Welcome to Midnight AI ("Service", "Platform", "we", "us", "our"). By accessing or using our Telegram bot and Web Application, you agree to be bound by these Terms of Service and Privacy Policy ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Age Restriction & Eligibility

1.1. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to access or use Midnight AI. 1.2. By using the Service, you represent and warrant that you meet this age requirement. If we discover that you are under 18, your access will be terminated immediately.

2. Fictional Nature of Content

2.1. 100% Fictional: All characters, personalities, scenarios, texts, and images generated within Midnight AI are entirely fictional and created by Artificial Intelligence. 2.2. No Real People: Any resemblance to actual persons, living or dead, or actual events is purely coincidental. 2.3. Age of Characters: All AI-generated characters depicted in the Service are expressly portrayed as being 18 years of age or older.

3. User Conduct & Zero-Tolerance Policy

3.1. You are solely responsible for the prompts, texts, and interactions you input into the Service. 3.2. Zero-Tolerance: We maintain a strict zero-tolerance policy against illegal content. You are strictly prohibited from using the AI to generate, request, or promote:

• Child Sexual Abuse Material (CSAM) or any exploitation of minors.
• Non-consensual intimate imagery (deepfakes) of real, identifiable people.
• Content promoting terrorism, violence, self-harm, or illegal acts. 3.3. Violation of these rules will result in immediate permanent account suspension and, if required by law, reporting to relevant law enforcement authorities.

4. Payments & No Refund Policy

4.1. Midnight AI offers virtual items and virtual currency (e.g., "Gems", "Energy", "Stars") for purchase via Telegram Stars or cryptocurrency. 4.2. Final Sale: All purchases of virtual currency and digital items are final. Once virtual goods are credited to your account, they cannot be exchanged for real money, refunded, or transferred. 4.3. No Refunds: We do not offer refunds for unused virtual currency, accidental purchases, or if your account gets banned for violating these Terms.

5. Disclaimer of Warranties ("AS IS")

5.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. 5.2. Because content is generated by AI algorithms, we do not guarantee the accuracy, reliability, or appropriateness of the output. The AI may occasionally produce unpredictable, inaccurate, or offensive content. You consume this content at your own risk.

6. Limitation of Liability

6.1. To the maximum extent permitted by law, Midnight AI, its developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, the Service. 6.2. We are not responsible for any emotional, psychological, or legal consequences arising from your interactions with the AI.

7. Privacy Policy & Data Handling

7.1. What we collect: To provide the Service, we collect your Telegram ID, Telegram Username, and your chat history within the bot. 7.2. How we use it: Chat histories are temporarily processed to provide context for the AI models to generate accurate responses and images. 7.3. Data Sharing: We do not sell or rent your personal data to third parties. Data is only processed through our secured AI provider APIs (e.g., OpenRouter, Civitai) strictly for generating your requested content. 7.4. By using the Service, you consent to the processing of your data as described.

8. Changes to the Terms

8.1. We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Service constitutes acceptance of the updated Terms.
