THIS is the moment a man is shot dead at point blank range by a neighbour in a row over a dumped mattress. 
The killing in Texas was filmed by the dead man’s fiancee and shows a dispute with father and son neighbours turn deadly.
John Miller, 67, and 31-year-old Michael Miller were arrested on murder charges over the death of 37-year-old Aaron Howard, who lived next door.
They have both been freed on $25,000 (£18,000) bond.
Police said the row was over where to leave a mattress in a shared alleyway for collection by binmen.
The footage, which was released by grieving Katie Box today, graphically shows the killing on September 1.
The Miller son and dad can be seen standing topless and armed with guns.
Miss Box said she and her partner had left the mattress in a dumpster but that the Millers had taken it out and thrown it back onto their property in the town Abilene, which lies 150 miles west of Fort Worth.
Angry at this, Mr Howard then confronted his neighbours in the back street of their houses while his partner filmed the row on her phone.
The dad can been seen with a pistol in his right hand while the son, standing just a few feet behind him, is gripping a shotgun.
John Miller can be heard saying: “If you come closer to me, I’m gonna kill you.
“If you come within three feet of me, I’m going to kill you.”
Shots are then fired and Mr Howard can be seen lying on the ground with a bleeding head wound.
Miss Box told the Star-Telegram: “I stepped in between Aaron and John (Miller), then my ears started ringing from the gunshots.
According to Miss Box, John Miller walked up to her and put his handgun against her head, ordering her to get down.
She said she decided to release the disturbing footage to a television news broadcast because she said people deserved to know what happened.

It began, police say, as a dispute among neighbors in Abilene, Tex. Two families argued about where to dump trash in an adjacent alleyway. Insults escalated to threats, and a father and son, both armed, allegedly shot and killed a 37-year-old man who lived next door in an encounter captured on camera.
Police have arrested the alleged shooters, 67-year-old John Miller and 31-year-old Michael Miller, who have been charged with murder in the death of Aaron Howard.
The Sept. 1 standoff between the neighbors, which ended in the fatal shooting, was the final argument in a days-long feud over trash disposal, said Abilene Police Chief Stan Standridge, speaking at a news conference about an hour after the incident.
“It’s been going on for a couple days, and it culminated in today’s violence,” Standridge said.
Howard was killed in front of his brother and his common-law wife, Kara Box, who recorded the encounter on her cellphone. The Fort Worth Star-Telegram published the footage on Thursday, which gives a rare glimpse into a deadly dispute and sheds new light on a weeks-old killing.
Reached by phone, the Millers declined to discuss the incident.
The video, at a little over two and a half minutes unedited, begins with the Millers, guns drawn, staring Howard down, a flipped twin mattress between them. That mattress, Box told the Star-Telegram , was the conflict’s catalyst.
Box and Howard had thrown the mattress in the dumpster a couple days earlier, she said. But on Sept. 1, they saw the mattress back on their property. So Howard moved it back to the dumpster. Box said Howard’s nieces, nephews and brothers were with them, too. She told the paper that she and her husband then watched the elder Miller, John, walk to the dumpster, pull the mattress out and toss it back on Howard’s property.
That’s when, Box said, Howard and Miller started shouting at each other. John Miller pulled a handgun out of his basketball shorts, she said, and, at some point, his son arrived with a shotgun. Then Box started to record.
“Oh yeah, you’re going to jail,” Howard can be heard saying in the video.
“Nah I’m not,” John Miller replies. He’s holding his handgun at his side. Behind him, Michael Miller has a shotgun in his right hand and is resting it on his shoulder, behind his head. His left hand is in the front pocket of his jeans. The Millers are shirtless.
“Back off . . . If you come closer to me, I’m gonna kill you,” John Miller says calmly.
In an interview with the Star-Telegram, Box said Howard was very protective of his family, especially his nieces and nephews — who he refers to as “my kids” in the video.
“Hey, you hear him say he’s gonna kill me?” Howard, who appears unarmed, asks Box, before turning back to the Millers. “I’m at the dumpster. Put the gun up and go inside. You pulled a gun in front of my kids over . . . a mattress.”
The men begin trading insults, their voices get louder. Howard tells the Millers, “You’re dead. I promise you, you’re both dead . . . I’m gonna kill you.”
Michael Miller then interrupts and advises, “If you’re gonna show this video to the cops, you might as well stop yelling that you’re gonna kill us.”
Howard responds that he doesn’t care and repeats his threat.
“If you come within three foot of me, I’m gonna kill you,” John Miller says.
“You’re not going to shoot my husband,” Box responds.
A couple seconds later, pops can be heard and the camera moves wildly. Then Michael Miller is seen taking aim with his shotgun. More pops.
“Aaron? Aaron? No! No!” Box screams.
Howard had been shot at least twice, said Standridge, the police chief. But those who called 911 reported hearing as many as five shots fired, he said. At the news conference, Standridge didn’t disclose where on his body Howard had been shot, but said he died after being transported to the hospital.
