LOS ANGELES -- Actress Priscilla Barnes says the only reason she posed for nude photographs that appeared in Penthouse Magazine was because she was broke, and would not have done it had she known they might be reprinted with her real name.
The former 'Three's Company' co-star testified Wednesday at a non-jury trial over Penthouse's request to republish portions of an explicit 19-picture layout that appeared in a March 1976 edition under the name Joanne Whitty.

Penthouse attorney Norman Roy Grutman argued that Barnes, 29, signed a legal release allowing the magazine to reprint the photographs, which he described as 'the most gorgeous, erotic' pictures he has ever seen.
The photos, taken when Barnes was 20, show the actress, 'from her toenails to the hair on her head,' Grutman said. She appears alone in all of the pictures.
Grutman said Barnes signed a model's release in 1975 giving Penthouse permission to 'publish and republish photographic pictures or portraits of me ... in conjunction with my own or a fictitious name.'
But her attorney, David Elson, argued the document was only for one-time use.
'Penthouse was buying the picture of a pretty girl,' he added. 'They were not buying her name.'

Testimony was completed Wednesday, and U.S. District Court Judge James Ideman ordered closing arguments to be heard Nov. 7.
Penthouse sued Barnes in May to win the right to reprint the nude photos. She countersued, claiming publication of the pictures would be an invasion of her privacy.
Barnes, who wore a dark tailored suit to court and had her blonde hair pulled back, said she posed for photographer Jeffrey Dunas in November 1975 only because she believed her real name would not be used. She was paid $2,000.
'I was broke,' she testified. 'I didn't have enough money.'
The actress said she had second thoughts the day after the photo session and unsuccessfully demanded that the pictures be returned.
'I felt dirty after the session,' she explained. 'I didn't feel well about it.'
She said Dunas -- who Grutman said is hiding out in Paris to avoid testifying -- refused to return the photos.
Grutman also showed Barnes' a copy of a 1982 issue of High Society magazine including photos of the actress, wearing only panties. The headline read, 'TV plus T&A equals Priscilla Barnes.'
Barnes said those photos were reprinted from outakes of a movie she was filming and that she did not authorize the magazine to print them. She said she didn't sue High Society because she didn't want to draw attention to the pictures.

Grutman said Penthouse publisher Robert Guccione has promised not to reprint the photographs of Barnes until the trial is settled. If the judge rules the contract is valid, he said, Penthouse will republish the photos 'as soon as possible.'
