Who hasn’t heard about this yet? Max Hardcore, a pornographer known for very violent degrading porn just got sentenced to more than three years in prison for obscenity. 
I’m sure a lot of you are cheering. I think that’s sad.
There are problems with Max Hardcore, and I’ll get to those in a second. But the charges that got him thrown in jail are bullshit. I’m not saying this just because I believe in free speech, although that’s a lot of it. I don’t think there’s anything wrong with his videos. 
No one can control what turns them on. You can’t analyze sexual desire away. You can make an effort to figure out where it comes from, but at the end of the day you’re still going to want what you want. There are a whole lot of inconvenient kinks out there — kinks that scare potential partners away, kinks that can get dangerous, kinks that are so weird they’re humiliating to discuss — and if it were possible to make them evaporate, people would. 
And so instead those of us afflicted with kink find a way to achieve sexual satisfaction. We get doms to slap us around and subs to slap around.We establish safewords and boundaries. We buy handcuffs and real dolls and Nazi costumes. We masturbate a lot.
There is nothing wrong with any of this. I am not a bad person because violent degrading porn turns me on. And the guy who jerks off to the same violent degrading porn that makes me wet isn’t a bad person either. And the guy who makes the violent degrading porn with consenting actresses isn’t necessarily a bad person either.
I read this post a few days ago and it made me depressed. Even in a progressive community people worry that having the wrong kind of sex with a consenting partner is something to feel guilty about. That’s not okay and it’s certainly not something we as feminists should encourage. 
All of this is why I’m standing up for Max Hardcore and all the other violent degrading porn out there. Because yeah, your first instinct may be that it’s sick and wrong, but your first instinct isn’t always right. It’s easy to dismiss what you don’t understand.
And here’s the thing: I hate standing up for Max Hardcore, because Max Hardcore is an asshole.
Here’s the rotten.com article on him. Scroll down to the second picture and right next to it is a description of an outtake that features him treating an actress like shit. This article at the F-Word talks about a documentary in which Max Hardcore abuses a different actress.
This should be prosecuted. This is worth worrying about. This is something no one should be allowed to get away with. But no one cares because they’re just sex workers.
The obscenity charges don’t take into account whether or not the actresses were consenting or treated fairly. It’s just assumed that they are. Because it’s more important to send someone to jail for making a video of the kind of sex not everyone approves of than it is to protect women. (And of course the women are porn stars, so it’s not like they’re real women.)
The obscenity charges are still stupid. Of course, the fact that he hasn’t been charged for the way he treats his actresses is stupid and dangerous.
In this society sexphobia is more important than women. That’s disturbing.

The squeamish reactions of jurors to only 40 minutes of "gonzo" porn have persuaded a Florida judge to reconsider her decision to have them watch 8-1/2 hours of it in the obscenity trial of producer Paul Little, aka Max Hardcore (left).
"Jurors squirmed in their seats, squinted their eyes and frequently looked away" while viewing just one of the gonzo videos that prosecutors intend to use as evidence against Little, the St. Petersburg Times reported. The videos feature scenes of Little, who stars in and directs his movies, inflicting pain and humiliation on female actresses.
Prosecutors originally planned to show jurors some 2-1/2 hours of segments produced by Little, but U.S. District Judge Susan C. Bucklew agreed with the defense that, in order to decide whether the films are obscene, jurors should see them in their entirety. After the brief initial viewing, Bucklew reconsidered. "I think it will be very difficult for this jury to sit through five of these," she said.

In a rare obscenity prosecution, the Justice Department has charged Little with five counts of using a computer server to sell obscene matter and five of delivering obscene matter through the U.S. mail. Little insists his films are protected by the First Amendment.
UPDATED: Judge Bucklew has decided to let the prosecution and defense screen as much or as little of the videos as they deem necessary. Just after she ruled, a male juror sent her a note asking, “Your honor, would it be at all possible for clips to be shown to the jury instead of the movie in its entirety?”

If you don't recognize the name, you may recognize his nom de porn: Max Hardcore. For years, Hardcore was considered one of, if not the, most extreme adult movie directors in the business. Starring Hardcore in a cowboy hat and a shit-eating grin, his formulaic movies focused on the systematic degradation of his female costar of the moment who was not infrequently dressed up to resemble a child: wearing pigtails, discovered on a playground, sucking on a lollipop. The sex scenes took place on what would become an iconic yellow sofa, where speculums were introduced, Hardcore's verbal onslaughts commenced, and the young women were turned into wild-eyed, dazed zombies by the finale.
Years ago, I encountered Hardcore at a loft party in downtown Los Angeles, but for the most part, over the years I wrote about the adult movie industry, I stayed away from him. In an over-the-top, surreal world, Hardcore seemed almost too much, unable to discern between his on-camera persona and whatever real person he actually was.
Of course, even in the wild, wild world of porn, if you play with fire enough times, you're bound to get burned, and in 2008, in Tampa, Florida, Little was found guilty of distributing obscene material over the internet and through the US mail and sentenced to 46 months in prison. At the time, most journalists and bloggers saw Little as a victim -- a man whose freedom of pornographic expression had been labeled criminal by the US government. In response, I wrote a post about the very hardcore realities of a Hardcore movie. [Warning: This post contains graphic language.]
In January of 2009, Hardcore surrendered to US marshals. Turning to the reporters who were following this spectacle, he pronounced:
"I'm disappointed that they found me guilty down there. But I respect it. I'm here to turn myself in and as a lover of freedom, I'm not too happy about that, but that's the way it is and, well, I'll see you guys later."
Eventually, he ended up at La Tuna Federal Correctional Institution in Anthony, Texas. Occasionally, I thought about writing him a letter asking if he'd let me interview him if I made the trip to Anthony, but I never did. I wondered if it was wrong that a man was imprisoned for making adult movies featuring consenting adults, or if Little was somebody who pushed the envelope one too many times and had to deal with the consequences.
Last year, I received an email from a journalist who was working on a story about Little. He was interested in interviewing me for the story because he had gone to see Little in prison. Apparently, Little had gone on a rant about a journalist who had written something about him, something that had enraged him. As it turned out, that story was mine, the aforementioned post on my blog, which, I assumed, he had read before he had gone to prison. Somehow, I had come to symbolize for Little all that he hated: the person who would not give him a pass to let him do whatever he wanted, no matter the cost.
Then, yesterday, I got the tweet that Little had been released. For months, I'd heard rumors he was out already. I called the Bureau of Prison's Public Information Office, where a man confirmed, yes, Little had been released from La Tuna in January to a halfway house in Long Beach, California. As of July 19, he was a free man. I asked the man if Little had been a good prisoner, but the man was unable to say. For the next 36 months, Little will be under court-ordered supervision, although the man would not say what the details of Little's parole are.
Once upon a time, pornographers were king. Today, the business is dying . As for obscenity, its definition remains as elusive as the day in 1964 when Supreme Court Justice Potter Stewart famously opined: " I know it when I see it ."
