No Way Out Ch. 01

Part 1 - Prologue

Friday, January 17th. The schoolchildren of Eastside Elementary were getting a special treat. Carole Troy's second-grade classmate Jameis's grandfather was the owner and operator of a metal scrapyard on the southside of Town, along Depot Street west of Junction Station, and he had invited the kids to visit. He'd also done this for other elementary schools in the past.

The property was bordered on the south and west by farm fields. Among the equipment was a conveyor line that took scrap metal to the crusher. The crusher was composed of massive gears that interlocked and ground together, large ones on top that tore apart anything dropped in, and smaller ones beneath that cut the metal (or rock) to a smaller, finer grade. The powerful motors were capable of crushing cars and sheets of metal into small strips that would later be compressed into blocks for sale.

There was a 'control tower' that oversaw the operations, and on the floor below it was a room with windows that allowed the students to watch. There was a catwalk over the grinders, but no one was allowed on it while the machinery was operating, due to the exceptional danger of certain death if one fell into the gears.

*WHIRRRRRRRR!*

The powerful motors started up, and the gears began rotating. Even inside, the noise was very loud, and outside it was such that the business was prohibited from operation before 8:00am and after 4:00pm weekdays.

The conveyor belt began bringing large pieces of metal up, including an 55-gallon drum, a car door, and other large metal pieces. They dropped into the bin.

*GRIND!* *GRIND!* *GRIND!*

The pieces of metal bounced around then were caught up in the gears and driven down between them. The kids would later be shown the end result, a railroad car full of small pieces of metal.

"Wow!" Carole Troy said as they watched. "Your grandfather has some cool stuff, Jameis!"

"Yeah!" said Jameis. "It's fun watching cars get crushed and ground up!"

Other kids agreed, and they excitedly cheered as they watched the powerful machine destroy seeming indestructible objects... except Shawn Redmond. He was standing apart from the others and not near the window, totally disinterested in what was going on.

And Carole's father and even her brother Jim were interested as she recounted what she'd seen at dinner that evening...

Saturday, January 17th. The trains of Troy Transcontinental Railroad thundered along the tracks through the great Lego City. The Amtrak train was steered to the side track and the station, which was a Lego replica of the old Harvey Houses that once dotted the landscape of the Old West. Attached to the end of the Amtrak was the brown and beige private railcar that Ian and I had taken hours to make and paint. (Author's note: 'Homewrecker', Ch. 04.)

"Dad," asked Ian as he watched the trains, "can we build another private car for the Amtrak?"

"Sure." I said. "Maybe one like President Roosevelt took when he went to Warm Springs, Georgia and the Little White House."

"Yeah!" said Ian. "That'll be awesome!" My four-year-old son looked very happy at that. Buddy, who was supervising, did not let Ian's excitement interrupt his hard-earned nap...

Sunday, January 18th.

"I'm a real man, too." said Halsey. "And if you want a baby, just say so, and I'll leave the rubber in it's wrapper and fill you up with my seed."

"Nooooooo, thank you." said Isley. Halsey was sure full of himself, she thought to herself. As if she'd ever take him to stud, when there were plenty of other, better men around. Like Todd Burke's brother, and that Jenkins guy that was in Southport now. Yeah, Tim Jenkins knows how to throw a fuck into a woman. I wonder if the Iron Crowbar is as good as he is..."

"All right, let's go." said Isley. "It's going to be a big week."

"It sure is." Halsey said enthusiastically. "I can hardly wait!" Isley surreptitiously peered over at Halsey, concerned about his bright-eyed overeagerness, feeling a little bit disturbed. But she needed him for this operation...

Part 2 - Case of the Missing Reporters

"This is Bettina Wurtzburg, KXTC Channel Two News!" shouted the redheaded MILF reporterette at 7:00am, Monday, January 20th, from in front of the Courthouse Complex. "Channel Two News has learned that several Members of the Town & County Council have brought a lawsuit against the Town & County Police Department!"

Bettina began: "Council Members Kelly Carnes, Malinda Adams, Reginald B.F. Lewis, Sheila Sorrells, and Susan Weston filed the complaint, which stated that the Town & County Police Department illegally promoted Officers to new positions, including that of Lieutenant Micah Rudistan to Vice Lieutenant, without Council approval. Judge Harry R. Nance accepted the lawsuit and issued an injunction, disallowing the Police Force from implementing the moves."

