Personal Data may be provided voluntarily by the User or, in the case of usage and ELD-related data, collected automatically while the Application is in use.

Unless otherwise specified, all requested Data is necessary to provide the Service, and failure to provide such Data may result in the inability of the Application to deliver its services.

The Owner applies appropriate technical and organizational safeguards designed to prevent unauthorized access, alteration, disclosure, or destruction of Personal Data.

Alongside the Owner, access to Data may be granted to personnel involved in operating this Application, including administrative staff, support teams, legal and compliance units, and system administrators, as well as external service providers such as hosting companies, IT vendors, communication providers, and technical partners appointed as data processors where necessary.

Place

Data is processed at the Owner’s operational locations and at any other sites where parties involved in processing activities are based.

Depending on the User’s location, Data may be transferred and processed in jurisdictions outside the User’s country of residence.

Retention Time

Unless otherwise stated in this document, Personal Data is retained only for as long as necessary to fulfill the purposes for which it was collected. It may be stored for longer periods where required by applicable legal or regulatory obligations, including those related to transportation compliance, ELD regulations, audits, taxation, accounting, dispute resolution, or enforcement requirements, or where the User has provided consent for extended storage.

Purposes of Processing

User Data is collected and processed to enable the Owner to operate the Leon ELD mobile application, support electronic logging and hours-of-service functionality, maintain driver and vehicle records, facilitate roadside inspections and compliance procedures, meet legal and regulatory obligations, respond to official requests from authorities, protect legitimate interests and rights, detect and prevent fraudulent or malicious activity, and provide technical support services.

Device Permissions for Personal Data Access

Depending on the User’s device, this Application may request specific permissions to access device-related Data as described below. These permissions must be explicitly granted by the User before access is enabled and may be revoked at any time through device settings.

Please note that disabling or revoking certain permissions may negatively affect the functionality of the Application, including ELD features, location tracking, electronic logs, inspection tools, and document-related services.

Phone Permission

Used to access basic telephony and device state information, such as read-only access to phone status, device identifiers, network information, or call state data, where necessary for security purposes, account management, customer support, or core service functionality.

Precise Location Permission, Including Continuous Location

Used to access the User’s precise geographic location. The Application may collect, process, and utilize location Data to support ELD-related functionality, including duty status tracking, vehicle movement recording, trip history generation, compliance reporting, mapping features, inspection assistance, and other operational or safety-related functions. Location Data may be collected in the background when required for ELD operations and when permitted by the User’s device settings.

Storage Permission

Used to access shared or external storage, including the ability to read, store, or upload documents, logs, diagnostic records, inspection files, images, and other data necessary for the operation of the Service.

Detailed Information on the Processing of Personal Data

Personal Data is collected and processed for the following purposes and through the services described below:

Provision of Leon ELD Mobile Application Services

The Application processes driver information, account data, carrier details, vehicle information, electronic logs, location data, hours-of-service records, diagnostic information, inspection records, and device-related identifiers in order to deliver ELD functionality requested by Users and motor carriers.

Compliance and Legal Obligations

The Application may process, store, and disclose Personal Data where required to comply with applicable transportation regulations, ELD and hours-of-service rules, lawful governmental requests, audits, inspections, subpoenas, court orders, or other legal procedures.

Support, Security, and Maintenance

For operational, security, and maintenance purposes, the Application and associated systems may collect system logs, crash reports, device information, IP addresses, and usage data in order to maintain service stability, troubleshoot issues, improve performance, and protect system integrity.

Legal Basis of Processing

The Owner may process Personal Data of Users under one or more of the following legal grounds: where the User has provided consent for specific purposes; where processing is necessary for the performance of a contract with the User; where processing is required to comply with legal obligations; where processing is necessary for legitimate interests pursued by the Owner or a third party; or where processing is required to protect legal rights and respond to lawful requests.

Further Information on Retention Periods

Personal Data collected in connection with contractual obligations between the Owner and the User is retained for the duration necessary to fulfill those obligations and for any additional period required under applicable law or legitimate operational needs.

Electronic Logging Device (ELD) records, Records of Duty Status (RODS), Hours-of-Service (HOS) data, vehicle activity records, location records, and other transportation compliance records are retained for a minimum of six (6) months in accordance with applicable FMCSA requirements. Such records may be retained for longer periods when required by law, regulatory obligations, audits, investigations, litigation, contractual obligations, dispute resolution, enforcement actions, or legitimate business purposes.

Once the applicable retention period expires, Personal Data may be deleted, anonymized, or archived where reasonably feasible, unless continued retention is required by law, regulatory requirements, security investigations, backup procedures, or other legitimate operational needs.

User Rights under the General Data Protection Regulation (GDPR)

Users may exercise certain rights regarding their Personal Data, subject to applicable law. These rights may include the right to withdraw consent, object to processing, access personal data, request correction, request restriction of processing, request deletion, receive data in a portable format, and lodge complaints with relevant supervisory authorities.

Sources of Personal Information

We collect Personal Information directly from Users or indirectly through their interaction with the Application, including when they create or use an account, connect a vehicle or device, submit logs or documents, contact support, or when the Application automatically collects ELD-related, device-related, location-based, and usage data required for Service functionality.

Your Privacy Rights Under U.S. State Laws

Subject to applicable law, Users may have rights to access Personal Information, correct inaccuracies, request deletion, obtain a copy in portable format, opt out of sale or sharing where applicable, restrict the use of sensitive Personal Information where permitted, and exercise these rights without discrimination.

To exercise these rights, Users may contact the Owner using the contact details provided in this document. Identity verification may be required prior to fulfilling such requests.

Disclosure of Data

The Owner may disclose Personal Data to service providers and contractors assisting in Application operations, including hosting, infrastructure, customer support, analytics, communications, security, maintenance, and compliance services. Data may also be disclosed to motor carriers, drivers, authorized personnel, enforcement agencies, or regulatory authorities when necessary for ELD compliance, inspections, legal obligations, safety purposes, or regulatory requirements.

Children’s Privacy

This Application is not intended for children under the age of 13 and does not knowingly collect Personal Data from individuals under 13. If it is discovered that such data has been collected, the Owner will take reasonable steps to delete it.

Driver Privacy and Non-Harassment

LEON ELD collects and processes location information, Electronic Logging Device (ELD) records, Records of Duty Status (RODS), and Hours-of-Service (HOS) data for compliance, safety, fleet management, operational, and customer support purposes.

The information collected through LEON ELD is not intended to be used to harass drivers or to encourage, require, or pressure drivers to violate applicable Hours-of-Service regulations, safety requirements, or transportation laws.

Motor carriers and users remain responsible for complying with all applicable FMCSA regulations, including anti-harassment and coercion requirements.
