Deepfake technology is allowing bad actors to turn private images into pornographic content. Laws must change to tackle this worrying new trend
In 2016, a friend alerted fitness instructor Maiken Brustad to a forum on the digital distribution platform Discord. There, someone had posted some of Brustad’s most intimate pictures. The photos, which she had taken for her fiancé, had been stolen from her iCloud and distributed on the internet. This is where her nightmare started.
Brustad did not receive proper support from the authorities either in London – where she had just moved at the time of the incident – or in Norway, where she is from originally. After the photos appeared online, she received countless anonymous messages frightening, threatening and misleading her. Her name and details were also posted alongside nude photos of other women.
Eventually one of her photos was made into a deepfake and used in pornographic content. It then spread around the internet. 
Deepfake is a relatively new technology that enables the layering or photoshopping of one person’s likeness, or face, to a real or a synthetically created body with artificial intelligence (AI). With deepfake technology, a few pictures from Instagram or even private images can be turned into pornographic content – as happened to Brustad, and other women, such as the British poet Helen Mort. Last year, Mort found hardcore pornographic videos merged with her picture in dark corners of the internet.
“I’ve never shared intimate photos. But I recently found out that, since 2017, someone has been taking images of me from private social media and other sources and uploading them to a porn site, using my first name, inviting other users to photoshop my face onto explicit and violent sexual images,” Mort writes on petition platform Change.org . Mort’s petition aims to tighten regulations on revenge porn to include deepfake pornographic imagery. Since December 2020, she has collected more than 6,000 signatures. 
According to Sensity AI , an organisation monitoring artificial intelligence, the number of deepfakes on the internet has doubled every six months since 2018. More than 85,000 deepfake videos were in circulation by December 2020. 
Some of these deepfake videos appear on TikTok, such as the infamous fake Tom Cruise videos , which first circulated in February 2021. The Deep Tom Cruise TikTok account now has 1.4m followers and the original video, which shows the fake Cruise playing golf, has been viewed over 14m times. Others are distributed on platforms such as YouTube, including Channel 4’s Deepfake Queen video, which aired over Christmas to raise awareness around deepfakes. But the majority of these videos are found on sketchier websites. According to Sensity AI, up to 95 per cent of deepfakes that are distributed are pornographic, and 90 per cent of these contain nonconsensual erotic imagery of women.
“Revenge porn or the threat thereof has been used to silence women or as a tool of domestic violence,” says Agnes Venema, a legal scholar pursuing her PhD in intelligence and national security at the University of Malta. “And I think it ‘works better’ on women because it’s considered more scandalous than if it happened to men. They’re probably judged more.”
Venema, who recently addressed the New Zealand parliament about introducing new legislation to tackle deepfakes, highlights the need for such legislative change. “Because it’s digital and online, there are considerations to make this image-based sexual abuse a crime, but there are hardly any statutes,” she explains. “It’s this creature that nobody understands because there’s just a complete lack of awareness.”  
New Zealand is not the only country considering laws against deepfakes. The Law Commission of England and Wales recently published a report on deepfakes, which proposed expanding existing criminal laws on the non-consensual taking and sharing intimate images to include “altered intimate images, such as deepfakes”. The report is currently under review by the commission, following a public consultation.
According to English law, the definition of an “intimate image” does not currently cover images that are explicit just because they have been doctored or combined with another image, explains Aislinn O’Connell, a lecturer in law at the Royal Holloway University of London.
“The criminal offence needs to be changed so that it covers faked images,” she says. “And there also needs to be a legal mechanism which allows people to force the websites to take down images.” 
O’Connell recommends introducing image rights that would enable people to legally object to the publication of images of themselves. She also points out that police in the UK currently investigate revenge porn only if the identity of the perpetrator is proven, and if it’s clear that their motivation was to cause harm to the victim.
“Besides the law, there needs to be a massive shift in society’s attitude. It’s important we start very young with education, undoing the misogynistic and patriarchal attitudes which seemingly entitle people to women’s bodies,” O’Connell says.
New laws will be needed as these technologies become more widely accessible in the future. At the moment, says O’Connell, the creation of a realistic deepfake picture requires “a fair amount of computing power and relatively good artificial intelligence”. However, “plausible deepfakes” can be created with only a couple of photos of a person’s face.
“Deepfake images are easier than deepfake videos, for which the AI needs to map facial expressions,” explains O’Connell. “But there may be engines out there that, with two or th
