A former Squamish firefighter who pleaded guilty to possessing child pornography has been sentenced to 10 months in jail.

A report was made to the B.C. integrated child exploitation unit, which launched an investigation.
Information from the internet service providers led police to Martin. A search of his residence in June 2019 resulted in police seizing a number of devices.
In imposing sentence, provincial court Judge Reginald Harris said the volume of pornography possessed and the nature of the material were aggravating factors.
“Also aggravating is, Mr. Martin shared the material and he breached his employer’s trust by using the fire department’s Wi-Fi addresses as a tool in his offending,” said the judge. “Lastly, and statutorily aggravating, is that the images involve the abuse of persons under the age of 18.”
Martin’s lawyer argued that his client’s subsequent resignation from the fire department and the resulting media coverage of the case were mitigating factors, but the judge did not accept that argument.
“In this regard, I would expect any first responder whose duties include assisting and interacting with children to appreciate that the loss of their employment would be a natural consequence of engaging in criminal behaviour harmful to children,” said the judge.
Martin claimed that his circumstances were exceptional and that he was addicted to pornography, but the judge also rejected those arguments. The judge said there was no reliable evidence showing that Martin lost control and was truly addicted.
“In fact, and to the contrary, there is ample evidence showing he was in control. In this regard, he was fulfilling the daily rigours of working as a firefighter, he was volunteering in a demanding setting, he was caring for his child and he was attending to social engagements.”
The Crown called for a sentence of between nine and 12 months in custody followed by two years of probation. The defence said a 12-month conditional sentence to be served in the community was appropriate.
The judge concluded that incarceration was necessary to achieve the required degree of denunciation and deterrence and imposed a 10-month jail term and one year of probation.
Conditions of probation include that Martin must not possess or use any device capable of accessing a computer network, including the internet, except in certain circumstances, and must not possess, access or view any form of pornographic material.
