Польский проездной документ (Polski Dokument podróży). Часть 1.

В связи с тем, что белорусы больше не могут обменять или продлить паспорт за границей, возник вопрос, как быть тем, у кого уже истёк срок действия паспорта, но по каким-либо причинам поездка в Беларусь не является приемлемым вариантом решения проблемы.

Данная статья касается решения вопроса с помощью польского проездного документа, выдаваемого иностранцам, которые по каким-либо причинам не могут получить новый паспорт в консульствах своих стран. На данный момент упрощённое получение польского проездного документа для белорусов продлено до 31 декабря 2025 года.

Несмотря на то что истории, в которых путешественники получили отказ от посадки на борт, связаны с путешествием в страны, не входящие в Шенгенскую зону (перелёт в Черногорию, Грузию и Турцию), с целью уменьшения риска я решил задать вопрос Консульствам о признании документа европейскими странами, как входящими, так и не входящими в Шенгенскую зону, а также перевозчикам (Ryanair, Wizz Air). Ниже будет прикреплена переписка.

❗️В связи с новостью от 27 мая 2024 года рекомендую, в дополнение к ответам посольств принимающих стран и авиаперевозчиков, иметь распечатанное разъяснение Министерства внутренних дел, а также ссылаться на ст.253 польского Закона «Об иностранцах», а именно:

Art. 253.
1. Polski dokument podróży dla cudzoziemca w okresie swojej ważności uprawnia cudzoziemca do wielokrotnego przekraczania granicy.
2. Polski dokument podróży dla cudzoziemca jest ważny przez okres jednego roku od dnia jego wydania.

В личном кабинете Ryanair есть раздел Travel Documents, где можно прикрепить документ для онлайн-регистрации. Проблема в том, что в выпадающем меню доступен только вариант "Passport". Вопрос о прикреплении проездного документа я задал в Support-чате и получил ответ, что можно прикрепить полученный проездной документ как паспорт.

Я: My passport expired in April 2023. Despite being prolonged, it is more than 10 years old and is not valid for travelling. I created a Polish travel document (the document issued by the government), that allows me to travel over the world, can I specify it in the Travel documents section? I see there is a 'Passport' option only. Also, I have a Residence Permit card that allows me to travel without a visa.
The point is that this document is absolutely legal and I am going to travel with it, but I do not know if I can add it to the Travel Documents section to make check-in in advance.
Support: Did you tried to add the document details as passport?

Данным авиаперевозчиком я ранее не пользовался, хотел уточнить, годится ли польский проездной документ для покупки билета и онлайн-регистрации. После моего вопроса о признании польского проездного документа агент сослался на то, что решение принимают работники аэропорта + порекомендовал обратиться в посольства принимающих стран (что я и сделал). Возможно, стоило перефразировать, но агент сразу же отключился, а пробиваться через бота во второй раз у меня не хватило терпения.

Спустя некоторое время со мной связались из Wizz Air и спросили, всё ли понятно по информации от агента. Я уточнил свой вопрос и получил ответ, что это вне их компетенции.

In response to your e-mail inquiry of January 31, 2024, I would like to inform you that in accordance with the applicable legal status, in the case described by you - as the holder of a valid Polish travel document for a foreigner - you may - during the validity period of this document - cross the border multiple times /vide Art. 253 section 1 of the Act of December 12, 2013 on Foreigners (consolidated text: Journal of Laws of 2023, item 519, as amended)/.
When traveling to other EU/EEA/CH member states fully applying the Schengen acquis (i.e. other Schengen Area countries), you should also have a valid Polish residence card issued to you.

После этого я сделал аналогичный запрос в Румынскую Пограничную службу и получил следующий ответ (перевод на русский с румынского):

В соответствии с положениями Приказа Министра иностранных дел № 1124/2015 о списке документов для пересечения границы, принятых румынским государством, с последующими изменениями и дополнениями, приложенный к вашей петиции документ признается документом для путешествий на уровне румынского государства. Кроме того, начиная с 31 марта 2024 года, Румыния полностью применяет положения Шенгенского законодательства в соответствии с положениями Решения (ЕС) 2024/210 Совета от 30 декабря 2023 года о полном применении положений Шенгенского законодательства в Республике Болгария и Румынии. <...> В этом контексте, в соответствии с положениями ст. 21 пункт (1) Конвенции о применении Шенгенского соглашения, иностранцы, имеющие разрешение на проживание, выданное государством Шенгена, могут свободно передвигаться, не более 90 дней в течение 180 дней, по территориям других государств Шенгена, включая Румынию, на основании этого разрешения и действительного документа для путешествий. Наконец, отмечаем, что проверки выполнения условий въезда в страну проводятся персоналом Румынской пограничной полиции, присутствующим в пунктах пересечения границы.

После этого я сделал аналогичный запрос в Департамент полиции и погранохраны и получил следующий ответ:

Dear Sir/Madam
You can travel to Estonia with a Polish temporary travel document and residence permit card.
Although travel documents are not checked at internal Schengen borders, it is still necessary to carry a travel document when crossing internal Schengen borders. Competent authorities like police or immigration officials of relevant Schengen State have the right to check travel documents if needed.
