that Dang quickly removed the condom.
Officers searched the room after finding a condom wrapper and later reported that she was constantly asking for water.
She was taken to Jen-Ai Hospital in neighbouring Taichung City where scans revealed a ‘shadow’ in her chest, which police believed was the condom.
As a result, they were never able to formally charge Dang with destruction of evidence.
Doctors at the facility said the woman – had she really swallowed the condom as suspected – risked having the rubber lodged in her upper respiratory tract or somewhere in her digestive system, which would require surgery to extract in the future.
However, it could also be digested without obstruction.
The woman’s client and another massage parlour worker were also punished, but their sentences have not been revealed.

I had sex with a prostitute in Arizona via craigslist & I will NEVER make that mistake again (temptation). She was also much older than me so I’m assuming she’s “been around” a lot. She gave me unprotected head for about 1-2 mins and then I put on a condom and we proceeded to vaginal sex. We were having sex for about 10-15 mins and during that time I checked to see if the condom was broken and it appeared that it wasn’t. However there was a point when I was not in her and noticed the condom was no longer on my penis & it had slipped off. It could have been from my last withdrawal, but I don’t remember. I’m not sure if I was having sex with her at all without it on, or if it was on just until my last pull out. If it wasn't on.. it only had to be for at least a minute or so. We stopped having sex at that point and she finished me off with unprotected oral & I came on her chest. I'm extremely worried that I could have gotten HIV from the condom slipping off during sex.. to the point where this has been on mind 24/7 since the incident.. which took place 5-16-08. I called her and she said she gets checked up every 3 months but she didn't have the chance to say whether she had HIV at the moment or not.. because she said she was burning up minutes and would call me back from another phone - however she never did which scares me. I know there are similar questions like this on here, so sorry but it makes me just feel better posting my own story. What are real chances of me getting HIV from this?? I know 6-8 weeks is the best time for a first test, but right now I am FREAKING OUT. I am very young and made a foolish mistake. I’ve had no symptoms.. yet. She was also diabetic.. but I don’t think that has anything to do with anything. Now I know your probably going to tell me my odds and stuff, but why are they low? 1:1000.. I don’t get how its that hard to get the virus. Sorry for the long question(s)! Please help, this is the most scared i've ever been. Thanks

You may have had a single unprotected exposure to a commercial sex worker (CSW).  Your chances of having gotten HIV from this exposure are extraordinarily low.  Here's why:

1,  Even though she did not call back, chances are, your partner did not have HIV.  Most CSWs do not, even older ones.  Her likelyhood of being infected on a statistical basis is less than 10%
2.  Your chance of getting HIV, if she was infected is less than one in 1000 per exposure.  This fact is established from scientific studies.  
3.  You were at least partially protected, this is likely of some benefit to you.

When you put all of these facts together, your chances of being infected from the exposure you describe is less than one 100th of 1%.  Getting tested in the future is reasonable.  At 4 weeks, 85-90% of tests that are going to be positive will be.  Good luck- EWH

You are right, the HIV epidemic is huge, effecting nearly 50 million people worldwide there are more than 3 billion people living on earth at the moment, this this eidemic effects only a small proportion of the owrld's population.  Furthermore, when you subtract pout peole who are really hhigh risk (risk taking men who have sex with other men, drug users, etc) the likelyhood of your exposure becomes quite small.  this is not an endorsement of risk taking- safe sex is the way to go- but a look at the odds.  Your job (and mine) is to work to keep the odds in your favor.  EWH


oh no i believe you, i was just curious to how the percentage rate comes out like that. the thing is i've never educated myself to well on HIV and i have a lot now. before it just seemed to me that HIV was a huge epidemic the way it is portrayed, and that a lot of people in America had it - and also that it was really easy to get through sex. so i thank you doctor and all the other people on these forums for your knowledge and help. like i said i was just curious on how the statistics worked and now i have a good idea from research and everyones help on here.

You are correct, there are lots of factors. The figure I provided is an average value.  that is what scientific studies provide.  If you choose to not believe me, that's fine.  This is not a debate.  EWH


thanks for the response. it just seems strange to me that if someones unprotected penis was in an infected womans vagina for lets say 10 mins, that you would have a 0.001% chance of getting the virus. there must be A LOT of factors that come into play.
