A 16-year-old Maryland girl who was prosecuted for sending her friends a sex video she made of herself has launched an appeal. 
The girl made the tape in October 2016 and was convicted of distributing child pornography after two friends, aged 16 and 17, reported her.   
Court documents stated that the three teens would regularly send 'silly videos' in a bid to 'one up' each other. 
The 16-year-old, referred to as S.K, sent the one-minute clip of her performing oral sex on an unidentified male.

Her two friends informed an officer from the Charles County Sheriff’s Office and even though at least one of them shared it in school, only S.K faced charges. 
She was put on probation and referred for a mental health evaluation.
She and her family appealed the court decision and are now awaiting a ruling from the Maryland Court of Appeals, expected later this year.   
At the girl's initial hearing, the prosecutor said the state was not 'trying to prove a point in going forward with this case,' but that 'the state believes that the respondent is in need of some guidance, rehabilitation for something deeper' and 'is just trying to help her.'    
The Court of Special Appeals, which upheld the conviction, sided with the state in ruling that legislation hadn't included exceptions for consensual sex or for self-produced child pornography. 
'The state has an indisputable interest in protecting minors from exploitation 'as subjects in pornographic material' . . . whether at the hands of others or by their own conduct,' wrote the chief judge.  
However, in the same ruling the court rejected the finding that the teen was responsible for 'displaying obscene material' to a minor because the law doesn't allude specifically to the technology she used to do so. 
But in February the Maryland Court of Appeals' - the equivalent of a state supreme court - was told by the girl's defense lawyer that the her conduct was voluntary and legal .
'The statute is intended as a vehicle to protect, not prosecute, minors victimized and exploited in the production of sexually explicit videos,' Claudia Cortese defending wrote.

A 16-year-old Virginia girl is facing a charge of distributing child pornography after tweeting nude pictures of herself.
The James City County girl posted the pictures on or around January 30, and they were shared by various friends before a school resource officer was informed about them.
The school staff member spoke to the girl and her mother before turning the case over to James City County police.

Police charged the girl with one felony count of possession, reproduction, distribution, solicitation, and facilitation of child pornography.
According to the WAVY , police decided to pursue the harsh charge due to the 'lewdness' of the photos.
The teen may face jail time for the nude photographs, but it's more likely she and her parents will have to complete a court-ordered 'Sexting Education' program.
Officer Stephanie Williams-Ortery said teenagers often don't understand the seriousness of sharing personal information and photographs online.
'It’s not just friends that see what they post but also strangers and everyone else out there,' Williams-Ortery told WAVY.
'You have no idea who’s out there watching. You never know who’s going to see what you post.'
This isn't the first time the mix of sex and social media has had disastrous results for a teen.

Last month, a Canadian teen was convicted of child pornography possession after posting a nude photo of her boyfriend's ex-girlfriend on Facebook.
The girl's lawyer slammed the decision after her guilty verdict.
‘These child pornography laws were intended to protect children, not to persecute them, and again it seems the criminal justice system, it's a heavy hammer to be using,’ said Christopher Mackie.
Williams-Ortery says the Virginia girl isn't the only one who may be in trouble with the law over the pictures.
'I would hope that they would not then forward it on to their friends because then they become guilty also of distribution of child pornography, whether they know that or not,' she told WAVY.

A 16-year-old girl is appealing a child porn conviction she was given for sending a video of herself having sex to her friends.
The girl, identified only as ‘SK’ by court documents because she is a minor, sent the video to two friends in October 2016.
According to court documents , the three friends, identified as KS and AT, would ‘regularly exchange “silly” videos and attempted to “outdo” one another.’
After the three friends had a falling out, AT and KS showed the video to an officer at the Charles County Sheriff’s Office.
Only SK faces charges related to the video even though one of her friends reportedly shared the video while they were in school, prosecutors said.
Once the video got out, SK did not attend school for a month, according to court records.
She recently appealed the charge after the Special Court of Appeals upheld her child pornography conviction, ruling that it is not illegal for a 16-year-old to engage in sex, but it is illegal for them to send a video of the act.
The court wrote: ‘The First Amendment to the United States Constitution did not protect conduct of a minor who distributed a digital video file of herself engaged as a subject in consensual sexual conduct.’
SK’s lawyer, Claudia Cortese, argued that the law, which is intended to protect children, is being used to harm her client, who was put on probation and referred for a mental health evaluation.
The prosecutor said the court was not ‘trying to prove a point in going forward with this case,’ but ‘the state believes that the respondent is in need of some guidance, rehabilitation for something deeper (and) is just trying to help her.’
Because she is a minor, the teen has not faced a mandatory sentence or the possibility of registering a sex offender.
Assistant Attorney General Sarah Pritzlaff said: ‘When you create a digital image, a depiction like this, it is a permanent record. These images are getting out. It’s not at all surprising in this case that there was a falling out among friends and this video got out and was all over school.’
The Maryland Court of Appeals is expected to deliver a ruling on SK’s case later this year.
