HLS Professors John Goldberg and Henry Smith are working to reinvigorate the study of contracts, torts, and property with the new Private Law Workshop, which they co-teach as part of the Project on the Foundations of Private Law at Harvard Law School. The workshop, said Goldberg, is “an opportunity to introduce students to some of the emerging literature that’s aiming to rethink the significance of private law in modern legal systems.”

The Transactional Law Clinics consist of the Business and Non-Profit Clinic, the Real Estate Clinic, the Entertainment Law Clinic, and the Community Enterprise Project.

Private law is law that concerns how individuals and firms can or must interact with one another. Though many subject-areas within the law have important private-law dimensions, including corporate law, employment Law, and family law – at its core are subjects such as agency, contracts, fiduciary law, property, restitution, and torts. These bodies of law define basic legal rights and duties (such as the right to have contractual promises enforced, and the right against another person’s invading one’s house or privacy) and also important legal powers (such as the power to make legally binding arrangements). A world leader in contemporary private law and private law theory, Harvard Law School offers students instruction from dozens of faculty members who research and teach in private law areas.
Tort law expert and Harvard Law Professor John C.P. Goldberg explains what election technology companies Smartmatic and Dominion Voting Systems must do to prove their claims of defamation against former former Trump allies, how likely they are to succeed, and whether these types of lawsuits might have an impact in the fight against disinformation.
In “Recognizing Wrongs,” Goldberg and his co-author argue that much of the criticism of tort law comes from failing to appreciate its character and purposes.
Harvard Law School Professor John C.P. Goldberg, an expert in tort law, tort theory, and political philosophy, recently discussed some of the work that he’s done at HLS as well as a forthcoming book on torts that he is co-authoring with Fordham Law School Professor Benjamin C. Zipursky.

That portion of the law that defines, regulates, enforces, and administers relationships among individuals, associations, and corporations. As used in distinction to public law, the term means that part of the law that is administered between citizen and citizen, or that is concerned with the definition, regulation, and enforcement of rights in cases where both the person in whom the right inheres and the person upon whom the obligation rests are private individuals.