The investigation is ongoing, the chief said then.
On Thursday, John and Michael Miller said they didn’t want to talk about that day or the charges against them.
“I really don’t have a comment one way or the other,” John Miller told The Washington Post. “This is something that I consider a private matter between me and the state of Texas.”
The Millers were booked into Taylor County Jail on murder charges, but were released ahead of their court dates after they posted a $25,000 bail, the Star-Telegram reported .
Box still lives in Abilene, she told the newspaper.
But not in the house next to the Millers.

A father and son from Abilene, Texas, were charged with murder after they were caught on video fatally shooting their neighbor during a dispute over trash.
John Miller, 67, and his son, Michael Miller, 31, were charged with first-degree murder in the death of Aaron Howard, 37.
They were arrested Sept. 1, but were released a day later on a surety bond of $25,000, jail records showed.
However, the two men were taken into custody on Friday after a district court reviewed the initial bonds and raised them to $250,000 each, police said Friday.
The deadly encounter between the neighbors was recorded on video by Howard’s common-law wife Kara Box.
The video, published by the Star-Telegram, showed the Millers — armed with guns — arguing with Howard over a mattress that Howard had dumped in the shared alleyway behind their homes on Don Juan Street.
The video captured the Millers firing multiple rounds at Howard who was shot at least twice, police said. He died after being transported to the hospital, police said.
Both the Millers admitted to shooting Howard, police said.
Abilene Police Chief Stan Standridge said that the neighbors began arguing over trash in the alleyway a “couple of days” before the Sept. 1 shooting.
Box told the Star-Telegram that she and Howard had thrown out a twin mattress in a dumpster in the alley a few days before the shooting.
On the morning of Sept. 1, the couple saw that the mattress was on their property so they tossed it back in the dumpster, Box said. This prompted their next-door neighbor John Miller to throw the mattress back on their property, Box said.
An argument ensued between Howard and John Miller who refused to put the mattress back in the dumpster and then pulled a handgun out of his pocket, Box said.
This enraged Howard, who accused his neighbor of pulling a gun while his nieces and nephews were in the backyard with him, according to Box.
The fight escalated when John’s son, Michael Miller, retrieved a shotgun from his residence, police said.
There were a total of five people in the alley, including the Millers, Howard, Box, and an unidentified member of Howard’s family, police said.
In the video, both Box and Howard can be heard shouting at John Miller for pulling a gun in front of children.
“If you come closer to me, I’ll kill you,” John Miller is heard telling Howard.
Howard — who did not have a gun — is heard repeatedly telling John Miller that he was going to kill him.
“You’re in an alley with a shotgun, you piece of shit,” Howard is heard saying. “I’m going to kill you.” “I doubt it,” the older Miller responds.
Michael Miller, who is seen standing behind his father holding a shotgun over his shoulder, then tells Howard, “First of all, if you’re going to show this video to the cops you might as well stop yelling that you’re going to kill us.”
Howard is then heard yelling, “I don't give a fuck. I will fucking kill you. You pulled a gun on my kids.”
John Miller is heard telling Howard to “back up” several times.
At some point during the confrontation, Howard’s family member reportedly retrieved a baseball bat from their residence, according to police.
John Miller is then heard egging Howard on to “take a swing” at him, while Howard repeatedly provokes him to point the gun at him.
Howard then tells the younger Miller, “You're a bitch, I’m going to kill you too,” to which the son responds, “Fuck off, cocksucker.”
“If you come within three feet of me, I’m going to kill you,” the older Miller is heard telling Howard.
Box interjects, saying, “You're not going to shoot my husband.”
Howard repeatedly shouts, “shoot me” and “point it.”
At least two gunshots are then heard on the video, after which Michael Miller can be seen firing his shotgun.
At least another four shots can be heard in the video, and police said that callers reported as many as five shots being fired.
Box is then heard screaming, “Aaron, no, no,” as she rushed toward her husband.
Box told the Star-Telegram that John Miller then put the handgun to her head and yelled at her to get on the ground, while his son went to Howard’s brother and placed the shotgun to his head. Police responded to the scene shortly after.
A detective who reviewed the footage believed that it was apparent from the video and interviews with the Millers that "they were tired of their neighbor, Aaron Howard, acting out and yelling and threatening them verbally," according to a statement released by Abilene police on Friday.
The statement said that Howard "got more and more upset" during the argument as the Millers stood in the alley with their firearms.
Police said that John Miller fired the first rounds as soon as Howard raised his baseball bat while standing approximately seven feet away from John. At the time when Michael Miller discharged his shotgun, and his father fired the final two rounds, Howard was unarmed, police said.
“I really don’t have a comment one way or the other,” John Miller told the Washington Post on Thursday. “This is something that I consider a private matter between me and the state of Texas.”
The Millers could not be reached for comment Friday.
“[The Millers] deserve to spend your lives in prison,” Box told KTXS.
She did not respond to BuzzFeed News’ request for comment.
