VIDEO of three correctional services guards grabbing a 13-year-old boy by the neck and forcibly stripping him is appalling, the Northern Territory Children’s Commissioner said.
ABC broadcast the 2010 footage this week after a Supreme Court justice upheld a prior ruling that the guards did not use unreasonable or excessive force.
It shows three guards entering a small cell in Alice Springs, taking the child by the neck and turning his head away before dropping him facedown onto a mattress.
The guard pins him by the head as another guard pulls off his shorts and underpants, then holds him down with his knees across his naked buttocks.
Afterwards the boy is seen stalking around the cell and throwing his torn-up mattress at the CCTV camera in visible distress. The boy had been classed as at-risk and needed to be dressed in a non-rip gown, Justice Peter Barr ruled, and was apparently a known “spitter”.
Restraint is only ever used as a last resort in situations where there is a threat to an inmate or staff, said Corrections Minister Robyn Lambley.
But at that point he was not a threat to anyone, said NT Children’s Commissioner Dr Howard Bath.
“Violently grabbing and putting the kid down with knees and hands around the neck and on the buttock, stripping him naked, is hardly a therapeutic response; it’s likely to harm the child,” he told AAP on Friday.
The action appeared designed to humiliate the boy, and was “appalling practice”, he said.
Justice Barr said the force used did not appear to be excessive, describing the actions as low-level physical violence.
The video only shows a small portion of the incident excluding the threats to self-harm and violence the boy displayed before the incident, said Minister Lambley,
“The youth detainee featured in the vision has been found guilty of more than 50 criminal offences, many of which were violent acts, over the past five years,” she said.

A 13-YEAR-OLD boy was caught performing a sex act on a crying boy, 14, and raped an 11-year-old in an alley.
The boy pleaded guilty to one charge against the 14-year-old boy, and three charges against the 11-year-old girl. All the offences took place in Dorset.
At a youth court in Poole, a judge heard how the boy's mother reported her own son to police after she caught him in the act with the schoolboy.
An 11-year-old girl later told her mum that the boy had raped her at his home, and two more times in an alley near the property, the Bournemouth Echo reports.
The court heard that the boy was friends with his two victims. None of those involved in the case can be named for legal reasons.
The 14-year-old boy's mum, in a victim impact statement read to the court, said: "Since the incident his behaviour has changed drastically at home and at school.
"He has been running up and down the stairs screaming in the night. He is having counselling at school for anger and emotions.
"He always appears to be on edge. He [the 13-year-old boy] has ruined the life of my son."
The 11-year-old girl's mum said in her statement: "She became very violent and angry which is something that she was not before.
"Her school work has been affected and she refuses to do science where they discuss parts of the body because she is embarrassed.
"She is receiving support and counselling."
District Judge Stephen Nicholls told the boy after his guilty pleas: "If you had been an adult and pleaded guilty to those matters the sentence would have been measured in many years of imprisonment.
"Please take this opportunity to work with the Youth Offending Team."
The boy was given a 12-month referral order to a Youth Offending Team.

New search has found that lesbian, gay and bisexual young people are four times more likely to self-harm than their straight peers. (Pexels)
A 13-year-old boy on Grindr was raped or sexually abused by at least 21 men, according to an investigation by The Sunday Times .
The national newspaper revealed that detectives have investigated over 30 cases of child rape in the UK since 2015 , where the underage victims were first contacted on dating apps like Tinder and Grindr.
The 13-year-old boy from Yorkshire was reportedly contacted by men on dating apps he had signed up to, including Grindr and Badoo.
The Sunday Times also found that there 60 further cases of child sex offences using online dating services, including violent sexual assault, kidnapping and grooming, according to police documents seen by the paper following Freedom of Information (FOI) requests.
In one incident, an eight-year-child from Lincolnshire sent photos of a “sexual nature” to a paedophile and had a “sexual conversation” with him after being groomed on an unnamed dating app, reports the newspaper.
The paper received FOI responses from 10 out of the UK’s 46 police forces.
A Grindr spokesperson told PinkNews that it is “saddened” by The Sunday Times’ investigation and that the dating app was taking steps to remove underage users.
“Grindr is committed to creating a safe and secure environment to help our community connect and thrive, and any account of sexual abuse or other illegal behaviour is troubling to us as well as a clear violation of our terms of service,” the spokesperson said.
“We encourage users to report improper or illegal behaviour either within the app or directly via email to legal@grindr.com.
“In addition, our team is constantly working to improve our digital and human screening tools to prevent and remove improper underage use of our app.”
Responding to The Sunday Times ‘ investigation, culture secretary Jeremy Wright said the findings were “truly shocking” and provided “yet more evidence that online tech firms must do more to protect children.”
He told the paper that the government would consider new legislation requiring porn to use age verification technology to stop those below 18 from using dating apps from April.
“I will be writing to these companies asking what measures they have in place to keep children safe from harm, including verifying their age,” Wright told The Sunday Times.
“If I’m not satisfied with their response, I reserve the right to take further action.”

Both Tinder and Grindr have a minimum age policy of 18.
However, some users have reported being able to sign up to Tinder and Grindr, despite being underage.
There have been previous reports of underage boys being abused on Grindr.
In October, it was reported that a man from Sydney, Australia, was bailed for the alleged rape of a 13-year-old boy he met on Grindr.