Bettina: "However, City Attorney Dennis Garland, after refusing to file the original complaint on behalf of the Council, did file a counter-complaint and appeal with Judge Patrick R. Folsom on behalf of the TCPD. Judge Folsom immediately overturned Judge Nance's ruling. The Police complaint also includes a formal complaint to the State Supreme Court, the State Bar, and the State Legislature against Judge Nance for egregious political bias and refusing to consider the facts and the law in the case."

Bettina: "Appellate Court Leahy immediately reversed Folsom's reversal, and re-implemented Judge Nance's stay of the Police actions, and the case has been appealed to the State Supreme Court. Reaction on both sides was bitter and angry. Roll tape."

Tape rolled. First was shown Kelly Carnes, screaming furiously at the microphone: "The Council has filed this lawsuit because of the abuse of power of Commander Donald Troy in making Police promotions without getting the approval of the Council as required. Not only will we stop these illegal acts, it is long past time that Commander Donald Troy be fired for his willful ignorance of the law!"

More Carnes: "And City Attorney Dennis Garland works for the Council first, not the Police! We will be moving to fire Garland and bring charges against him for his refusal to file our lawsuit and represent us in Court!"

Then Mayor Daniel Allgood was shown, saying angrily: "Only promotions to Lieutenant and above go to the Council, and there were no promotions, only lateral moves that do not require Council approval. Furthermore, it was not the Council that brought the lawsuit, which is why City Attorney Garland did the right thing in refusing to file it! It was only the Democrats on the Council that filed the suit, and they did so as individuals, not as the Council itself!"

Back to Bettina live: "And in Midtown, there is growing bipartisan support to impeach deeply unpopular Governor Val Jared in the State House. State Representative Lamar Linder of Hamilton County announced that he will vote to impeach Jared..."

"I think I might need to hold another Press Conference." I said as we drank coffee in the Chief's Conference Room. " Commander Ross, would you ask Damien Thompson to call a 9:00am Press Conference?"

"Hoo boy." groaned the Chief. The Sheriff caught my eye before I could turn to respond to the Chief, and I saw his barely shake his head at me. Ergo, I said nothing.

"What have you spiked your coffee with this morning?" Cindy said to me, perhaps meaning it as a joke. My glare at her was her first clue that I was not amused.

"Press Conference?" I said. "Please?"

"Okay, okay." Cindy said resignedly.

"All that aside," said the Chief, "we will have to comply with the stay until it's sorted out. Soooo, Captain Perlman, you'll have to tell Mr. Roooodistan that it's been fun having him here with us, but he'll have to show his smiling face at 2nd Precinct for the next few days. And Commander Croyle, tell Lieutenant DeLong he will have to sit in 1st Precinct for a few days."

"What about Sergeant McGhillie, sir?" asked Teresa Croyle.

"I'm leeeeeving him at 1st Precinct." said the Chief. "Since he's a Sergeant, not a Lieutenant, we will make a show of our independence on that point." We all nodded, then the Chief said "Of course, they have phones and they have pens, so they can uuuuuse them to continue their new dooo-tiesss from a-farrrrrr.."

Teresa said, perhaps as an understated joke on her part: "Is this Reginald B.F. Lewis's way of getting the Detectives dispersed to the Precincts?"

"No." I said coldly. "This is much worse. This is Democrat Members of the Council trying to subvert the new Charter. Democrats will do anything to subvert the Charter, and the Constitution nationally, to gain and keep raw political power. Anything. And we'd better fight them with everything we've got or they will run roughshod over us."

"C'mon, it's just politics." Cindy said. "They're just messing with us. It's a game with them."

My gray eyes flashed cold fire at Cindy, and I had had enough. I said "Excuse me, Chief.", got up, and walked out, leaving the others in an embarrassed, awkward silence.

At 9:00am, I went to the Press Room. Captain Thompson met me at the door. "Sir," he said, his voice almost a whisper, "I called the Presser, but there's almost no one here."

"No one? At all?" I asked stunned. I peeked into the room. There were three reporters, all 'cubs', as well as Alison McFarland of the Town & County Examiner. and another woman that looked familiar to me.

"Most of them are in Midtown, sir, since the Legislature is in session." said Captain Thompson. "But I don't understand why KFXU didn't send anyone."

"Okay, then." I said. "Let me go do this. Record it, so we can put it out there ourselves."

I went up to the podium without ceremony and said "Thank you for coming. I have a statement to make regarding the lawsuit against the Town & County Police. As you know, I was part of the Charter Commission that wrote the Charter that is currently the cornerstone of the law in this County. As such, I am very well aware of what the Charter and current law says."

