Можно ли жениться или выйти замуж за того, кто совершал прелюбодеяние? Что об этом говорится в Коране? Как трактуют ученые соответствующие аяты о прелюбодеях? Отвечает имам-хатыб Московской Мемориальной мечети Асхат-хазрат Гиматдинов.
Касательно вот этого вот аята суры Ан-Нур, « Прелюбодей женится только на прелюбодейке », что ему дозволено это и прелюбодейка выходит замуж только за прелюбодея и запрещено это для верующих, каков тафсир? Нужно вернуться к тафсиру этого аята.
Ибн Касир приводит тафсир этого аята, что Ахмад ибн Ханбаль сказал, что именно, имеется в виду в этом аяте прелюбодейка, которая не сделала тауба, не попросила у Аллаха покаяния, не оставила. То есть, например, она не целомудренна и запрещено не прелюбодею на ней женится. Например, мужчина не совершал зина и девушка, которая совершает зина, совершает прелюбодеяние и не делает таубу и выходит за него замуж и она на этом же продолжает прелюбодействовать, то вот это запрещено. А если она попросила у Аллаха прощения (тауба) и оставила это или он был прелюбодеем и попросил Аллаха прощения, попросил покаяния и оставил, то это тогда дозволено.
Как Аллах говорит в Коране [ Тот, кто просил у Аллаха покаяния, после этого просил прощения и изменился в лучшую сторону, то Аллах Прощающий и Милосердный ].
Так же пророк Мухаммад (мир ему и благословение) сказал: « Тауба, искреннее покаяние, прощает все, что было раньше ».
Так же Аллах говорит в Коране: [ Благие дела стирают плохие дела ]. Имеется в виду, если человек совершал прелюбодеяние и хочет жениться на девушке, которая не совершала прелюбодеяния, но он при этом попросил у Аллаха покаяния, то ему дозволено. Если человек продолжает совершать прелюбодеяния и женится на девушке, которая не совершала прелюбодеяния или наоборот, то это не дозволено. Хорошие дела стирают плохие дела.
Есть некоторые саляфы, которые говорят, что нет, даже если он совершил прелюбодеяние, и ему сделали наказание плетью, то тогда он не имеет права жениться на девушке целомудренной. Прелюбодей, который прошел наказание плетьми имеет право жениться только на такой же. То есть, получает такую же девушку, которая прошла наказание. Получается, что это одно из мнений.
Однако большинство мнений ученых такого: человек, если он был прелюбодеем, оставил это и попросил у Аллаха покаяния, то он может жениться на целомудренной девушке. И так же наоборот. Если девушка совершила зина, прелюбодеяние и попросила у Аллаха прощения, то тогда она может выйти замуж за целомудренного.