I continued: "The recent moves by the TCPD were not promotions. Two Lieutenants were moved laterally, which does not require Council advice nor consent. Additionally, a Senior Sergeant was laterally moved, and no actions regarding Officers below the rank of Lieutenant require any Council action... and that should not be construed as an inference that lateral Lieutenant moves do require Council action. Ergo, the lawsuit by some individuals is without merit."

I went on: "Furthermore to this subject, City Attorney Garland is prohibited from rendering 'personal services' for Town & County employees. Only Government institutions can be represented by him. This lawsuit was not filed by the Town & County Council, but by individuals. As such, City Attorney Garland was correct in refusing to comply with Kelly Carnes's illegal order to file that lawsuit. He obeyed the law, and Kelly Carnes's threats against him are intimidation and possibly illegal in themselves. What are your questions with regard to my statement or this issue?"

There were none.

Alison McFarland was escorted to my office with the woman that had been with her in the Press Room. "Hi, Don." Alison said. "Have you met Lisa Fillmore?"

"I remember her." I said, shaking Lisa's hand. "You were treated very badly on the 'Point Taken' show." (Author's note: 'Summer in the County', Ch. 01.). Lisa Fillmore was short and slender, what one might call 'slight', which was typical of television personalities. She had dirty blonde hair, and a cute face.

"Good enough." I said.

Alison said "And the Examiner has been doing very well, so I hired Lisa as a reporter. Don't hold it against her."

"If she keeps standing up to the slugs, I won't." I replied. "Well, let's talk off the record for a moment, if we may?" The women nodded, and I said "Why did no one show up for my Press conference? I know I shouldn't complain, but..." I let the sentence hang.

Lisa said "We were shocked, too. Keith Madden is in Midtown, covering the Legislature, and just about everyone who is anyone in the Media is down there. Priya and Catrina Pierce are down there, but Bettina and Meredith Peller, are still up here. So I don't understand it."

"Don, let me ask you this," said Alison, "and I'll keep it off the record. Do you have any problems with the Feds right now? The FBI, or anyone?"

I felt a sense of foreboding as I peered at Alison and said "I'm not sure. We just solved a murder case that didn't make the DEA look very good. And the US DOJ's Civil Rights Division is trying to intimidate us, but that's not new. Why? Anything you've heard?"

Alison nodded. "Yes. Since we've reconciled, my dad and I talk once a week, on Saturday or Sunday. This past week, my dad said to watch out, that something was going on in this State, and Federal Agents were seen talking to Federal Judge Ruth B. Taney and U.S. Attorney Richard Baldwin. And Tim Geiger and I both heard that something's going on with KXTC, especially now that they've gotten Amber Harris out of jail..."

With slight modifications, I sent my statement as a 'Friend of the Court' brief to City Attorney Garland, Mayor Allgood, Judge Folsom, Judge Watts, Appellate Judge Leahy, and the State Supreme Court... as the Chairman of the Charter Commission and primary author of the current Charter.

Part 3 - It Begins

2:30pm, Monday, January 20th.

*Whirrrrrrrrrrr*

A tornado drove into my office in the form of Tanya Perlman in her wheelchair, and stopped on the dime I'd glued to the floor. "Good news, sir." she announced. "One of the State Supreme Court Justices rescinded Nance's stay of our personnel actions last night. The lawsuit is not dismissed, at least not yet, but we can go ahead with the changes. I've already told Commander Croyle, Rudistan, and DeLong."

"Good. Thanks." I said, sounding absentminded. Tanya took off her badge, held it up, and put it on my desk. I nodded, did likewise, and activated the ink pen bug killer.

"Don," Tanya said, "between you and me, what's going on? Especially with you and Cindy?" When I hesitated to answer, she said "Don, you walked out on the Chief and the Sheriff this morning. You made a blatantly political statement, and Cindy's comment in reply was pretty benign. If you don't want to talk about it, okay, but I'm a good enough Detective to see that you're really stressed out. I just want you to know that I'm here, and I want to help you any way I can."

"Thanks." I said quietly. "But no, it's best I don't talk about it."

"Don, let's cut to the chase, here." Tanya said. "You and Cindy have always been tight. More than family, more than Police partners. You're Crowbar 1 and Crowbar 2, and there are no others. Sure you've had back-and-forth, but it's always been friendly. We know you love each other unto Death itself. But now... we can tell there's a serious problem between you two. And frankly... it scares me to death."

"And it should." I said. "Let me ask you this, and I have a reason for asking: has Jack said anything to you about any... stuff... that might be going on?"
